Applicants (Casey and Merrigan) are seeking relief by SPECIAL PERNIlT under Nantucket
Zonin.¢ Bylaw Section 139-33A (alteration/expansion of a m'e-ex~u~ nonconforming use~structure)•
Applicants propose to construct an about 16' x 20' two-story addition onto the rear of the existing two-
famdY structure. The addition would meet all dimensional zoning requirements and the three (3) parking
spaces would be maintained on site. The Locus also contains a separate third dwelling unit (Unit 3 owned
by Donato). 'The Locus is nonconforming as to number of dwelling emits allowed on one (1) lot with
three t3) on site and two (21 being the maximum permitted; and as to setbacks with the subiect structure
being sited about 1.0 feet at its closest point from the rear yard lot line and with Unit 3 being sited about
1.9 feet at its closest point from the easterly side yard lot line,. in a district that requires a five-foot rear

Dear Mr. Memgan,
Your application for a permit to build an addition to a two family dwelling located
at Sid Jefferson Ln (55.4.1-119) has been reviewed pursuant to §139 of the
Code of Nantucket and is for the following reason deniod.
The dwelling was added to pursuant to 8334-93 as authorized by Special Permit
#R4&91. At that time the Zoning Board of Appeals found that lot contains a pre-
existing nonconforming use (three dwellings on the loth. Because of this finding
of nonconformity any additional building permits can only be issued pursuant to a
Special Permit.
Please be advised that you may appeal this decision of the Building
Commissioner to the Zoning Board of Appeals pursuant to §139-31 of the Code
of Nantucket. If you require any additional information please contact my office.
