At a Public Heazing of the NANTUCKET ZONING BOARD OF APPEALS held at 1:00
p.m., Friday, February 11, 2000, in the Conference Room, Town Annex Building, 37
Washington Street, Nantucket, Massachusetts on the Application of EDWARD SIMONIAN, of
45 Orange Street, Nantucket, Massachusetts 02554, Boazd of Appeals No. 018-00, the Boazd
made the following decision:
1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
Laws Section 139-33E(2xa) and Section 139-33A(4)(a) and (b). Applicant proposes to build a
14 foot f by 17 foot t addition to their existing single-family dwelling and adding 250f square
feet of additional ground cover onto the southwesterly side of the structure, without intruding
into the required 5 foot side yard setback area. The Bound cover would increase from about 942
square feet (thirty-two (32f%) percent) to about 1,191 squaze feet (forty (40f%) percent). In
addition, Applicant proposes to increase an existing rear single story portion of the structure to
two (2) stories over the existing footprint without coming any closer to the lot line than the
existing structure which intrudes into the setback area by about 1.9 feet. The Locus is non-
conforming as lot size with the lot containing about 2,960 squaze feet of area in a district that
requires a minimum lot size of 5,000 square feet; as to frontage with a lot containing about 45.2
feet of frontage along Pine Street in a district that requires a minimum frontage of 50 feet; as to
Ground Cover Ratio with a lot containing about thirty-two (32%) percent in a district that allows
a maximum Ground Cover Ratio of thirty (30%) percent for undersized lots; and as to side yard
setback with a structure being cited about 3.1 feet at its closest point from the northerly side yard
lot line in a district that requires a minimum of five (5) feet.
The Premises is located at 26 PINE STREET, Assessors Map 42.3.2, Parcel 109, Deed
reference 548/188. The Property is zoned residential old historic.
2. The Decision is based upon the application and materials submitted with it and
the testimony and evidence presented at the Hearing. The Planning Board made no
recommendation as the matter was not of planning concern. There was one (1) letter on file from
an abutter expressing concern about the proposed increase in ground cover. There was no
opposition expressed by members of the public in attendance at the hearing.
3. Applicant, through counsel, represents that the purpose of the Special Permit
relief under Section 139-33E(2)(a) is to allow an increase in ground cover ratio of the Locus
from 32f% to 40f%, by constructing an approximately 14 foot ~ by 17 foot f addition in the
southeasterly side yard of Locus outside of the required five (5') foot setback area. Applicant's
counsel stated that the request for an increase of approximately 250E square feet results in a new
ground cover ratio that is less than the fifty (50%) percent allowed under the new Zoning By-
Law adopted at the 1999 Annual Town Meeting. Said By-Law limits allowable ground cover to
30% for lots containing less than 5,000 square feet, however grants the special permit granting
authority the right to grant relief to allow the Bound cover to exceed thirty (30%) percent, but
not to exceed the permitted ground cover ratio in the zoning district where the lot is situated; in
this case, up to fifty (50%) percent as the Lot is in the Residential-Old-Historic District.
Applicant's counsel makes note of the fact that the area proposed for the addition to the structure
is in that portion of the yard with frontage on Farmer Street while the existing single-family
dwelling faces Pine Street. In other words, the addition is proposed in a yard area generally
abutting a street on one side, rather than another improved property.
4. Applicant, through counsel, further represents that the purpose of the Finding and
Special Permit Relief under Section 139-33A(4)(a) and (b) is to permit the increase to two (2)
stories of apre-existing non-conforming rear single-story portion of the structure, which
encroaches on the northerly five (5') foot side yard setback area by 1.9E feet, without coming
any closer to the lot line-than the pre-existing non-conforming structure. Applicant, through
counsel, submitted a "Mortgage Plot Plan of Land in Nantucket, Mass", drawn by Charles W.
Hart & Associates and dated September 27, 1999, as evidence to the Zoning Board of Appeals
showing the existing and proposed footprint. The Mortgage Plot Plan shows a triangular
encroachment of the northerly rear corner of the pre-existing, non-conforming single-story
addition into the side yard setback area that comprises an area less than five (5) f square feet.
Applicant, through counsel and Applicant's architect, stated that both the proposed addition,
adding approximately 250 t square feet of additional ground cover onto the southeasterly side of
the structure, without intruding into the required 5 foot side yard setback area and increasing the
rear single-story portion of the structure to two-stories over the existing footprint, without
coming any closer to the lot line than the pre-existing non-conforming structure are modest
requests and are in keeping with both the other dwellings in the neighborhood and Zoning
District and are in harmony with the general purpose and intent of the By-law.
