The information provided includes the HDC documents for a proposed addition that was approved in April Of2008. At that time the property had the Zoning classification of RC-2 and the side yard setback requirement was 5 feet for both side yards. All work as designed complied with the zoning requirements in effect. At the April 2009 Town meeting the area was reclassified as R-5 and the requirement of a 10-foot set back on one side of the property was put into effect. This change requires complete abandonment of the proposed plans. As per 139-16-CI, we are requesting the Board to grant a Special Permit to reduce the side yard setback from 10 feet to 5 feet. Please note that this property is at the end of a cul-de-sac with a narrow strip of undevelopable land to the east along the property line in question. It is my understanding that the intent of the 10-foot side yard setback is to provide access for emergency equipment and the existing open area to the east will achieve the desired result. Given the design & permitting expenses committed to this project to date we are hopeful that the board will grant this Special Permit. At a public hearing of the Nantucket Zoning Board of Appeals on Thursday, November 12, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 058-09 of John Ryan Smith cj 0 Charles Lenhart, PO Box 2113, Nantucket, MA 02584. 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) (intensity regulations) in order to reduce the ten (10) foot easterly side yard setback to five (5) feet in order to construct a house addition, including a garage, that was approved by the Historic District Commission (HDC) prior to the zoning change from Residential Commercial 2 (RC-2) to Residential 5 (R-5) at the 2009 Annual Town Meeting. The site is located at 5 Sparrow Drive, is shown on Nantucket Tax Assessor's Map 68 as Parcel 530, is shown on Land Court Plan 16514-12, and is registered at the Nantucket County Registry of Deeds as Certificate of Title No. 15078. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board recommended that the board grant the requested relief. One letter abutter comment was received either in favor of or against the Application. 4. At the hearing, the Applicant was represented by Charles Lenhart of Sandcastle Construction Inc. Architects and Builders. Mr. Lenhart noted that the Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) in order to reduce the ten (10) foot side yard setback to five (5) feet to construct the HDC approved addition. Ms. Lenhart noted that Applicants received HDC approval in April of 2008, well before the zoning change was proposed and approved. At the time of HDC approval, the proposed addition met all zoning requirements. 5. Based on the foregoing, the Board finds that reducing the easterly side yard setback from ten (10) feet to 5 feet in order to construct the proposed addition is within the purpose and intent of the Zoning Bylaw. 6. Accordingly, by a motion made and duly seconded to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(I) to reduce the southeasterly side yard setback from ten (10) feet to five (5) feet to allow the construction of the proposed addition as shown on the plan entitled "Smith Residence, 5 Sparrow Drive, Nantucket, MA, Renovation & Addition", sheet 1 of I, prepared by Sandcastle Construction, Inc. , Builders and Architects, dated November 4, 2007 and attached as Exhibit A, there were five (5) votes in favor and none (0) opposed.
