ADDENDUM
Applicant, Bernard F. Blaney, requests special permit relief pursuant to
Section 139-33A(8) of the Nantucket Zoning By-Law ("By-Law") for his
property located at 9 New Jersey Avenue, Nantucket, MA 02554 (hereinafter "the
Property"), Parcel 408 on Nantucket Town Assessor's Map 60.3.1., a copy of
which is attached hereto as Exhibit "A". The Property contains 16,000 square
feet of area shown as Lots 1-4 and 57-60 in Block 31 on Land Court Plan 2408-M
filed with the Nantucket Registry of Deeds, a copy of which is attached hereto as
Exhibit "B".
The subject Property is located in the R-2 zoning district. The minimum
lot size is 20,000 square feet. Applicants' property consists of an undersized
12,000 and 4,000 square feet of area. The 12,000 square foot portion of the
Property, shown as Lots 3,4 and 57-60 in Block 31 on Exhibit "B", is shown on
the attached plot plan prepared by Bracken Engineering, Inc., dated July 29,2007,
a copy of which is attached hereto as Exhibit "C". The 4,000 square foot portion
of the Property, shown as Lots 1 and:? in Block 31 on Exhibit "B", is shown on
Exhibit "C" as parcels 367 & 368 on map 60.3.1.
The 12,000 square foot portion of the Property is a pre-existing non
conforming lot as evidenced by the Deeds filed with Certificates of Title No.
16,753 and 22,693 at the Nantucket Registry District, copies of which are
attached hereto as Exhibit "D".
On September 17,2009 applicants purchased the 4,000 square foot portion
of the property, from the Town of Nantucket as part of the Town's "Yard Sale"
program. The Town conditioned this purchase on the applicants merging the
12,000 and 4,000 square foot undersized lots for zoning purposes to create an
undersized, but more conforming 16,000 square foot lot. This agreement is set
forth in the Quitclaim Deed for the above mentioned conveyance dated September
17,2009, a copy of which is attached hereto as Exhibit "E".
In addition, the structures on the Property were erected prior to July, 1972,
as evidenced by the Affidavit of Keith C. Humphreys, which the applicant
anticipates will be submitted to the Zoning Board before the November hearing.
Accordingly, the single family dwelling and the garage on the Property are pre-
existing, non conforming as to the current intensity regulations for the R - 2
district. No changes to these structures are proposed as part of this application.
Accordingly, applicants seek a special permit pursuant to Section 139-
33A(8) of the By-Law to merge the 12,000 and 4,000 square foot undersized lots
to create a less non-conforming lot ofrecord. Section 139-33A(8)ofthe By-Law

states that a special permit is required to validate this change in size and shape of
the previously existing non-conforming lot to make the Property less non-
conforming as well as to validate the lot as a lot of record for zoning purposes. In
addition, no new non-conformity will be created by the relief requested.
Applicants therefore respectfully request that the Board grant the special
permit to validate the entire 16,000 square feet as a non-conforming lot of record
as the relief requested will not be substantially more detrimental to the
neighborhood and will serve to make the locus less non-conforming.

QUITCLAIM DEED
Lots 1 and 2, Block 31, Section 2, Plan No. 2408-M
in the Madaket Section of Nantucket, Massachusetts
The TOWN OF NANTUCKET, a Massachusetts municipal corporation having a
principal place of business at 16 Broad Street, Nantucket, Nantucket County, Massachusetts
acting by and through. its Board of Selectmen (the "Board"), in consideration of Five Thousand
Twenty Five and 00/100 Dollars ($5,025.00), hereby grants to BERNARD F. BLANEY of 354
Atlantic Avenue, Marblehead, Massachusetts, with quitclaim covenants, that certain land known
as Town of Nantucket Assessor Map 60.3.1, Parcels 367 and 368 located off New Jersey Avenue
in that part of Nantucket, Massachusetts known as Madaket Terraces and identified as Lots 1
and 2, in Block 31, Section 2 of the plan on file with the Nantucket County Registry of the Land
Court ("Land Court") as Plan No. 2408-M (the "Plan"), together with improvements thereon, if
any (colleCtively, the "Property"), subject to the following restrictions.
The grantor's conveyance of the Property is based in part on the grantee's warranty and
representation to the grantor that such parcels shall be used for residential purposes only and
shall, for all intents and purposes, be combined with and considered as one parcel with the
abutting property previously acquired by grantee pursuant to Certificate of Title on file with the
Land Court as Certificate No. 22693, known as Town Assessor Map 60.3.1, Parcel 408 and
numbered 9 New Jersey Avenue, and shown as Lots 3, 4, 57, 58, 59 and 60 of Block 31 on the
Plan (collectively with the Property, the "Combined Premises"), and that no part of the Property
or Combined Premises shall hereafter be used for non-residential purposes nor divided,
subdivided or conveyed as a separate parcel or parcels. Accordingly, the parcel hereby granted
to the grantee is conveyed subject to permanent restrictions held by the grantor, forever
restricting the Property and Combined Premises to residential use, prohibiting the division or
subdivision of any portion of the Combined Premises, and prohibiting the conveyance or use of
any portion Of the Combined Premises apart from another portion of the Combined Premises.
These restrictions shall run with the title to the Combined Premises, and no part of the Combined
Premises shall be hereafter used, conveyed, divided or subdivided in a manner inconsistent with
these restrictions unless the Board, in addition to any other permission required by law, grants to
the grantee or to allhis successors, heirs and assigns, such Board's prior written release for such
use, conveyance, division or subdivision and the Land Court accepts such release for filing.

