At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m.
on Friday, May 12, 2000 (originally noticed for Friday, April 7, 2000 and continued
without opening the hearing to May 12, 2000), Conference Room, Town Annex, 37
Washington Street, Nantucket, Massachusetts, on the Application of ANN R.
TEASDALE of P.O. Box 157, Nantucket, MA 02554, Board of Appeals File No. 031-00,
the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw
Section 139-7F in order to place an employer dormitory in a proposed new second floor
addition to be constructed over an existing commercial warehouse. There would be a
maximum of eight (8) to ten (10) employees in what would initially be one (1) dwelling
unit. Applicant is asking that she be allowed to convert the one (1) unit to two (2)
separate two-bedroom units when the municipal sewer system is extended to the
subject Lot. To the extent necessary, Applicant is also seeking a MODIFICATION of
the Special Permit granted in the Decision in BOA File No. 056-92 to allow the use as
proposed. In addition, Applicant is seeking relief by SPECIAL PERMIT under
Nantucket Zoning Bylaw Section 139-18 (Parking Requirements) to waive up to three
(3) additional parking spaces with seven (7) being provided on site.
The Premises is located at 19 Teasdale Circle, Assessor's Map 69, Parcel 67,
Land Court Plan No. 14342-P, Lot 50. The property is zoned Residential-Commercial-
2.
2. The Decision is based upon the Application and materials submitted with it and
the testimony and evidence presented at the Hearing. The Planning Board made a
positive recommendation provided a Dormitory Management Plan be incorporated in
the decision. There were five (5) letters from abutters supporting the Application.
There were no abutters present at the Hearing.
3. Applicant, through counsel, represented that she is planning to add a second
story to the existing building which will be 2,040± square feet for an employer dormitory.
Applicant owns four (4) retail stores and employs between thirty (30) and thirty-five (35)
employees each season. Some of her employees have family housing on-Island.
However, many of her employees do not have housing. Applicant will use the dormitory
to house between eight (8) to ten (10) employees until the sewer system is extended.
At that time, Applicant will convert the dormitory into two (2) separate, two-bedroom
units and this conversion would not require any additional relief and are allowed as a
matter of right without permits from this Board. Applicant presently has seven (7)
conforming, on-site parking spaces. Based on the present use for 3,936 square feet of
commercial space, four (4) spaces are required. The dormitory use would require six
(6) spaces; (two spaces for a dormitory plus one-half a space for every employee over
two (2) with a total of up to ten (10) employees) which would be a total of up to six (6)
spaces for the dormitory. Thus, the total parking spaces required would be ten (10) and
a waiver of three (3) spaces would be necessary and is requested. Upon conversion,
the lot would contain the required amount of parking spaces. A Modification of Board of
Appeals File 056-92 is also necessary to allow for the employee dormitory and the
waiver of three (3) parking spaces. The loading zone will remain unchanged and
continue to be provided.
4. Therefore, the Board finds that the addition of a second floor for an employee
dormitory will not be substantially more detrimental to the neighborhood and will be in
harmony with the general purpose and intent of the Bylaw. Additionally, the Board finds
that the waiver of three (3) parking spaces, with seven (7) being provided on site, is in
harmony with the purpose and intent of the Zoning Bylaw and not contrary to sound
traffic and safety considerations as many employees will not have vehicles and the
property is on the shuttle route. The Board further finds that a Modification of the
Special Permit granted in Board of Appeals File 056-92 is appropriate to allow for the
construction of the second floor employee dormitory/two (2), two-bedroom apartments.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested
SPECIAL PERMIT relief under Section 139-7D in order to place an employee dormitory
in a proposed new second floor addition with the understanding that the dormitory may
be converted to two (2) separate two (2) bedroom units when the municipal sewer
system is extended to the subject lot without further relief from this Board. Additionally,
the Board GRANTS a MODIFICATION of the SPECIAL PERMIT granted in Board of
Appeals File 056-92 to allow the construction of the second floor for use as an
employee dormitory/two apartments. Further, the Board GRANTS the requested
SPECIAL PERMIT relief under Section 139-18 to waive up to three (3) additional
parking spaces, upon the following conditions:
(a) Applicant shall comply with the "Sample Dormitory Management Plan"
approved by the Nantucket Planning Board on December 20, 1999 and marked as
Exhibit A and attached hereto.
(b) All conditions incorporated in Board of Appeals Decision 056-92 shall remain
in force.

