Applicants are seeking relief by SPECIAL PEt~MIT under Nentuck®t Zoning By- Law §39-33A {alteration of a pre-existing nonconforming atructure/use). Applicants propose to alter and expand ono {1 } of two (2} dwetlirtg units on the praperty. The Decision is based upon the Application and rra~terials submitted therewith, and the testimony and evidence introduced at the hearing. Thore was no recommendation from the Planning Board as the Board detennlned that the matter was not a planning concern. There was one (1) letter on file from an interested petty in favor of the application. 3. Applicants, through their at#omey, presented plans for the renovations/addition which have been approved by the Historic Districts Commission (Certificate No. 34528, Revision No. 34844). Applicants' property is a 6780 square foot lot with 54.75 feet of frontage on Vestal Street, therefore, it is conforming as to area and frontage. There are two dwelling units and an artist's studio on the property, and these units have been condominiumized. Applicant owns Unit 2 of said Condominium which is comprised of a 528 square foot dwelling and a 592 square foot studio which are connected by an uncovered wooden deck. The dwelling unit complies with the set-backs, but the studio is non-conforming as to side-yard set-back as it is sited 0.5t feet at its closest point from the easterly side yard lot line in a district that requires a minimum of a five foot side and rear yard set-back. Unit 1 of the Condominium (not part of this Application) contains a 1,322 square foot dwelling that is non-conforming as to side yard set-back in that it is sited 2.3t at its closest point from the westerly side yard lot line.
