At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00
P.M., Friday, April 7, 2000, in the Conference Room, Town Annex Building, 37
Washington Street, Nantucket, Massachusetts, on the Application of
HYDRANGEA, L. P., 110 SE 6"' Street, Fort Lauderdale, FL 33335, Board of
Appeals File No. 028-00, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning
By-Law §139-33A (alteration/expansion of apre-existing nonconforming
structure/use). Applicant was granted a Special Permit in 1997 in BOA File No.
030-97 to construct an addition to an existing single family dwelling that was
intended to increase the ground cover ratio from about 928 SF (about 12.22°r6) to
about 1178 SF (about 15°r6). Upon a new survey having been done upon
completion of the project, it was found that the ground cover was actually about
1367 SF (about 17.8%). To the extent necessary, Applicant also seeks a
MODIFICATION of the Decision in BOA File No. 030-97 to validate the ground
cover as constructed. The Locus is nonconforming as to lot size with the Lot
containing about 7,674 SF of area in a district that requires a minimum lot size of
20,000 SF; and as to front yard setback with the structure being sited at about
12.5 feet at its closest point from the lot line along Cliff Road in a district that
requires a minimum front yard setback of 30 feet.
The Premises is located at 104 CLIFF ROAD, Assessor's Map 41, Parcel 11,
Land Court Plan No. 13328-D, Lot 4. The property is zoned Residential-2.
2. The Decision is based upon the Application and material submitted with it,
and the testimony and evidence presented at the Hearing. The Planning Board
made no recommendation as the matter was not of planning concern. There was
no support or opposition on file or expressed at the Hearing.
3. Applicant, through counsel, represented that this property was the
recipient of a Special Permit from this Board in 1997 (Case No. 030-97).
Pursuant to that Special Permit the single-family dwelling was renovated and
expanded. At the completion of the renovation, a surveyed plot plan was
prepared indicating that the dwelling, as renovated, had a ground cover of about
1367 SF, as noted on "As-Built Plot Plan" dated August 28, 1998, drawn by
Stephen J. Sullivan of Nantucket Surveyors, Inc., (see plan attached hereto as
Exhibit "A"). The Special Permit issued in 1997 stated that the renovations would
be completed in substantial accordance with plans submitted, said plans
indicating a completed ground cover of about 1178 SF. Applicant explained,
through counsel, that the structural integrity of the original house was not as
expected, and it was necessary for the contractor to make "on the job" changes
in the layout of walls and rooms. The as-built plan indicates that the renovated
dwelling complies with all setback requirements except for the front yard setback
of 12.4 feet which was not increased as a result of the work completed on this
project, which was apre-existing condition. Although the addition exceeds the
ground cover called for in the 1997 Decision, it is still well under the maximum
ground cover allowed of 1500 SF for lots of record. The land surrounding the
dwelling has been extensively landscaped which mitigates the front yard
intrusion.
4. Therefore, the Board finds that the structure, as renovated and completed
as shown on Exhibit "A", is not substantially more detrimental to the
neighborhood than the original nonconforming structure as approved in Board of
Appeals Case No. 030-97. The Board further finds that the renovations have
improved the appearance of the structure resulting in an aesthetic benefit to the
neighborhood and the additional ground cover has little impact upon the
neighborhood as no nonconforming set back distances were increased, and the
additional ground cover is still under the maximum allowable of 1,500 square
feet.
5. Accordingly, the Board, by unanimous vote (Hourihan, O'Mara, Parent,
Toole and Murphy) GRANTS relief by Special Permit under Nantucket Zoning
By-law §139-33A to alter and expand the structure in accordance with Exhibit
"A". The Board also GRANTS, by unanimous vote, a MODIFICATION of the
Special Permit granted in Case No. 030-97 to validate the existing ground cover
of the dwelling as shown on Exhibit "A", as a maximum of about 1,367 square
feet.

At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, April 4, 1997, in the Selectmen's Meeting Room,
Town and County Building, Broad Street, Nantucket, MA, on the Application
of HYDRANGEA, L.P., 110 SE 6th Street, Fort Lauderdale, FL 33335, Board
of Appeals File No. 030-97, the Board made the following Decision:
1. Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-33A (alteration/expansion of a pre-existing non-conforming
structure/use). Applicant proposes to expand a structure, said to be
pre-existing, by adding a new porch and kitchen addition on the westerly
side of the dwelling and a small bathroom addition onto the easterly
side. Approximately 72 square feet of the porch-kitchen addition on the
west and approximately 24 square feet of the bathroom addition on the
east will be sited within the required 30-foot front yard setback area.
The existing structure i5 non-conforming in that it is sited
approximately 12.4 feet at its closest point from the front yard lot
line along Cliff Road. The proposed additions will not come any closer to
the front yard lot line than the existing structure and will, in fact, be
to the rear of the front line of the house. The Locus is non-conforming
as to lot size, having a lot area of approximately 7,674 square feet in a
district that requires a minimum lot size of 20,000 square feet; and as
to front yard setback as stated above.
The premises is located at 104 Cliff Road, Assessor's Map 41,
Parcel 11, Land Court Plan 13328-D, Lot 4. The property is zoned
Residential-2.
2. The Decision is based upon the Application and material submitted-

3. Applicant, through counsel, represented that the Locus was a lot
of record containing 7,674+ square feet of lot area in the R-2 zoning
district that requires a minimum lot size of 20,000 square feet and thus
entitled to a maximum ground cover of 1500 square feet. The Lot currently
contains a 938+ square-foot single-family dwelling that is non-conforming
as to front yard setback being sited 12.4+ feet from the front yard lot
line along Cliff Road in a district that requires a minimum setback of 30
feet. Applicant proposes to add a covered porch that would extend down the
westerly side of the structure and along the entire southerly rear portion
of the house and add a deck on the southerly side of the porch. A dormer
will be added to the rear of the structure, outside of the 30-foot front
yard setback area, that will be contained entirely within the existing
footprint of the dwelling. Applicant will add a 170+ square-foot kitchen
addition on the westerly side within the footprint of the new porch and a
70+ square-foot bathroom addition on the east, increasing the ground cover
ratio from 12.22+% to 15+% or 1178+ square feet. A 24+ square-foot portion
of the bathroom addition will be sited within the 30-foot front yard
setback area but will be sited farther back from the front building line
of the existing dwelling. A 72+ square-foot portion of the new
porch/kitchen addition will also be sited within the 30-foot front yard
setback area but will come no closer to the front yard. lot line than the
existing structure. Applicant further represented that the impact of the
front yard setback intrusion was mitigated by extensive landscaping and
orientation of the structure.
4. Therefore, the Board finds that the proposed expansion of the
existing single-family dwelling by the construction of a covered porch,
deck, dormer, kitchen and bathroom additions will not be substantially
more detrimental to the neighborhood than the existing structure and that
the expansion falls within the spirit and intent of the By-Law. The Board
further finds that the project as proposed will improve the appearance of
the structure, resulting in a benefit to the neighborhood.
5. Accordingly, the Board, by a vote of four (4) in favor (O'Mara,
Williams, Leichter, Toole) and one (1) opposed (Sevrens), GRANTS the
requested relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A
to alter and expand the existing structure as described above upon the
following condition:
The structure shall be expanded in substantial conformance
with the plans submitted and on file at the Board of Appeals and done by
Nantucket Architecture Group, dated November 06, 1996, a portion of which
is attached hereto and marked as Exhibit A.
