At a Public Hearing of the Nantucket Zoning Board of Appeals opened at
1:00 P.M. on Friday,. January 14, 2000, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the
following decision on the application (Board of Appeals File No. 010-00) on the
Application of Nantucket Commercial Street LLC, having a mailing address of P.
O. Box 1138, Nantucket, Massachusetts 02554, in connection with property
situated at 3 Commercial Street and 24 Washington Street, Nantucket.
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning By-law §139-18 to waive any parking spaces required by relocation of
two structures from New Whale Street (Nautilus and Pisces) to 3 Commercial
Street to replace two existing structures (Cranberry and Scallop). There are 12
units, each containing a kitchen, currently existing on the Applicant's property,
and approximately 1940 square feet of commercial warehouse/storage space.
There will be no increase in the number of units. The units, if found to be
transient residential facilities, are permitted as of right in this zone. If the units
are found to be multiple residential units on a single lot, then the units area pre-
existing non-conforming use and the Applicant is seeking relief by SPECIAL
PERMIT under Nantucket Zoning By-law §139-33A to permit the relocation of
Nautilus and Pisces to the present location of Cranberry and Scallop. The
Premises are located at 3 COMMERCIAL STREET (Assessor's Map 42.3.1, parcel
38) and 24 WASHINGTON STREET (Assessor's Map 42.3.2, Parce122) and are
shown as Lots 2 and 1 on Land Court Plan 9434-E, respectively. The property is
zoned Residential-Commercial.
2. Our decision is based upon the application and accompanying
materials, and representations and testimony received at our public hearing. The
Planning Board recommendation was negative. One letter in support was
received prior to the hearing, and there was no opposition presented at the
public hearing.
3. The Applicant proposes to move the two structures (each
containing one dwelling unit) known as Nautilus and Pisces from their current
location on New Whale Street and Nantucket Harbor to the Commercial Street
location to replace two existing structures (each containing one dwelling unit)
known as Cranberry and Scallop as shown on the site plan submitted by the
applicant. The project has been approved by the Nantucket Conservation
Commission and the Nantucket Historic Districts Commission.
4. The property known as 3 Commercial Street and 24 Washington
Street consists of two lots in common ownership with six existing structures that
are used for transient residential accommodations. There are a total of 12 units
on the property; each unit contains a kitchen. There is also some workshop and
storage commercial use in the building known as the Candle House consisting of
approximately 1940 square feet of floor area that is not generally open to the
public.
5. No conforming parking spaces are shown on the site plan although
some parking is accommodated on the site near the corner of Commercial and
Washington Streets. The parking requirements are 12 spaces in connection with
the units, and 2 parking spaces in connection with the workshop and storage
space since parking is required under §139-18 at a rate of one space per 900
square feet, for a total of 14 grand-fathered parking spaces. There is no change in
the number of units that will be on the property, therefore there is no increase in
the number of parking spaces required. However, X139-18A(1) states that "an
enlargement of any building shall require the provision of off-street parking for
the existing building when enlarged as if it were newly constructed." It can
therefore be argued that the replacement of the two existing cottages with
slightly larger cottages would require that the two parking spaces required for
those buildings be provided on the site. It has also been suggested that all of the
grand-fathering with respect to parking has been lost, and that a waiver of all
fourteen spaces is required. Consistent with the By-law, the Board finds that a
waiver of the two parking spaces associated with the buildings being enlarged is
required. The Applicant has requested a waiver under §139-18B of any parking
requirements that will be triggered by the proposed project. The Board also
finds that providing the parking on this property given its proximity to the
harbor, the configuration of the buildings and its downtown location would be
physically impossible and that the requested waiver can be granted in harmony
with the purposes and intent of the Zoning By-law.
6. The property is zoned Residential-Commercial and within this
district transient residential facilities are permitted as of right. The Board finds
that the use of the 12 units on this property for short-term rentals is not within
the definition of a commercial transient residential facility use because each unit
has a kitchen and therefore must be considered a residential dwelling unit.
Accordingly, the property must instead be considered a validly existing non-
confirming use consisting of multiple dwelling units on a lot. Given this finding,
the Applicant's request for a Special Permit under §139-33A to permit the
alteration of that use by the demolition or removal of the two existing structures
and the relocation of the two slightly larger structures from New Whale Street to
the property in the place of the existing structures with no increase in the
number of units must be considered.
7. When relocated, the replacement structures themselves conform in
all respects with the dimensional requirements of the Nantucket Zoning By-law,
curing the existing non-conforming spacing between the buildings. This case is
distinguished from those cases in which a structure that violates a setback or
exceeds the allowable ground cover ratio is demolished and the new structure
may only be reconstructed incompliance with the By-law unless a variance is
issued. The non-conforming use (multiple dwellings on a lot) in this instance is
not being abandoned, but a structure containing a single dwelling unit will
simply be replaced with a different structure containing a single dwelling unit as
part of a single project. Accordingly, the non-conforming use remains
unchanged. Relief by Special Permit is therefore available to the Applicant.
8. The Board finds, given the need to renovate the pre-existing
structures into conformity with current building codes and remove Pisces and
Nautilus from their current nearby location on New Whale Street (thereby
increasing the zoning conformity of that site, and the fact that the number of
units on the property will not be increased), that the demolition or removal of the
existing buildings known as Cranberry and Scallop, and the relocation of Pisces
and Nautilus to the site in their stead, will result in a decrease in the number of
dwelling units in this area and will not be substantially more detrimental to the
neighborhood.
9. Based on the foregoing findings, the Board hereby GRANTS, by a
unanimous vote in favor, the requested Special Permit under Nantucket Zoning
By-Law Section 139-33A so as to allow the demolition or removal of the two
existing structures known as Cranberry and Scallop, and the relocation of the
structures currently situated on New Whale Street and known as Pisces and
Nautilus, onto the property in their place, substantially in accordance with the
plans approved by the Historic Districts Commission (Certificate of
Appropriateness Nos. 34990 and 34994), and a Special Permit under Nantucket
Zoning By-law Section 139-18 waiving the two parking space requirement
triggered by this project.