5. Therefore, the Board finds that constructing the addition onto the southeasterly
side of the existing structure by adding about 250 t square feet of additional ground cover
increases the non-conforming ground cover. However, the Board further finds that said increase
in ground cover is not substantially more detrimental to the neighborhood than the existing, non-
conforming ground cover.
Additionally, the Board finds that increasing an existing rear single-story portion of the
structure to two (2) stories within the northerly side yard setback area, without coming any closer
to the northerly side yard lot line, will be an increase in the non-conforming nature of the setback
intrusion, as it will increase the upward massing of the structure within the required side yard
setback area. In addition, the Board finds that said increase to two (2) stories within the side
yard setback area will not be substantially more detrimental to the neighborhood than the pre-
existing non-conforming single-story addition.
6. Accordingly, by a vote of four (4) in favor (Hourihan, Parent, Sanford, Murphy)
and one (1) opposed (Sevrens), the Board GRANTS the requested SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-33E(2)(a} to increase the Bound cover ratio from 942E to
approximately 1,192E square feet by constructing a 14f foot by 17f foot addition onto the
southeasterly side of the structure; and GRANTS the requested SPECIAL PERMIT pursuant to
Nantucket Zoning By-law Section 139-33A(4)(a) and (b), permitting the extension of the pre-
existing non-conforming single-story dwelling to two (2) stories, without making the non-
conforming distance more non-conforming, upon the following conditions:
(a) The renovation of the pre-existing, non-conforming single-family dwelling by adding
a second story to the back of the structure, shall result in a maximum roof ridge height no higher
than the existing two (2) story portion of the structure; and
(b) The proposed 14t foot by 17t foot addition onto the southeasterly side of the
structure shall be constructed in substantial conformity with the plan entitled, "Mortgage Plot
Plan of Land in Nantucket, Mass", drawn by Charles W. Hart & Associates and dated September
27, 1999 and attached hereto as Exhibit "A".

ADDENDUM
The Applicants, Edward and Karen Simonian, seek Special Permits pursuant to
Section 139-33E(2)(a) and Section 139-33A(4)(a) and (b) of the Nantucket Zoning By-Law.
The Applicants propose to build a 14' x 17' + addition to their existing dwelling
consequently adding approximately 250 square feet of additional ground cover in the
buildable portion of the yard, and extend apre-existing, non-conforming structure without
making the non-conforming nature of the structure more non-conforming. The dwelling is
located at 26 Pine Street (the "Premises"). The Premises is located in the Residential Old
Historic District.
The Premises consists of a lot of land approximately 2,960± feet in size as improved
by atwo-storey, wood-framed single-family dwelling. The lot of land is non-conforming as
to lot size being situated in a Zoning District with a minimum lot size of 5,000 square feet.
The Premises is non-conforming as to side yard set back with a portion of the dwelling 3.1
feet, at its closest point, from the northern most property line in a Zoning District with a
minimum side yard set back requirement of five (5') feet. The Premises is non-conforming as
to ground cover ratio having a ground cover ratio of approximately 32% in a Zoning District
that allows 30% ground cover for lots containing less than 5,000 square feet. The Premises
is non-conforming as to frontage having a frontage of 45.2± feet on Pine Street in a Zoning
District with a minimum frontage requirement of fifty (50') feet.
The Applicants propose to construct an approximately 14' x 17' addition on the
southwesterly side of the Premises. Once constructed, the calculated ground cover will
increase from 942 ± square feet to 1,192 ± square feet. This will result in a ground cover
ratio of approximately 40 % ± in a Zoning District that allows 50% ground cover ratio by
Special Permit from the Nantucket Board of Appeals for lots with square footage less than
5,000 square feet.
Additionally, Applicants propose to increase the existing single-storey rear wing of
the dwelling to one and a half stories. A portion of the existing rear wing encroaches the
required side yard set back by approximately two feet. The increase from a single storey to a
storey and a half will not result in the non-conforming distance being made more non-
conforming.
The proposed addition and the consequent increase in ground cover ratio from 31 ±
to 40%± is consistent with other Premises in the neighborhood and as a result, is not
substantially more detrimental to the neighborhood. The proposed increase from a one store}~
rear addition that slightly encroaches the required side yard set back to a one and a half
storey addition is also consistent with other Premises in the neighborhood and is not
substantially more detrimental to the neighborhood. By granting the requested Special
Permits, the Board would be acting in a manner consistent with the spirit and intent of the
Nantucket Zoning By-Law.
The Applicants respectfully requests that the Board act in favor of the requested
Special Permits.
