CABOT, JR., LESSEE, of 41 Liberty Street, Nantucket, MA 02554 and 26 Okorwaw, Nantucket, MA 02554, respectively, Board of Appeals File No. 013-00, the Board made the following Decision: Applicant (Cabot) is seeking relief by SPECIAL PERMIT under Nantucket Zoning Bylaw Section 139-9B(2xo) (take-out food establishment) to convert a retad fish market to a take-out food establishment. To the extent necessary, Applicant is also seeking relief by SPECIAL PEIZNIlT under Section 139-18 (parking requirements) to waive any additional parking spaces that may be required. The use of the second floor of the structure as an apartment will remain unchanged. The Locus is nonconforming as to ground cover with the structure covering in excess of the permitted 50% maximum ground cover ratio allowed; as to setbacks with the structure being sited at zero feet from the westerly and easterly side yard lot lines and at zero feet from the rear yard lot line in a district that requires a minimum side and rear yard setback distance of five (5) feet; as to frontage, with the Lot having less than the 40 feet required in this district; as to lot size, with the Lot containing less than the minimum of 5,000 square feet required; and as to parking with there being no on-site parking. The Premises is located at 8 BROAD STREET, Assessor's Map 42.4.2, Parcel 63, Land Court Plan 8755-B, Lot 8. The property is zoned Residential-Commercial 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were three (3) letters in support from nearby business owners on file. There was one (1) letter in opposition on file from counsel representing an abutter, expressing concern about noise, smells from exhaust fans, and potential trash problems. There was also one (1) letter from counsel representing an abutter that expressed concern over unrelated litigation concerning a neighboring property. The former was at the hearing and elaborated on the abutter's concerns. 3. Applicant represented that he wished to convert a fish market, known as "Island Seafoods", that had existed at the present site since a time prior to 1900, to use as a take-out food establishment. The owner was moving the retail fish market business out of the downtown area and was in the process of leasing the store to the Applicant. Applicant stated that there would be little change in the impact upon the area and would in fact be less as the take-out food establishment would service primarily walk-by pedestrian traffic, whereas the fish market catered to patrons that primarily drove to the site. There would be no increase in ground cover. The structure was grandfathered for seven (7) spaces and the new use would require seven (7) spaces. The hours of operation would be consistent with the other take- out food establishments on the same block. Applicant would monitor the trash situation on a constant basis and would have regular trash pickup to minimize any negative impact on the street. Applicant agreed to run the vent, required for cooking of the food, up the interior of the structure to vent as high on the rear outside wall as possible to address the concerns of the abutter. Applicant further represented that putting his business at that particular location would be in harmony with the area as there were already many take-out establishments in that part of the downtown and very few dwelling units, making sense to keep the majority of take-out businesses in the same area. Applicant also proposed to change the entryway to prevent lines from extending out onto the sidewalk and blocking travel. 4. Therefore, the Board finds that the proposed conversion of the retail seafood business to that of a take-out establishment would not be substantially more detrimental to the neighborhood in this predominately commercial area. The use would be consistent with the other food service establishments in the immediate surrounding area and would have little additional impact. The proposed business would actually have less of an impact upon vehicular traffic as it would primarily service pedestrian traffic, unlike the present use. With the conditions imposed below, the Board finds that the take-out business would be harmony with the general purpose and intent of the Zoning Bylaw. 5. Accordingly, the Board, by a unanimous vote, GRANTS the requested relief by SPECIAL PERNIIT under Nantucket Zoning Bylaw Section 139-18, to the extent necessary, and under Section 139-9B(Zxo) to allow the conversion of the existing retail seafood store to use as a take-out food establishment upon the following conditions 1. The exterior exhaust system shall be vented through the interior of the structure to the roof ; 2. Trash receptacles shall be placed on either side of the main entrance doorway on the interior of the structure; 3. Applicant shall provide and/or monitor the exterior trash receptacles proximate the establishment on a constant basis; 4. Applicant shall maintain regular trash pickup service and provide a trash receptacle to the rear of the structure that will be used solely for the subject business that shall be sited upon a lot located across a `~vay" and shown on Assessor's Map 42.4.2 as Parcel 71 and 72; 5. Relief is hereby made personal to the Applicant; 6. Occupancy of the second floor apartment shall be limited to a maximum of four (4) persons; 7. There shall be only one (1)take-out station on the Premises; 8. Deliveries shall be made during business hours; 9. Applicant shall clean the sidewalk in front of the establishment on a daily basis; 10. The interior layout of the take-out food establishment and placement of the trash receptacles shall be substantially as shown upon the `door Plan of 8 Broad Street", marked as Exlu'bit A and attached hereto; and 11. Hours of operation shall be consistent with the hours of the other take-out food establishments located specifically on Lower Broad Street.
