At a PUBLIC HEARING of the Nantucket Board of Appeals held at 1:00 P.M.,
Friday, March 10, 2000 in the Conference Room, Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts 02554 on the application of TIMOTHY and ELIZABETH
ROSE BRIDGES of 2 Greglan Avenue, Suite 130, Nantucket, Massachusetts 02554, BOARD
OF APPEALS FILE NO. 024-00, the BOARD made the following decision:
1. Applicants are seeking relief by VARIANCE under Nantucket Zoning By-Law
Section 139-16A (Intensity Regulations). Applicants are asking the Board to validate two 92)
vacant lots with a combined frontage in excess of 100 feet and having a combined lot area of
approximately 11,364± square feet as one (1), separately marketable and buildable lot which
has not merged into an abutting parcel of improved land also owned by the Applicants and is
located at 11 Clifton Street, Siasconset. This improved land has an area of approximately
7,522+ square feet. The lots at issue were created in 1980 by an ANR Plan endorsed by the
Nantucket Planning Board. At that time, these lots were located in the RESIDENTIAL-1
zoning district and conformed to zoning intensity regulations. The zoning district for the lots
changed to RESIDENTIAL-2 in 1984. This zoning change required a minimum lot size of
20;000 square feet and the subject lots are non-conforming as to minimum lot size
requirements. Applicants ask the BOARD to grant them a VARIANCE to cure the "merger" of
the vacant lots with the improved lot, or, alternatively, to make a finding that the lots did not
"merge" for zoning purposes and, therefore, zoning relief is unnecessary.
The Premises is located at 5 COMEAU LANE, SIASCONSET, Assessor's Map
49.3.2, Parcel 33, Plan Book 21, Page 120 (Lots 1, 2, and 3). The property is zoned
RESIDENTIAL-2.
2. The Decision is based upon the application and materials submitted with it, and
the evidence presented at the hearing. The Planning Board recommended favorable relief if the
Applicants showed that the subject lots were held in separate ownership at the time this zoning
district was changed from Residential-1 to Residential-2 in 1984. There was one letter in
opposition on file. One abutter, through her attorney expressed concerns about this application
for relief.
3. Applicants, through counsel, represented that the purpose of the requested
VARIANCE relief was to validate two (2) vacant lots shown as Lots 1 and 2 in Plan Book 21,
Page 120 as a single, separate, buildable lot with a maximum ground cover for structure(s) of
1,500 square feet; and to validate the abutting, improved lot (Lot 3) as a separate, marketable
lot with no increase in the existing dwelling's ground cover without further relief from this
BOARD. The title history for the property reflects that Frank and Shirley Savarese purchased
the property as one (1) lot from Mr. and Mrs. John J. Santos by virtue of a deed dated
February 12, 1968 and recorded in Book 131, Page 534 at the Nantucket Registry of Deeds.
On or about 1974, the Savareses built the existing house on the southern portion of the
property. The Savareses divided the property into three (3) lots in 1979. This ANR plan was
endorsed by the Planning Board in 1980 and recorded at the Registry of Deeds in 1982. In
March, 1984, the Savareses put each lot into separate ownership by virtue of deeds dated
March 29, 1984 and recorded at the Nantucket Registry of Deeds in Book 212, Page 288 and
289. Shirley Savarese owned vacant Lot 1; Frank Savarese owned vacant Lot 2; and both
owned improved Lot 3. At this point in time, each of the lots conformed to the 5,00 square
feet minimum lot size requirement of the R-1 Zoning District. In April, 1984, the Nantucket
Town Meeting voted to change the zoning district for these lots from Residential 1 to
Residential 2, and the Savarese lots were rendered non-conforming as to minimum lot size
requirements because the R-2 Zoning District requires a minimum lot size of 20,000 square
feet. On or about 1997, the Applicants began negotiations to purchase the property from Frank
and Shirley Savarese. During the course of these negotiations, Frank Savarese died on
September 27, 1998, leaving his entire estate to his wife, Shirley Savarese. By operation of
law, title to the three (3) lots vested in Shirley Savarese and the lots "merged" for zoning
purposes. In November, 1998, Applicants purchased the improved lot (Lot 3) and a vacant lot
(Lot 1) from Shirley Savarese. They later acquired vacant lot (Lot 2) from her in separate title.
At all times, Applicants were careful to hold abutting, contiguous lots in different title to
preserve the pre-existing, non-conforming buildability and marketability of each lot.
