NANTUCKET ZONING BOARD OF APPEALS 37 Washington Street Nantucket, Massachusetts 02554 Map 49.2.3 Parcel 017 R-2 25 Sankaty Avenue Book 176, Page 55 At a public hearing of the Zoning Board of Appeals held at 1:00 P.M. on Friday, the 12`" day of May, 2000 at the Town Building Annex, 37 Washington Street, Nantucket, Massachusetts on the application of Edward Foley Vaughan, 15 Fair Street, P. O. Box 659, Nantucket, Massachusetts 02554, Board of Appeals File No. 033-00, the Board made the following DECISION: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-33A (alteration/expansion of a preexisting nonconforming structure/use). Applicant proposes to demolish and reconstruct an existing secondary dwelling. The about 455 square-foot dwelling is currently attached to the primary single- family dwelling and is nonconforming as to northerly side yard and westerly front yard setback requirements. Applicant wishes to reconstruct a new detached secondary dwelling outside of the required 30-foot front yard setback area but relocated to the south of its present location. The height of the structure would be increased from about 20 feet to about 24 feet. At the time of its construction in 1969 the secondary dwelling met then Residential-1 ground cover requirements of 30%. Zoning was changed in 1984 to Residential-2 reducing the ground cover to 12.5%. The Locus currently contains a nonconforming ground cover ratio of about 18% and will not change with the new secondary dwelling. Applicant is asking to maintain the grandfathered status of the Locus as to ground cover ratio. In the alternative, or to the extent necessary, Applicant is seeking relief by VARIANCE under Nantucket Zoning Bylaw Section 139-16 to complete the project as proposed. The Locus is also nonconforming as to lot size, with the Locus containing about 9,060 square feet of area in a district that requires a minimum lot size of 20,000 square feet; as to northerly side yard setback with the primary structure being sited at about 3.1 feet at its closest point from that lot line in a district that requires a minimum of 10 feet; and as to frontage, with the Lot having about 72.3 feet along Sankaty Avenue in a district that requires a minimum frontage of 75 feet. The Premises is located at 25 SANKATY AVENUE, SIASCONSET, Assessor's Map 49.2.3, Parcel 17, Plan Book 2, Page 52, Lot 3. The property is zoned Residential-2. 2. The Decision is based upon the application and materials submitted with it, the testimony and evidence presented at the hearing including Polaroid photos of the structure and 8 letters from neighbors and abutters which were submitted in favor of the application. There were no letters written in opposition to the project nor did any of the neighbors or abutters appear at the hearing. 3. The recommendation of the Planning Board was negative. It felt that the structure did not meet present criteria fora "secondary dwelling", but it was uncontradicted that the structure is a separate dwelling constructed at a time when there was no definition of a secondary dwelling. The relief requested will, in fact, bring the dwelling into conformity with the current definition of a secondary dwelling. The Board also likened the existing structure to a duplex configuration, but a duplex contemplates a single structure with 2 dwelling units. What exists are 2 structures which are attached but which do not permit any passage one to the other. The second issue of the Planning Board raised the question of what would happen if the proposed demolition brought the existing ground cover ratio below 12'/z%, but, as shown below, that is not the case. 4. Applicant presented evidence that the property consists of 2 attached buildings, neither accessible from the other, the original constructed sometime in the 1920s and the second building constructed in 1969 prior to zoning. There is no ability to move from one structure to the other without going outside. Each structure has 2 separate entrances. Each structure is a dwelling unit within the meaning of the Zoning By-Law. Applicant also testified that the neighborhood contains a number of 2 story secondary dwellings. 