The grantee further agrees for himself and his successors, heirs and assignS that if for any
reason such restrictions on the use of the Combined Premises shall be deemed subject to
sun-setting provisions, terminated, void or voidable, or other principles requiring duration less
than perpetual, . then the grantee and his successors, heirs and assigns shall undertake all
reasonably necessary measures to ensure that the Combined Premises remain used in a manner
consistent with the terms of and intent of this instrument.
Where the grantor is a municipal corporation of the Commonwealth of Massachusetts, no
documentary stamps are required pursuant to G.L. c. 64D, ~ 1.
The conveyance hereby made has been completed in full compliance with the
requirements of Massachusetts General Laws chapter 44, section 63A.
This conveyance of the Property is made pursuant to the authority of Article 74 adopted
at the Town of Nantucket 2007 Annual Town Meeting, a Town Clerk certified copy of which is

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday,
November 12, 2009 at 1:00 P.M., in the garage area at 2 Fairgrounds Road, Nantucket,
Massachusetts 02554, the Board made the following decision on the application Bernard
Blaney c/o Vaughan, Dale, Hunter, Stetina, & Beaudette, P.c., 2 Whaler's Lane, PO Box 659,
Nantucket, MA 02554, Board of Appeals File No. 056-09:
2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-33.A.(8) (increasing size of nonconforming lot) in order to increase the size of the
pre-existing, non-conforming lot from 12,000 ::!:: square feet to 16,000 ::!:: square feet. The site is
located at 9 New Jersey Avenue, is shown on Nantucket Tax Assessor's Map 60.3.1 as Parcels
367,368, and 408, is shown on Land Court Plan 2408-M as Lots 1-4. 57-60, Block 31, and is
registered at the Nantucket County Registry of Deeds as Certificate of Title Nos. 22693 and
23333. The site is zoned Residential- 20.
3. Our decision is based upon the application and accompanying materials, and
representations, and testimony at our public hearing. The Planning Board made no
recommendation on the basis that no matters of planning concern were presented. No members
of public commented on this application.
4. The Applicants, through counsel, stated that they are requesting to increase the
size of the pre-existing, nonconforming 12,000 ::!:: square foot lot to 16,000 ::!:: square feet. In
September, 2009 the Applicant purchased the 4,000 square foot portion of the property from the
Town of Nantucket as part of the Town's "Yard Sale" program. The Town conditioned this
purchase on the Applicant merging the 12,000 and 4,000 square foot undersized lots to create an
undersized, but more conforming 16,000 square foot lot. Therefore, the Applicants are before
the Board in order to merge the 12,000 and 4,000 square foot undersized lots to create a less non-
conforming lot of record that has the benefits of a pre-existing nonconforming buildable lot.
5. Based on the foregoing, the Board finds that the proposed reconfiguration of the lot
lines to allow the merger of the Applicant's property creates no new nonconformity, does not
increase any nonconformity, but instead reduces the lot size nonconformity of the Applicant's
property. The Board further finds that such reconfiguration of lot lines would not be
substantially more detrimental to the neighborhood than existing lot lines, or contrary to the
general purpose and intent of the Zoning Bylaw.
6. Accordingly, the Board of Appeals, by a UNANIMOUS vote GRANTS the
requested SPECIAL PERMIT relief to allow the reconfiguration of lot lines by merger the
Applicant's property at 9 New Jersey Avenue, upon the following conditions:
a. The resulting merged Premises shall be comprised of9 New Jersey Avenue, shown as
both Map 60.3.1 Parcel 408 and Map 60.3.1 Parcels 367 and 368, on the Mortgage
Plot Plan prepared by Bracken Engineering, dated July 29, 2007, herein attached as
Exhibit A; and,
b. The merged Premises shall be considered a single buildable lot with the benefits of a
pre-existing nonconforming lot of record under the Nantucket Zoning Bylaw, as
amended.
