ZONING BOARD OF APPEALS South Beach Street Nantucket, MA 02554 Assessor's Map 42.3.2 Parcel 45 ROH 7 Twin Street Deed Ref: 154/263 Plan Book 10, Page 46 At a Public Hearing of the ZONING BOARD OF APPEALS held at 1:00 P.M., Friday, May 12, 2000, in the Conference Room at the Town Building Annex, 37 Washington Street, Nantucket, Massachusetts, on the Application of THE THEATRE WORKSHOP OF NANTUCKET, INC., for itself as Owner and WAYNE DUPONT, contract purchaser, PO Box 1297, Nantucket, MA 02554, Board of Appeals File No. 037-00, the Board made the following Decision: 1. Applicant (Dupont) is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33A (alteration of apre-existing nonconforming structure/use). Applicant proposes to alter the nonconforming use of an existing structure, currently used as a dance/artist studio and for theatre storage, by converting it to use as a single family dwelling. Applicant proposes to demolish the rear about 768 square foot portion of the structure and expand the building by constructing a conforming about 480 square foot addition on the easterly side and a deck on the rear. The "portable mini-storage" container will be removed. Two (2) parking spaces will be provided on-site. Applicant is also seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33E(2) to allow the construction of the addition as proposed with a resulting ground cover ratio of about 34°~ (or about 1440 square feet), in the ROH district that allows a maximum ground cover ratio of 30°r6 for undersized lots. Relief by Special Permit is available to increase the ground cover ratio for these lots to a maximum of 50°~. The Locus is nonconforming as to lot size with the Lot containing about 4,230 square feet of area in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Lot having about 43.02 feet of frontage along Twin Street in a district that requires a minimum frontage of 50 feet; as to ground cover with the Lot currently containing about 42.2°r6 in a district that requires a maximum ground cover ratio of 30°~ for undersized lots; and as to setbacks with the current structure being sited at about 2.2 feet at its closest point from the westerly side yard lot line and about 1.3 feet at its closest point from the westerly side yard lot line and about 1.3 feet at its closest point from the rear yard lot line in a district that requires a minimum side and rear yard setback of five (5) feet. See also BOA File No. 080-98 (withdrawn). The Premises is located at 7 TWIN STREET, Assessors Map 42.3.2, Parcel 45, Plan Book 10, Page 46. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted therewith, and the testimony and evidence introduced at the hearing. There was no recommendation from the Planning Board as the Board determined that the matter was not a planning concern. One (1) abutter spoke in favor saying it will improve the neighbofiood. There were no letters on file. 3. Applicant presented plans for the renovations which have been approved by the Nantucket Historic Districts Commission (Certificate No. 35639). He explained that the use of the property would be strictly residential in conformance with all applicable provisions of the Zoning Bylaw as to use. All rights as a grand~athered dance studio/theatre "use would be abandoned upon issuance of the Building Permit for the residential renovation. As the plans indicate, the mini-storage container will be removed from the Premises. Additionally, the rear portion of the existing building measuring 32' x 24' (768 square feet) which violates the side and rear yard setbacks is going to be demolished. An addition of about 480 square feet which would conform with side and rear yard setbacks is to be constructed on the easterly side of the remaining portion of the building, together with a deck at the rear of the remaining building, said deck to comply with all setback requirements. When the work is completed, the ground cover will be reduced from about 46°r6 (including min-storage containers) to about 34°~. Applicant will provide two (2) off-street parking spaces in conformance with the Zoning Bylaw. 4. Therefore, the Board finds that relief is required under Chapter 139, Section 33A, because of the pre-existing non-conforming nature of the lot and the use thereon; and the Board finds that relief is required under Chapter 139, Section 33(e), because the renovated structure, while it will have less ground cover than the existing structure, will still be in excess of 30°~ ground cover. The Board further finds that the renovations and change in use will not be substantially more detrimental to the neighbofiood than the existing non-conformity and will be beneficial to the residential character of the neighbofiood. 5. Accordingly, by UNANIMOUS vote, THE BOARD GRANTS THE SPECIAL PERMIT under Zoning Bylaw Section 139-33A, to allow the conversion to residential use and the demolition of the rear portion of the building as proposed: GRANTS SPECIAL PERMIT relief under Zoning Bylaw Section 139-33E(2) allowing construction of the addition with a resultant total ground coverage ratio of approximately 34%. Both of the above SPECIAL PERMITS are granted upon the following condition: a. The project is to be completed in substantial conformance with approved H.D.C. plans (File No. 35639), as may be amended. b. The project is to be completed in substantial conformance with site plan prepared by Emack Surveying, dated May 29, 1998, a copy of which is attached hereto as Exhibit "A".
