Special Permit relief was granted at the January 9, 2004 meeting allowing the Applicant to change the use of the second floor of a mixed- use commercial/residential structure by eliminating the two one-bedroom apartments, and converting the space to commercial use ancillary to a single first floor retail establishment, which consisted of an area of about 1,243 square feet after the proposed construction. This relief was granted under Section 139-33A of the By-law. The relief granted stated that there would be no access to the second floor by the general public, and the second floor has been used consistently by employees for work space and office space. Applicant is now seeking relief to use the second floor space as additional retail space, with the understanding that the building would be rented to one tenant only, and, further, Applicant would have the option to convert the second floor space back to two one-bedroom apartments without additional relief from the Board instead of using the second floor for additional retail space. Five additional parking spaces were waived at the 2004 meeting under Section 139-18 and, with the ten grandfathere~d spaces in existence at that time, Applicant currently has 15 spaces. No additional relief is required or being requested for parking waivers. Peter Martin dba "Sixteen Federal Street, Inc." purchases property and hires Ron Dasilva to repair and renovate the first floor for accounting offices and the apartments on the second floor. `83? -7/16/85; Peter Martin operates accounting practice on first floor 7/1 /85: property sold form Sixteen Federal Street, Inc. to Lee and Tharon Dunn. Mortgage w/ Nantucket Bank. No significant work performed on building "85 - 2001: Tharon Dunn operates retail business "Bramhall and Dunn, Ltd." on first floor and rents both apartments out on second floor. Applicant is requesting a Modification of Special Permit No. 006-04 (which converted two one-bedroom apartments on the second story to a commercial use ancillary to the first floor retail space) to allow the Applicant to change the use of the second floor from a commercial use ancillary to the first floor retail establishment to additional retail space on the second floor. Additionally, Applicant requests the option to convert the second floor space back to two one-bedroom apartments without further relief from the Board of Appeals if Applicant's retail tenant does not wish to use the second floor space. Should the Board deem it necessary, Applicant requests Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-20C (loading zones) to waive the loading zone requirements. The premises is located at 16 FEDERAL STREET, Assessor's Map 42.3.1, Parcel 71, Plan Book 15, Page 96, Lot 1, and is recorded at the Nantucket Registry of Deeds in Book 232, Page 144. The site is zoned Commercial Downtown. 2. This Decision is based upon the Application and materials submitted with it, along with the testimony and evidence presented at the hearing. The Planning Board did not make a recommendation as the matter was not of planning concern. There was no opposition to this Application, and there were thirteen (13) letters submitted by abutters and neighborhood businesses supporting the requested relief. There was no one present at the hearing that spoke against the requested relief. 3. Applicant, through counsel, represented that the subject property is available for rent at this time, and there is no tenant in place. Applicant wants the option to accommodate the future tenant by having the opportunity of allowing additional retail space on the second floor, which would be open to the public. In the alternative, if the future tenant does not need the second floor space for retail or office use, Applicant desires to have the option of converting the second floor space back to its former use which consisted of two, one-bedroom apartments. Neither of these proposed uses would require additional parking since the locus already has fifteen (15) spaces waived in accordance with the February 6, 2004 Zoning Board of Appeals decision 006-04. 4. Therefore, based upon the foregoing, the Board finds that the proposed use of the second floor space for retail use, open to the public, or the conversion of the existing second floor space back to two (2) one-bedroom apartments is in harmony with the general purpose and intent of the Zoning By-Law, and is not substantially more detrimental to the neighborhood. Further, the Board finds that a literal enforcement of the provisions of the Zoning By-Law would involve substantial hardship to the Applicant if there was a prohibition against allowing retail use on the second floor. Thus, the desired relief maybe granted without substantial detriment to the public good. 5. Accordingly, by a UNANIMOUS vote, the Board hereby GRANTS the relief requested for a MODIFICATION of Special Permit 006-04 allowing the second floor to be used for retail space with access to the public, or the conversion of the second floor to two (1) one-bedroom apartments with no additional relief necessary by the Board. The Board made a finding that a loading zone is not necessary because of the grandfathered commercial use of the property. Relief is hereby conditioned upon the following: a. The first and second floor will be limited to one retail tenant only.
