At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, March 10, 2000, at 1:00 P.M., and continued to public hearings on Apri17, May 12, and June 9, 2000, all in the Conference Room in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts ,the Board made the following decision on the application (023-00) of GORDON C. MARK, TRUSTEE of 661 Blackthorn Road, Winnetka, IL 60093, in connection with property known as 13 Hallowell Lane, Nantucket, Massachusetts. 2. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A (alteration/expansion of apre-existing nonconforming structure/use). Applicant proposes to demolish and reconstruct a rear portion of a said to be pre-existing secondary dwelling. The existing structure is sited at about 1.6 feet at its closest point to the easterly side yard lot line and the new second story addition will come no closer to the easterly side yard lot line than the existing first floor rear portion of the structure but would extend the structure in a southerly direction without coming any closer to the easterly side yard lot line and would be sited at about 6.7 feet at its closest point. The structure would comply with maximum ground cover requirements. To the extent necessary, Applicant also seeks relief by VARIANCE under Section 139- 16A to complete the project as proposed. The Locus is also nonconforming as to westerly side yard setback with the main dwelling being sited at about 7.7 feet at its closest point from the side yard lot line in a district that requires a minimum side yard setback of ten (10) feet. The Premises is located at 13 HALLOWELL LANE, Assessor's Map 30, Parcels 11 and 12, Land Court Plan 12022-D, Lot 28B, and Land Court Plan 12022-H, Lot 28A. The property is zoned Residential-2. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearings. The Planning Board made a recommendation that a variance would be required for the relief requested, but that interpretation was reversed by staff after clarification of the project. There was no opposition to the relief requested presented at the hearing. 4. The Applicant proposes to demolish and reconstruct the rear portion of the pre-existing non-conforming dwelling as shown on the attached site plan, while leaving the waterfront portion of the house unchanged. The existing structure has existed in its current configuration since well prior to the imposition of zoning, with the Applicant's family having owned the property since the 1930s. The Applicant is seeking the relief to expand the existing structure to provide additional space for the growing extended family that utilizes the property. The existing building is 1.6 feet at its closest point from the easterly side property line, when a 10 foot set back is required. The portion of the house that is the closest to the property line is one story, contains an existing bathroom, and will not be demolished as a part of this project. The Applicant is seeking to minimize the impact of the project on those portions of the building that are not being expanded and therefore is proposing not to modify the northerly portion of the structure. The portion of the structure being reconstructed will be no more that 6.7 feet from the side property line, and therefore, while not complying with the 10 foot set back requirement, no closer to the property line than the portion of the house that is not being reconstructed. According to the preliminary elevation drawings presented at the hearing, a second floor will be constructed over that portion of the structure being renovated and some of this second story will be within the side yard setback and therefore higher than the existing structure within the setback. Architectural considerations given the proximity of the existing septic system and the constraints of integrating the reconstructed section with the remaining structure make full compliance with the 10 foot setback requirement impractical. 5. Board members were concerned about fire safety issues given the proximity of the one-story portion of the existing building containing the bathroom to the easterly property line, even though renovations to that portion of the structure were not proposed. The Applicant addressed these fire safety issues by offering to use fire retardant shingles on this portion of the building and to increase the fire rating of the existing east wall of the bathroom which lies within the side yard setback. 6. Therefore the Board finds that the demolition and reconstruction of the rear portion of the dwelling which is partially within the side yard setback so as to include a second story, while not fully compliant with the current setback requirements, will be no closer to the property line than the existing structure and will not be substantially more detrimental to the neighborhood. The increase in the height of a portion of the structure would be an intensification of 2 the set back intrusion, but the Board's fire safety concerns were addressed, the Board finds that the increase in height within the setback will not be substantially more detrimental to the neighborhood than the existing structure. 7. Accordingly, the Board of Appeals voted unanimously to GRANT the requested SPECIAL PERMIT under Section 139-33A to allow the proposed project on the following conditions: a. that the project be constructed substantially in accordance with the site plan dated Jan. 3, 2000, revised June 7, 2000 prepared for Gordon C. Mark, Tr., by Emack Surveying, a copy of which is attached hereto as Exhibit A, b. that the east wall of that portion of the existing structure closest to the easterly property line (containing the bathroom) be shingled with fire retardant shingles and that fire retardant sheetrock be installed on the interior of that wall, thereby increasing the wall's fire rating under the Building Code, and c. that the hedge along the easterly property line be maintained.
