KINNEY, of P.0. Box 611, Nantucket, MA 02554, Board of Appeals File No. 015-00, the Board made the following Decision: 1. Applicant is .seeking relief by VARIANCE under Nantucket Zoning Bylaw §139-16A (Intensity Regulations - setbacks). Applicant is asking the Board to validate the siting of a secondary dwelling constructed under Building Permit No. 1497-97.-Upon a surveyed site plan having been done dated 12/16/99 in conjunction with obtaining a Certificate of Occupancy, it was found that the new dwelling was constructed in violation of the required five-foot rear yard setback area and intruded into that area by about 0.4 feet at its closest point. The Lot also contains a primary dwelling unit. The new dwelling meets all other dimensional zoning requirements. The Locus is nonconforming as to side and rear yard setbacks with the main structure being sited at zero feet from the easterly side yard lot line along Fair Street and about 2.2 feet at its closest point from the southerly rear yard lot line, in a district that requires a minimum side and rear yard setback distance of five (5) feet. The Premises is located at 2 EAGLE LANE, Assessor's Map 55.4.1, Parcel 128, Plan Book 16, Page 35. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters on file. 3. Applicant represented that the secondary dwelling was constructed under a duly issued Building Permit with the intent of siting the structure outside of the required five-foot rear yard setback area. Applicant was not aware that there had been an unintentional setback violation until a survey was done in 1999 to obtain a Certificate of Occupancy from the Building Department. The structure itself is sited outside of the required setback area at about 8.8 feet at its closest point. However, the entry stoop, with abut seven (7) steps, is situated about six (6) inches into the five-foot setback area at about 4.6 feet at its closest point. Applicant would suffer a hardship if the steps were required to be removed or cut back to meet the setback requirement as that would deprive the structure of its primary access on the front of the structure and not meet the building code requirements for access. 4. Therefore, the Board finds that the intrusion was of an unintentional nature. However, relief is only available by Variance and not Special Permit. While the intrusion may not be greater than five (5) feet into a required yard and not closer than four (4) feet, the siting was not based upon a "licensed survey", as required by Zoning Bylaw §139-16C(2) for structures constructed after 1990 in order to receive relief by Special Permit. The Board further finds that owing to circumstances relating to the irregular shape of the Locus and topography of the structures thereon, .and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of the Zoning Bylaw would involve substantial hardship, financial or otherwise, to the Applicant, and the desirable relief by Variance may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Bylaw. The Board notes that the approximately six (6) inch intrusion is de minimus and there would be no public benefit gained with the removal of said six (6) inches. 5. Accordingly, by a unanimous vote, the Board GRANTS .the requested relief by VARIANCE under Nantucket Zoning Bylaw §139-16A to validate the secondary structure as shown upon a "Building Location Plan" done by Charles W. Hart & Associates, Inc., dated December 16, 1999, marked as Exhibit A and attached hereto, upon the following condition: a. There shall be no further five-foot rear yard setback area.
