DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, January 14, 2000, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of NASHAQUISSET COOPERATIVE, INC.,
c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office. Box
2669, Nantucket, Massachusetts 02584, File No. 008-00:
2. The applicant is seeking a MODIFICATION of a SPECIAL
PERMIT issued by the Decision in Board of Appeals File No. 035-
96, by removing the limitation to one dwelling unit as set forth
in subparagraph 5(k) and by eliminating the condition in
subparagraph 5(1) that there be no residential occupancy of the
first floor of the structure, in order to allow a small apartment
for year-round occupancy to be placed upon the first floor of the
structure, without exterior alteration. The subject property
(the "Locus") is situated at 7, 9 and 11 WASHAMAN AVENUE and 13
YOMPASHHAM LANE, Assessor's Map 55, Parcels 529, 539, 531 and
538, being shown on Plan Book 24, Page 96, Lot 160, and Plan File
14-F, Lots 22, 24 and 32, and is situated in a Residential-10
zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable, provided that the first-floor
apartment be restricted to year-round occupancy. There was one
letter in support, and one expressing concerns, presented at the
public hearing. A family member of the neighboring property
owner who expressed concerns appeared in person at the meeting,
and after hearing the proposal had no objection to the change as
described.
4. The Locus is situated in a zoning district in which the
use of a dwelling containing two dwelling units (a "duplex") is
permitted. In Case No. 035-96, the Board of Appeals was asked to
grant a Special Permit for the use of a portion of the structure
upon the Locus as a "neighborhood service establishment" under
Nantucket Zoning By-law §139-8.B(2), as a service center for the
Nashaquisset community. In granting that relief, the Board of
Appeals established various conditions, one of which was that the
property be used as then presented by the applicant, with only
one dwelling unit, to be on the second and third floors, and with

no dwelling. unit on the first floor. Thus, while the use of the
structure as a duplex is permitted as a matter of right in the R-
10 district, it is in this case prohibited by the condition of
the Board's decision in Case 035-96. The applicant now proposes
to place a small apartment on the first floor, for year-round
occupancy. No restriction to occupancy by the applicant's staff
is proposed, but initially it is intended for the use of the
applicant's on-site property manager. The Locus consists of four
parcels, which have been merged together as a single lot for
zoning purposes by an instrument dated May 9, 1997, recorded with
Nantucket Deeds in Book 536, Page 95.
5. The Board of Appeals found, by UNANIMOUS vote, that the
proposed conversion of a portion of the first floor of the
structure for use as a second dwelling unit would be in harmony
with the general purpose and intent of the Nantucket Zoning By-
law, and specifically that the provision of an additional year-
round dwelling unit will benefit the Island by further addressing
its year-round housing needs, and GRANTED the proposed
MODIFICATION to the SPECIAL PERMIT issued in Case No. 035-96, by
deleting that portion of the condition in subparagraph 5(k) which
limits the structure to one dwelling unit, to be located on the
second and third floors, and by deleting subparagraph 5(1), which
prohibited residential occupancy of the first floor, subject to
the following conditions:
(i} Except as expressly herein modified, all
conditions set forth in the Decision in Case No. 035-96 shall
continue to be and remain in full force and effect.
(ii) The apartment on the first floor shall be limited
to year-round occupancy and shall not be rented seasonally.
