Box 3097, Nantucket, Massachusetts 02584, as owner and applicant, (Board of Appeals File No. 030-00), the Board made the following decision: Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law § 139-18B (Parking Requirements) to waive up to twenty-two (22) or 100% of the required on-site parking spaces to validate the existing uses contained in the"Parish House." The structure contains church offices, meeting rooms, a nursery school and the Nantucket Emergency Food Pantry. Four (4) truncated paved parking spaces currently exist on the subject property and will be maintained. In the alternative, Applicant seeks relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-18 to validate the four (4) parking spaces that range in length from about 19 feet to about 16 feet, where 20 feet is required, and waive all spaces over and above those in their entirety. In addition and to the extent necessary, the Applicant also seeks relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-20 to waive the loading zone requirement. In addition, should the Board deem it necessary, Applicant also requests a MODIFICATION of the relief granted in the Decision issued in BOA File No. 103-87 to allow the uses that exist. The Locus is nonconforming as to parking as described above; and as to setbacks, with the structure being sited at about 3.5 feet at its closest point from the southerly side yard lot line, and at about 1.4 feet at its closest point from the northerly side yard lot line in a district that requires a minimum side yard setback of five (5) feet. The Premises is located at 20 Fair Street, Assessor's Map 42.3.2, Parcels 7 and 65, Plan Book 7, Page 23, Lot B and Plan Book 24, Page 8. The property is zoned Residential-Old-Historic 2. This Decision is based upon the Application and materials submitted with it, along with the testimony and evidence presented at the hearing. The Planning Board made a favorable recommendation and an abutting property owner submitted a letter in support of the application. 3. The Applicant, through counsel, presented a plan of the property and structures thereon. The Applicant originally sought and was granted relief in BOA File No. 103-87 to alter and extend the nonconforming single-family dwelling on this property, which is separated from the Applicant's other properties on Fair Street by Bunker Court and use the expanded structure as the Parish House. Recently the Applicant discovered that additional relief to waive parking was required and should have been requested in the 1987 Application. Applicant represented that the Parish House contains the following uses that require on-site parking as set forth below under the Zoning Bylaw: Church offices, library and meeting rooms 3478 square feet at 1 space per 200 square feet = 17 spaces Nursery School 12 students at 1 space per 4 seats = 3 spaces Emergency Food Pantry 380 square feet at 1 space per 200 square feet = 2 spaces 1 employee at 1 space for every 3 employees = 0 spaces Total 22 spaces The Applicant further represented that there are four (4) truncated paved parking spaces on the property and when those spaces are full, users of the Parish House generally utilize the Church parking lot that lies just across Bunker Court, a dead end street that essentially runs through the parking lot. 4. Therefore, the Board finds that the existing uses of the Parish House are exempt religious and educational uses under Zoning Law, M.G.L. Chapter 40A and validates said uses to the extent required. The Board further finds that the requested Special Permit relief waiving parking is in harmony with the general purpose and intent of the Zoning Bylaw. A waiver of up to twenty-two (22) or 100% of the required on-site parking spaces for these uses is necessary because it is physically impossible to provide conforming parking spaces measuring 9 feet by 20 feet on the property. Said waiver would not have an adverse impact on or be contrary to sound traffic and safety considerations as the Church and the Parish House are in peak use at different times and share the Church parking lot. The Board further finds that a loading zone is not necessary or required under the Zoning Bylaw §139-20. Accordingly, by a unanimous vote, the Board GRANTS the requested SPECIAL PERMIT relief under Nantucket Zoning Bylaw § 139-18B waiving twenty-two (22), or 100% of the required on-site parking spaces for the above-stated religious and educational uses of the property, provided, however, that the four (4) truncated parking spaces on the property shall be maintained. MASSACHUSETTS 02554 DECISION: The BOARD OF APPEALS, at a Public Hearing held on Friday, September 18, 1987 at 1:30 p.m. in the Town and County Building, made the following decision upon the Application of ST. PAUL'S CHURCH (103-87) address 14 Fair Street, Nantucket, MA. 1: Applicant seeks a SPECIAL PERMIT under Section 139-33A of the Zoning By-law to alter and extend a single-family dwelling by constructing a two-story addition in place of an existing -single-story attached ell and detached 2-bay garage, adding religious uses comprising church administrative, educational and meeting uses said to be exempt under the Zoning Law M.G.L. Ch. 40A, ---- - -Section 3. The premises are located at 20 Fair Street, Assessor's Parcel 42.3.2-065, zoned Residential-Old Historic. 2. Our findings are based upon the Application papers ;including existing "as-built" and proposed site/plot plans and floor plans, and testimony and representations received at our hearing. We find that Applicant's proposed religious and educational uses are entitled to the exemption set forth in Chapter 40A of the Massachusetts General Laws, Section 3, second paragraph. Accordingly, it is not restricted to a dwelling use of the premises in the Residential-Old Historic District, but may add uses which are religious and educational including, per our Bylaw Section 139-17, such accessory uses as are customarily incidental to such principal uses, e.g., administrative. Zts proposed enlarged building remains, however, subject to reasonable zoning regulations concerning, inter alia, lot area parking and building coverage. ~~~~~, 28~ F,,~E 155 -2- St. Paul's Church 103-87 3. Here lot size is 5286 SF, i.e., greater than the 5000 SF minimum for the R-OH District per Section 139-16A. Permitted ground cover ratio of 50~ limits building cover to 2643 SF. Applicant's proposed 2300 SF cover is well within the permitted maximum. The lot is on the opposite side of a court or private way from Applicant's parking lot. 4. The side-yard setback required in the R-OH District is 5 feet. The southerly building line of Applicant's existing house is~only about 4 feet from the southerly lot line. However, Applicant represents that the house was constructed in 1901 with that siting, hence pre-existing the mid-1972 enactment of zoning in Nantucket. The existing garage is about 6 inches from the rear lot line, thus-also within the required 5-foot setback. As the. garage also pre-dated zoning, we find that such buildings are pre-existing, non-conforming, strictures. ' S. As required for relief by Special~Permit under Bylaw Section 139-33A, we find that Applicant's proposed improvement of the premises would not be substantially more detrimental to the neighborhood. No opposition was heard, and the Planning Board's recommendation was favorable. As shown on the plans of the proposed extended structure, the non-conformity with respect to setback will not be made more non-conforming.