5ampfe Dormitory Management Plan
1. The property owner shall be responsible to piarrt and permanently maintain a compact hedge at
least four feet high along the perimeter of the lot (except along any common driveway) to
provide scr~tung from neighboring parcels.
2. The property owner shall be responsible to plant and permaatetitly inairrtain at least two shade
trees of at least four inches caliper in locations deternrined by the ZBA to best minimize the
visual impact of the buiiditrg and parkimg area, as show on the e~rdorsed site plan.
3. All exterior lighting shall be directed generally downward and placed so as to not be directed at
any neighboring parcels.
4. The locus shall be serviced by a cotnmercial trash removal service, with trash to be removed at
regular, frequent izrten•als year-round, as needed.
5, No exterior storage of .furniture (with the exception of items typically used as lawn firrrriture;,
refuse, rxrechanical components, debris, unresistered or inoperable vehicles, or other materials
constituting a nuisance, shall be permitted on the locus.
6. No loud znusie or other noise violating the Nantucket noise by-law or any other provision of law
from tune to time in erect shall be permitted upon the lot.
7. The dorrnitvry building upon tl~e locus shall not be used f'or the housitag of any persons except
for employees oi'an ownner of the locus, or en~loyees of a tenant of an owner of the locus. No
portioza of any building upon the locus shall be rented to any person for occupancy by such
person; all tenants shall be etployers, and all occupants shall t>e employees of an owner or
tenant, who are licensed by their respective employers to o+:cupy a space in the dormitory by
virtue of tl~ir employment and for only so long as their employment shalt continue. No
subtenancies of the buildings upon the locus or any portion thezeaf shall be permitted.
8. Bach lease to an employer shall set Earth that the employer shall be responsible for compliance
with all provisions of these conditions by the employees of such ezrployer and within the area
leased to such employer.
g. Tire property owner shall employ an individual resident ixranager, or designate a tenant for the
same, who shall reside iu the dorrraitory building. The resident manager shall be required to take
action to address neighbor's complaints, and shall maintain an open log ofthe complaints arzd
action taken to abate each problem. The lag shall be subzrritted to the Building Departinez~t on a

and a representative of each new employer housing employees shall be required tv attend, in
order to eztisuz'e that each employer and each employee fully understand all conditiozts, rules and
regulations applicable to the dornmtory,
i 7. The Zoning Board of Appeals shall retain the right to revoke and/'or amend the special permit if,
in the opinion of the Board, the continuation of the dormitory special permit would be
i[tconsistent with the intent of the Zoning Bylaw or the; intent of the original special permit,
based on citizen COricerns, a review of complaints logged by the resident manager and/or any
other evidence from law enl'orcernent ol~icials, residents or Board members.

