Applicants are seeking relief by SPECIAL PERMIT under the Nantucket Zoning Bylaw §139-33E{2)(a) to allow an increase in the ground cover ratio from about thirty eight, (38%) percent to abut forty, (40°i°) percent to allow construction of an about eighty three, {83 s.f.}square-foot addition onto the rear of a said to be pre-existing single- familydwelling. The addition would meet all setback requirements. The locus is non- conforming as to lot area, with the lot containing about three thousand, six hundred thirty, (3,630 s.f.) square teat of area in a district that requires a minimum lot size of true thousand, (5,000 s.f.} square feet; as to side yard set-back with the single family dwelling being sited about one, {1') foot at its closest point from the northerly side yard lot line rn a district that requires a minimum side yard setback of five, {5') feet; as to frontage with the Lot containing about forty nine, (49') feet abng Liberty Street in a dstrict that requires a minimum frontage of fifty, (50') feet; and as to ground cover ratio as the Lot contains a ground cover ratio of thirty eight, (38%) percent in a district that allows a maximum ground cover rata of shirty, (30%) percent for undersigned lots without a Special permit having been issued by this B ard. The premises is situated ai 40 LIBERTY STREET, Assessor's Map 42.3.4, Parcel 121, Plan Book 311, Page 1. The property is zoned Residential Old Historic. 2. The decision is based upon the Application, the material submitted with it, the testimony and evidence presented at the hearing. There was one, (1 } letter on file in favor of the proposed expansion, and one, (1) abutter spoke in favor at the meeting. The Planning Board made no recommendation as it was not of Planning Board concern. 3. Applicants, through Counsel, presented plans of the locus, and a narrative description of the scope of the work proposed under the Application. The work proposed would result in the construction of an Historic District Commission 2~pproved, Certificate of Appropriateness, number 35,215, eighty three, (t33*s.f.} square foot addition off the rear of the single family dwelling. The ground cover ratio of the premises would increase from about thirty eight, (38%) percent to about forty, (40%} percent. The previous formula employed to ca~ulate ground cover ratio included the architectural "roof overhang" element. Under this formula the premises had a ground cover ratio of about forty one, (41 %) percent. At Town Meeting, in March of Nineteen Ninety Nine, (1999} a warrant article was adopted which excluded the "roof overhang" element from the formula employed to cak:ulate ground cover ratio. Under the new formula, the proposed expansion will result in a ground cover ratio, in theory, which is less than what had previously existed on the premises. 4. Therefore, the Board finds that the proposed project would increase a preexisting non-conforming ground cover ratio, but said increase would not be substantially more detrimental to the neighborhood than the existing non-conformity. The Board further finds that the proposed project would have little impact upon the surrounding area because the increase would be de minimus in nature, and there would be no change in use. 01/20/2000 11:26 508228?852 PETER D KYBURG ESQ PAGE 03 5. Accordingly, the Board, by a unanimous vote, GRANTS the requested relief by SPECIAL PERMIT under the Nantucket Zoning Bylaw §139-33E(2)(a) to expand the existing structure, as proposed, on the condition that the work is to be performed in substantial conformance with Historic OistriCt Commission Certificate of Appropriateness, number: 35,215 issued November 30, 1999, as may be amended. The locus is approximately 3,630 s.f. The structure is approximately 1,370 s.f. The non-conforming nature of the structure is that it currently has a ground cover ratio of approximately 38~Yo. Lots less than 5,000 s.f. are allowed a ground cover ratio of 30%. The applicant proposes to construct an addition of approximately 83 s.f. The completed structure, as proposed, would have a ground cover ratio of approximately 40%. Prior to the adoption of the town warrant article which exempted the overhangs of a structure from the formula for calculating ground cover ratio, the ground cover ratio of the locus was approximately 410. After the adoption of said article the ground cover ratio was diminished to approximately 38%, which is what exists currently.
