At a public hearing of the Nantucket Zoning Board of Appeals, which commenced on Friday, January 14, 2000, at 1:00 P.M., and was continued from time to time until Friday, April 7, 2000, at 1:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of HAMILTON HEARD, JR., TRUSTEE OF GINGHAM REALTY TRUST, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 001-00: 2. The applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law X139-18, for a waiver of the required seven (7) parking spaces, or in the alternative waiver of one space and approval of two nonconforming spaces which will be "stacked", and to the extent necessary a waiver of the required 24-foot aisle width requirement. The applicant proposes to construct a building with about 1,377 square feet in footprint with up to two offices on the first floor and one apartment on the second floor. The subject property (the "Locus") is situated at 14A Sparks Avenue, being portions of Parcels 229 and 229.1 on Assessor's Map 55, is shown as Lot 5 upon plan recorded with Nantucket Deeds in Plan File 56-0 (being portions of the former Lots 2 and 3 on plan recorded in Plan Book 22, Page 27) , and is zoned as Residential-Commercial. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board issued a recommendation which neither supported nor opposed the application, but suggested that certain conditions be included in any decision granting relief. There was no support nor opposition presented in person, by representatives or by written communication at the public hearing. 4. The applicant proposes to construct a new building containing office space for up to two businesses on the first floor and with a residential apartment on the second floor, upon what is now a vacant lot at the corner of Sparks Avenue and Hooper Farm Road. Both office and residential uses are permitted as a matter of right in this Residential-Commercial district; the application for relief is limited solely to the request for a Special Permit to waive certain parking requirements. Specifically, the applicant proposes to construct about 1,377 1 square feet of office space; under Zoning By-law §139-18.C, this use would require seven parking spaces, at the rate of one required space for each 200 square feet of gross floor area in office use. In addition, the applicant proposes to place an apartment on the second story, which requires one additional parking space. The proposed building footprint of about 1,377 square feet would be substantially less than half of the permitted ground cover upon the Locus, which in the Residential- Commercial district is 500 of lot area; the Locus contains about 5,854 square feet, so maximum permitted ground cover is about 2,927 square feet 5. For background, reference is made to the decision of the Board of Appeals in Case No. 114-99, involving the adjacent land of the applicant which was divided from the Locus by an approval- not-required plan endorsed by the Planning Board, which is the plan recorded with Nantucket Deeds in Plan File 56-0. Said adjacent land is shown as Lot 4 on that plan. In connection with the division of these lots and the decision of the Board of Appeals in Case No. 114-99, a driveway easement has been created along a major portion of the boundary between the lots and across Lot 5 so that all vehicular access to both Lots 4 and 5 would be to and from Hooper Farm Road, not Sparks Avenue. As a result, the portion of Lot 5 which is available for building construction and parking is limited. The plan presented by the applicant depicts four parking spaces which appear to comply with dimensional requirements of the Zoning By-law. The applicant requests waiver by Special Permit of the additional required spaces; however, the plan presented by the applicant shows an additional two parking spaces which are "stacked" behind conforming spaces; that is, if vehicles are occupying the conforming spaces, access to the "stacked" spaces is blocked. The applicant represents that the "stacked" spaces will be used for employee parking. 6. Under Zoning By-law §139-18.B(2), as in effect and applicable to the Residential-Commercial zoning district in which the Locus is situated, relief from parking requirements may be secured by the issuance of a Special Permit by the Special Permit Granting Authority (the "SPGA") (in this instance, the Board of Appeals), provided that the SPGA makes findings that the granting of the Special Permit is in harmony with the general purposes and intent of the By-law, and that compliance with the parking requirements set forth in the By-law would be (a) physically impossible to provide, or (b) would have a significant and adverse effect upon the scenic or historic integrity of the neighborhood, or (c) would be contrary to sound traffic and safety considerations. 7. The four-person majority of the Board of Appeals which voted to grant relief, as set forth below, acknowledged that the physical constraints upon the Locus, based upon its shape and the easements affecting it, made it difficult or impossible to provide all of the required parking spaces for the applicant's 2 proposed uses, together with the proposed building, in a conforming configuration, and that the public concern that access to both the Locus and Lot 4 be obtained solely to~and from Hooper Farm Road, with no separate access to and from Sparks~Avenue, provided additional constraints. Furthermore, any possible parking placed within the Locus by direct access to or from either of these streets, rather than through a driveway, would be contrary to sound traffic and safety considerations. Nevertheless, the members.of the Board of Appeals expressed .the concern that the applicant's proposed uses and structure upon the Locus, situated at a busy intersection, were excessive and should be reduced in size and scope. Even though there is no front yard setback requirement in this district as. to the frontage of the lot with one street, and minimum setback is five feet from each other street, the Board of Appeals members considered that the need to maintain good sight lines near this intersection, and the possibility of future sidewalk construction, dictated that setback of at least ten feet be maintained from Sparks Avenue and at least five feet setback be maintained from Hooper Farm Road. The Board of Appeals members also expressed their view that the propose construction, although within ground cover requirements, should be reduced, thus reducing the need for parking waivers. Further, the Board of Appeals members expressed concern that the proposal tv have .two separate offices on the first floor _ would exacerbate parking demand, even though there is no provision of the By-law as to computation of parking spaces for offices which refers to the number of separate offices. 8. Accordingly, upon motion made and seconded, the Board of Appeals, by a vote of four sitting members in favor (Waine, Sevrens, Parent and Murphy) and one in opposition (Toole), made the findings under By-law §139-18.B(2) that the granting of a Special Permit for parking waivers as set forth below, and as conditioned herein, would be in harmony with the general purposes and intent of the By-law, and that compliance with the parking requirements of the By-law would be physically impossible for the applicant to provide or would be contrary to sound traffic and safety considerations, and accordingly zo GRANT the required relief by SPECIAL PERMIT, to waive the number of conforming spaces required for the project down to four, subject to the following conditions: (a) The total gross floor area in office use shall be limited to a maximum of 1,099 square feet. (b) There shall not be more than one commercial entity which occupies the first floor, and there shall be no commercial use upon the Locus except for office use; and limited to one (1} dwelling unit on the second floor. (c) Setback of the structure upon the Locus shall be, at all points, at least ten feet from Sparks Avenue and at least five. feet from Hooper Farm Road. 3 (d) In addition to the four conforming parking spaces, two additional parking spaces shall be provided upon the Locus in a "stacked" configuration, for employee parking. (e) The layout of all structures and parking spaces as described in this decision shall be as shown upon the site plan, a copy of which is attached hereto as Exhibit A.
