Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18, to waive one (1) required parking space. Applicant proposes to construct a secondary dwelling that would meet all dimensional zoning requirements. Applicant is able to provide two (2) off-street parking spaces that would be laid out in a "stacked" manner rather than side by side as required for the principal and proposed secondary dwelling. The Premises is located at 21 WESTCHESTER STREET, Assessor's Map 42.4.3, Parcel 6, Plan Book 15, Page 74, Lot 2. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board recommended that the Applicant make Application to that Board for secondary dwelling approval and review of the parking situation. There were no letters on file for or against the requested relief. 3. Applicant represented that the approximately 6,180 square foot Lot and principal single-family dwelling were conforming in all dimensional aspects. There was one (1) existing conforming parking space on site. Applicant proposes to construct a new conforming secondary dwelling to the rear of the property, which would require a second parking space to be provided on site. Due to the existing siting of the principal structure and steep grade changes on the Locus, the second parking space would need to be sited directly in front of the existing space in a "stacked" manner. The Bylaw requires one (1) parking space for each dwelling unit. Applicant is asking the Board to waive the one (1) additional space and allow the provision of two (2) stacked spaces. 4. Therefore, the Board finds that compliance with the parking requirements would be physically impractical and the grant of Special Permit relief would be in harmony with the general purpose and intent of the Zoning Bylaw and not contrary to sound traffic and safety considerations and compliance would possibly have an adverse effect on the historic integrity of the neighborhood. Two (2) parking spaces would in fact be provided on site, though in a stacked manner. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-18 to waive one (1) parking space upon the following condition: a.