DECISION:
The Nantucket Board of Appeals, at a public meeting held on
Friday, July 10, 1991, at 1:00 P.M. in the Town and County
Building, Nantucket, Massachusetts, made the following decision
upon the Application of Ann R. Teasdale (056-92), c/o David J.
Moretti, Attorney-at-Law, 13 Goldfinch Drive, N.P.P. Suite 64,
Nantucket, Massachusetts 02554.
1. Applicant seeks relief by Special Permit pursuant to
Section 139-9B(2) (a,b,c and f) as well as Section 139-20C to allow
the construction and use of a structure for light manufacturing,
storage and warehousing, printing and publishing, etc. associated
with her retail clothing and silk screening business. No retail
sales from this site are proposed. Additionally, Applicant seeks
relief from compliance with Section 139-20C, insofar as Applicant
proposes a "Loading Area" within the front yard setback from
Teasdale Circle.
2. The premises are located at 19 Teasdale Circle, and shown
as Assessor's Map 69 Parcel 67. The premises is shown as Lot 50
on L.C. Plan 14342-P, endorsed, "Approved", by the Nantucket
Planning Board on July 22, 1985, and has the benefit of an eight-
year "freeze period." The district is zoned Residential-
Commercial .
3. Our findings are based upon the application papers,
including HDC approved plans, site plans, testimony _, and
representations at the hearing.
4. The uses proposed by this project are consistent with the
uses contemplated for the subdivision and historically permit~ed_in ~.,
the area. Therefore, we find that the proposed structure and~u;ses
are in harmony with the general purpose and intent of the Nu~~et
Zoning By-law, provided the conditions recited below are employed.
5. As regards relief from the off-street loading
requirements, the Applicant seeks to take advantage of new Section
139-20.C, voted at the Annual Town Meeting on May 6, 1992. In
order to make such relief available, Applicant must file at the
Nantucket Registry, prior to the use hereof, the necessary
instruments to waive the provisions of MGLA c. 40A, Section 6 and
Section 139-33 of the By-law. With that condition, we find that
granting the requested relief is in harmony with the general
purpose and intent of the By-law. Moreover because restrictions on
this rectangular corner lot, imposed as a condition of the
subdivision approval, prohibit driveway access from Nobadeer Farm
Road and Hinsdale Road as well as establish an additional front
yard setback from Nobadeer Farm Road, and given the proposed plans
approved by the HDC, we find that the provision of off-street
loading facilities outside of the setback areas is physically
impossible or if possible, will be impractical and would have an
adverse effect on the integrity of the neighborhood.
6. Accordingly, by unanimous vote this Board GRANTS to
Applicant the requested Special Permit
A. For construction and use of a building on the site for the
following:
- light manufacturing (139-9B(a));
- storage and warehousing (139-B(b);
- fabrication and assembly of component parts for off-
site construction or use (139-B(c), and
- printing and publishing (139-9B(f)), AND
B. For relief from the By-laws requirements for off-street
loading facilities to allow placement and compliance of the Loading
Space substantially as shown on the sketch plan annexed hereto as
Exhibit A and incorporated herein by this reference, to wit within
the frontyard setback as measured from Teasdale Circle,
upon the following CONDITIONS:
(i) the Owner of the land shall duly record at the
Nantucket Registry District for the Land Court an instrument
waiving the provisions of Section 6 of M.G.L.A. c. 40A and Section
139-33G, as provided in MGLA c. 40A Section 6 and By-law Section
139-33K;
(ii) no retail sales from the premises without further
relief or modification of this Permit from this Board;
(iii) Applicant shall provide proper containment and
ventilation for use of potentially hazardous supplies, and all
hazard materials shall be used, stored and disposed of in
accordance with all applicable federal, state and local regulations
for the same;
(iv) appropriate screening of the parking area and along
the easterly side (35') and southeasterly corner (7+') of the
loading space, all as shown on the sketch plan annexed hereto as
Exhibit A and incorporated herein by this reference.

final endorsement of the plans, subject to the condition that all
lots be tied into the public sewer system when said service is made
available to the development.
4. A separate legal instrument shall be prepared and executed_
and made legally effective to restrict all the lots to no further
subdivision and to one dwelling unit per lot, and a restriCti,on to

shall be obligated to approve the removal of these restrictions when
the development is connected to an active Town sewer line.
S. A separate legal instrument shall be prepared and executed
and made legally effective to restrict lots 1, 10, 11, and 12 from
having direct driveway access onto Nobadeer Farm Road and Lota 1, 2
and 3 from having direct driveway access onto Hinsdale Road. The
reverse. lot frontage restriction shall run with the land in
perpetuity and be binding upon the Grantors, their heirs, successors
and assigns.
6. A 10 foot wide right-of-way and bicycle path easement
shall be shown on the plans along the frontage of Lots 1, 10, 11 and
12 on Nobadeer Farm Road and provisions made to convey said easement
to the Town.
~. A 15 foot wide front yard setback requirement shall be
maintained along the frontage of Lots 1, 10, 21 and 12 from the edge
of Nobadeer Farm Road and a requirement to this effect shall be
included in all deeds out and run with the land in perpetuity.
8. The P1aBging Board agrees to grant waivers for the
'-following: guard ra~.ls and posts, bicycle path and bridges.
9. The Planning Board agrees to allow a 45 foot centerline
radius on the proposed interior road in substitution for the required
200 foot minimum radius, Section 4.03e of the Planning Board's Rules
and Regu~,ations.