Applicants now recognize that the vacant lots may have "merged" upon the death of Frank
Savarese and seek to combine both vacant lots into a single and separate buildable lot.
4. In these circumstances, the BOARD finds that a grant of VARIANCE relief is
warranted upon certain conditions. We find that the peculiar shape and configuration of these
lots are different from other lots in the RESIDENTIAL-2 zoning district, and a literal
enforcement of the Residential-2 intensity regulations would cause the Applicants an undue
hardship. The death of Frank Savarese arguably caused the "merger" of the lots; this event was
beyond the Applicants control. Applicants propose to combine vacant Lots 1 and 2 into a
single, buildable lot with a maximum ground cover of 1,500 square feet. Further, Applicants
are willing to limit the height of structures to be built on this lot. We find that a grant of
VARIANCE relief upon these conditions and a VARIANCE may be granted without
substantial detriment to the public good and without nullifying or substantially derogating from
the intent and purpose of the Zoning By-Law.
5. Accordingly, by a UNANIMOUS VOTE, the BOARD GRANTS the requested
VARIANCE under Nantucket Zoning By-Law Section 139-16A to validate vacant Lots 1 and 2
containing approximately 11,364 square feet on a Plan recorded in Plan Book 21, Page 120 at
the Nantucket Registry of Deeds as a combined, marketable and buildable lot; and to validate
improved Lot 3 containing approximately 7,522± square feet as shown on said Plan as a
single, separate, and marketable lot upon the following conditions:
a) The maximum allowable ground cover for the single, vacant lot created from
vacant Lots 1 and 2 ("New Vacant Lot') shall be 1,500 square feet;
b) No structures on the New Vacant Lot shall exceed a roof ridge height of twenty-
four (24±') feet from Mean Grade as defined in Section 139-2 of the By-law;
c) No roof walks or widows walks are to be constructed on the premises;
d) Any secondary dwelling on the combined lot shall not exceed 600± square feet
in ground cover; and
e) The maximum ground cover for Lot 3 ("House Lot") shall not exceed the
ground cover of the existing dwelling on the House Lot without further relief from this
BOARD. Applicants may, however, renovate the existing dwelling on the House Lot
by reducing its size and ground cover or, alternatively, by constructing a smaller
dwelling in its place, without further relief from this BOARD.

in 1984. Applicants are asking the Board to grant the relief requested or make a finding that the Lots did
not merge for zoning purposes and no relief is necessary.

Applicants, Timothy Bridges and Elizabeth- Rose Bridges, are. seeking relief by
Variance under Nantucket Zoning Bylaws Section 139-16A {intensity regulations-
minimum lot size) and Bylaw 139-2 (definitions) "Lot" to validate a lot (the "Locus")
located at 3 and 5 Comeau Road, Siasconset, as separately marketable and buildable from
an adjacent improved lot located at 11 Clifton Street, Siasconset (hereinafter "Dwelling
Lot").
The Locus is an unimproved parcel of land comprised of two lots with a combined
frontage in excess of 100 feet in a Zoning District with a minimum frontage requirement of
75 feet and having a combined lot area of 11,364 square feet in a zoning district with a
minimum lot size of 20,000 square feet. The Dwelling Lot pre-exists the adoption of the
Zoning Bylaw on Nantucket and is improved with apre-existing, non-conforming wood-
frame dwelling.
The Locus was created in 1979 by a Plan endorsed by the Nantucket Planning
Board as "approval under the subdivision control law not required". At the time of the
division, both lots camprising Locus and the adjacent Dwelling Lot conformed with the
requirements of the R-1 Zoning District. On April 3, 1984, this District changed from R-1
to R-2 with a minimum lot area of 20,000 square feet and minimum frontage of 75 feet.
At the time of the up-zoning, the northernmost of the two lots comprising Locus and the
Dwelling Lot were in separate record title from the middle vacant lot and in 1998 the
applicants purchased these properties. In 1999 the applicants purchased the middle vacant
lot at which time the Locus and Dwelling Lot came into common ownership.
Applicants now request a Variance from the requirements of the Nantucket Zoning
Bylaw to validate the Locus as separately marketable and buildable from the adjacent
improved property or, in the alternative, a Finding from the Zoning Board of Appeals that
no such relief is necessary or appropriate, the Locus already being and continuing to be, a
separate, pre-existing, non-conforming, buildable lot in conformity with all provisions of
the Nantucket Zoning Bylaw.
