The lot, single-family dwelling and shed are otherwise conforming as to all other dimensional requirements of the Zoning By-law. Applicants purchased the pre-constructed shed in February 2008. The shed was approved by the Nantucket Historic District Commission in Certificate of Appropriateness No. 51,781. Duly issued Building Permit No. 174-08 was issued to place the shed on the southwesterly corner of the lot, sited so as to meet the then required five-foot side and rear yard setbacks of the Residential- Commercial-2 zoning district. Applicants decided to change the location of the shed in April 2008 before the shed was delivered and obtained further HDC approval in Certificate of Appropriateness No. 52,192 to relocate the shed to the northeasterly corner of the lot, still in conformance with the then required five-foot side and rear yard setbacks. Unfortunately, the corresponding modification was not made by the contractor to the Building Permit to show the new location. The shed was delivered and placed in April 2008 and has remained in the current location since that time without incident or comment. Applicants asked the contractor to close out the open Building Permit for the shed with the Building Department this past spring of 2009. In furtherance of that request the agent asked for and received the signoff from the HDC as to its compliance in the new location. When the Applicants' agent applied for the signoff from the Building Department and the Zoning Enforcement Officer ("ZEO"), a denial letter dated May 12, 2009 was issued. Unfortunately for the Applicants, since the time that the shed had been placed on the site in April 2008, the zoning had changed from RC-2 to R-5 at the April 2009 Annual Town Meeting. The R-5 zoning district required one side yard setback to be a minimum of ten feet and allowed the other side yard to maintain a setback of five feet. The rear setback remained five feet. The ZEO stated that had they modified the Building Permit prior to the first publication of the zoning change in February 2009 for the Naushop Subdivision, a permit could have been issued under the then RC-2 zoning requirements . However, since the Applicants had not done so in a timely manner, the shed would now be subject to the new setback requirements as established by the April 2009 ATM. The ZEO also points out that the dwelling is complying as the structure is sited at about 11 feet from the northeasterly side yard lot line and thus the shed had to also meet that side yard setback of ten feet from that lot line. Applicants argue that the placement of the shed is consistent with a majority if not all of the existing sheds in the subdivision, which are sited at five feet side and rear. In addition, the location of the shed to the rear of the lot abuts an area of green space required for an abutting subdivision and has no negative impact on any abutting property nor is it sited proximate to another structure. The yard is fully landscaped and the shed is integrated into that landscaping. It would serve no public benefit to be relocated and is hidden by the house that is sited on a little travelled cul de sac within amulti-lot subdivision. Applicants ask that SPECIAL PERMIT relief be granted to reduce the northeasterly side yard setback from ten to five feet in order to validate the existing siting of the shed. The only finding necessary to be made is that the relief is in harmony with the general purpose and intent of the Zoning By-law. This is not a situation of substantially more detrimental as the shed cannot be considered pre-existing nonconforming as it was not signed off on prior to the zoning change, even though the structure was on the lot prior to said change. B. Exceptions for frontage*. (1) The Board of Appeals may grant a special permit reducing the minimum frontage required in commercial districts to no less than 20 feet, provided that the use or structure on the lot to be granted such a reduction is a commercial use or structure and that such reduction in frontage will not be substantially more detrimental to the neighborhood. (2) Frontage may be reduced by up to 30% for lots fronting on the turning circle of a dead-end street. (3) Frontage of a lot may be reduced for an individual lot in a subdivision or on a plan endorsed "approval not required" to a minimum of 50 feet (which width shall not be reduced at any depth within the lot), provided that: (a) The total number of lots does not exceed the total permitted by the area requirements of § 139-16A above. (b) The total frontage of all lots shall meet or exceed the total frontage requirements of § 139-16A above. (c) Each lot shall have a regularity factor of 0.55 or more as required by Subsection D below. (d) Notice of the reduction of frontage for any lot under this § 139-16B(3) shall have been recorded or registered as an encumbrance upon the record title for each lot considered in making any computation under this section concurrently with the recording or registration of the plan which created such lot with reduced frontage or prior to conveyance or building upon any individual lot shown upon such plan. C. Exceptions for yards. At a public hearing of the Nantucket Zoning Board of Appeals on Thursday, November 12, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 060-09 of Richard and Amy Gammons c/o Nancy Drahzal, PMB 64, Nantucket, MA 02554. 2. Applicant are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) (intensity regulations) in order to reduce the ten (10) foot northeasterly side yard setback to five (5) feet in order to validate the siting of the existing utility shed. The site is located at 11 Curlew Court, is shown on Nantucket Tax Assessor's Map 68 as Parcel 518, is shown on Land Court Plan 16514-12 as Lot 266, and is registered at the Nantucket County Registry of Deeds as Certificate of Title No. 22825. The property is zoned Residential - 5. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board recommended that the board grant the requested relief. No abutter comment was received either in favor of or against the Application. 4. At the hearing, the Applicant was represented by Nancy Drahzal of Structures Unlimited. Ms. Drahzal noted that the Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) in order to reduce the ten (10) foot side yard setback to five (5) feet to validate the siting of an 84 square foot utility shed. The lot, single-family dwelling, and shed are otherwise conforming to the Zoning Bylaw. Ms. Drahzal represented that the Applicants purchased apre-constructed shed in February 2008 and said shed was duly approved by the Nantucket Historic District Commission in Certificate of Appropriateness No. 51,781. Accordingly, Building Permit No. 174-08 was issued to place the shed on the southwesterly corner of the lot so as to meet the required five-foot side and rear yard setbacks in the zoning district. In April 2008, the Applicants decided to change the location and duly obtained further Historic District Commission approval in Certificate of Appropriateness No. 52,192 to relocate the shed to the northeasterly corner of the lot, still in conformance with the zoning setbacks. This information was not relayed to the Building Department and accordingly, the shed was delivered and placed in Apri12008 and has remained in the current location since that time. Ms. Drahzal informed the Board that when the Applicants were closing out their building permits, the Zoning Enforcement Officer sent a denial letter because since the time the shed had been placed on the site in April 2008, the zoning had changed from RC-2 to R-5 and thereby changed the side yard setback from five (5) feet to ten (10) feet on one side. The porch of the Applicant's dwelling is sited as close as 5.1 feet to the side yard setback on the northwesterly side and the shed in question is sited as close as 6.5 feet from the side yard setback on the southeasterly side. Therefore, the Applicants are requesting Special Permit relief to reduce the southeasterly side yard setback to 6.5 feet in order to site the existing shed. 5. Based on the foregoing, the Board finds that reducing the southeasterly side yard setback from ten (10) feet to 6.5 feet in order to validate the location of the existing shed is within the purpose and intent of the Zoning Bylaw. 6. Accordingly, by a motion made and duly seconded to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(1) to reduce the southeasterly side yard setback from ten (10) feet to six and one half (6.5) feet to validate the siting of the shed located 6.5 feet from the side yard setback as shown on the plan entitled "As-Built Plot Plan", prepared by Nantucket Surveyors, LLC, dated April 3, 2008, and attached as Exhibit A, with the condition that no further construction of structures, nor additions to the existing shed, shall take place within ten feet of the southeasterly side yard lot line without the issuance of further relief by the Board of Appeals, there were five (5) votes in favor and none (0) opposed.
