been obtained. As to the perking issue, since th+sns is no intensification or change in
th® nature of the use, th® two (2) 'stacked" parking spas which rurrentty exist will
continue to provide adequate parking for the Premises.
4. Therefore, the Board finds that the proposed expansion wiH be in harmony with
the 9®n®ral purpose and intent of the by Zoning By-taw, wig not intxsase the non-
conforming nature of the structur® as th0 additions will meet the set-bas~ca, and the
additions will not be substantially more c3atrimental then the pro-existinD non-
conformities to the neighbofiood. As to the parking relief requested, the Board finds
that with the additional ground cover, parking must be calculated as if newly
construct®d. Th® Board further finds that the pre-existing iodation of the buildings on
the tot make it impossible #o provide additional partcing spac®s, and the existing two {2)
"stacked" parking spaces adequately serve the premises as they have been for over
thirty (3U) years.
5. Accordingly, by UNANIMOUS vote, the BOARD GRANTS THE SPECIAL
PERMIT under Zoning ey-taw Section 139-33A, to construct the project as proposed
upon the fotlawing conditions:
a. The project is #o De completed in substantial conformance with approved
H.D.C. plans {File No. 3458, r®vised 34844}, as may be amended; and
GRANTS SPECIAL PERMIT relief under Zoning ey-law 3ectionl3>i3-188{2) and
(3j, waiving one {1 } parking space, on the condition that the two {2j'stacked' parking
spaces wilt remain as presently configured.

1. Applicants are seeking relief by SPECIAL PEt~MIT under Nentuck®t Zoning By-
Law §39-33A {alteration of a pre-existing nonconforming atructure/use). Applicants
propose to alter and expand ono {1 } of two (2} dwetlirtg units on the praperty. The 528
t square foot conforming dw~lling (Unit 2}, located to the rear of the property, and the
592 t square foot studio, nonconforming as to setback and located in lye ~ntsr of the
Lot, are currently connected by en uncovered wooden deck. They wilt be joined
together to cAmpri$e one {1) enlarged dwelling unit by encoring the deck arse and
adding a second #Ioor. The addition will not encroach ups tl~ required five toot
setback area nor exceed the allowable ground ever ratio, and the nonconforming
setback distance of 0.6t feet, at its clr~sest point from the easterly side yard lot ling, for
the studio structure will not be increased. The lot also contains a separate 1,322 t
square foot dwelling unit (unit 1), located in the front of the Lot (not pert of this
Application) that is nonconfionr~ing as to th3 side yard s®tbet~k as it is ffiited 2.3f fast at
its closest point from the westerly side yard lot ling. Apppcants era a{so milking relief
by SPECIAL PERMIT under Nantucket Zoning Bylaw §139-188(2) end (3) waiving one
{1 }parking space. There ar® currently two {2) parking spaces on the property that will
remain. As the ground cover of Unit 2 is being increasedf, th® parking must be
calculated as if newly constructed. Similar reii~sf was granted in BSA Decision 029-97,
which work was never undertaken, with said relief arguably now expired. The Premises
is located at 158 Vestal Street, Unit 2, Assessors Map 42.3.3, Parcel 42.2, Plan File
43-D. The property is zoned Residential-Old-Historic.
2. The Decision is based upon the Application and rra~terials submitted therewith,
and the testimony and evidence introduced at the hearing. Thore was no
recommendation from the Planning Board as the Board detennlned that the matter was
not a planning concern. There was one (1) letter on file from an interested petty in
favor of the application.
3. Applicants, through their at#omey, presented plans for the renovations/addition
which have been approved by the Historic Districts Commission (Certificate No. 34528,
Revision No. 34844). He explained that there was to be no intensification of use, the
addition is to 8ive Applicants more living space. The Applicants intend to enclose the

ADDENDUM "A"
Applicant is seeking a special permit under Nantucket Zoning By-law Chapter
139-33A (Alteration/Extension of aPre-Existing Non-Conforming Structure/Use).
Applicants' property is a 6780 square foot lot with 54.75 feet of frontage on
Vestal Street, therefore, it is conforming as to area and frontage. There are two
dwelling units and an artist's studio on the property, and these units have been
condominiumized. Applicant owns Unit 2 of said Condominium which is
comprised of a 528 square foot dwelling and a 592 square foot studio which are
connected by an uncovered wooden deck. The dwelling unit complies with the
set-backs, but the studio is non-conforming as to side-yard set-back as it is sited
0.5t feet at its closest point from the easterly side yard lot line in a district that
requires a minimum of a five foot side and rear yard set-back. Unit 1 of the
Condominium (not part of this Application) contains a 1,322 square foot dwelling
that is non-conforming as to side yard set-back in that it is sited 2.3t at its closest
point from the westerly side yard lot line. Applicants propose to add a second
floor and enclose the deck area all as shown on plans approved by Nantucket

Applicants also seek relief via special permit from the parking requirements of the