5. At the time of the enactment of the Zoning By-Law in 1972, the premises were conforming in all respects. Thereafter sideline setbacks of 5 feet were introduced with the result that a portion of the north side of the primary dwelling, 3.1 feet from the sideline, is within the sideline setback. Sconset was re-zoned in 1984 and the zoning for locus changed from R-1 to R-2. This zoning change made the property nonconforming as to the front-yard setback (26.3 feet from property lint, 30 feet required), nonconforming as to the frontage (75 feet being required and 72.3 feet existing) and nonconforming as to ground-cover ratio (1,132 square feet allowed [12'/z%]; 1,660.92 existing [18.33%]). 6. Applicant explained that he would like to demolish the existing secondary dwelling and replace it with one having not more than the existing 467.18 square feet of 2 ground cover and which would meet all dimensional requirements on side and front yard setbacks. 7. Applicant believes that the lot, at the time the structure is removed, will momentarily become more conforming, although, it will continue to be non-conforming as to ground cover ratio. Specifically, after demolishing the secondary dwelling there will remain ground cover of 1,193.74 square feet (13.17%). Consequently, Applicant seeks a Special Permit under § 139-33A of the By-law. 8. Applicant referred the Board to 4 recent cases (see Thomas Family Realty Trust [075-92) and related cases) in which this Board has allowed a lot to retain the benefit of a grandfathered non-conformity even though a portion of the building is, for a moment in time, made more conforming during the course of its demolition and reconstruction, provided the nature of the non-conformity is not altered or increased. 9. Therefore, the Board finds that in light of the fact that Applicant's house is in a neighborhood where secondary dwellings are routinely constructed of 2 stories, that demolition and reconstruction will take place with no change in footprint size and by doing so will bring the property into greater dimensional and definitional conformity with the Nantucket Zoning Bylaw, the proposed demolition, reconstruction and height-increase of the secondary dwelling will not be substantially more detrimental to the neighborhood than the existing structure. 10. Accordingly, by UNANIMOUS vote (Waine, Toole, Hourihan, O'Mara and Sevrens in favor) the Board GRANTS the Applicant a SPECIAL PERMIT under § 139- 33Aupon the following conditions: (a) The demolition, reconstruction and increase in height of the secondary dwelling shall be done in accordance with the plan drawn by Hart-Blackwell & Associates dated March 3, 1987, submitted with the application. and attached hereto and marked Exhibit A; (b) the Applicant will contimae to provide a minimum of 2 off street parking spaces; and (c) the reconstructed secondary dwelling will not have ground cover in excess of 467.18 square feet and will meet all dimensional and setback requirements. TC_/~_ mailed_/~_ See related cases lawsuits other ADDENDUM A I am seeking a special permit pursuant to § 139-33 A of the Nantucket Zoning By-Law to allow for the demolition and reconstruction of the existing secondary dwelling on my property in `Sconset, which has a footprint of 16.25x 28 or 455 square feet. The secondary dwelling is presently attached to the primary dwelling. I plan to replace it with a new single family dwelling on the Premises using the same footprint, but moving the secondary dwelling from its present location on the northwest portion of the lot to a new location on the southwest portion of the lot and bringing the stricture outside the 30 foot front yard set back. The height of the existing building would be increased from roughly 20 feet to 24 feet. The secondary dwelling on the Premises is apre-existing, attached, non- conforming structure. It was built in 1969 before coning. When zoning came into effect, ._ the two dwellings were in an R-1 district with no front yard set back requirement; a side line set back requirement of 5 feet, a minimum lot size of 5,000 square feet, frontage of 50 feet and allowable ground cover of 30%. In other words, confon7ung in all respects except as to the northerly side Iine set back. As a consequence of the up-zoning to R-2 in Sconset in 1984, the structure protrudes slightly into the front yard set back and is 26.3_+ feet from the front lot line. This will now be made conforming as to the set back. Existing ground cover is approximately 18%+, is grandfathered and will not change. Allowable ground cover is 12.5%. The property has 72.3 feet of frontage. The now required frontage is 75 feet. I propose to demolish the existing secondary dwelling and to reconstruct same. Once the existing structure is demolished, the lot will still be non-conforming by a few feet.
