DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, October 8, 2009 and Thursday, December 10, 2009 at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the following
Decision on the Application in Zoning Board of Appeals File No. 053-09 of Paula
C. Edmunds of 78 Hotham Road, London, England, SW151QP.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33.A.(5) (alteration of pre-existing, nonconforming
structure) in order to validate the existence of a deck sited in the front yard
setback. Said deck is as close as 7.4 feet from the front yard setback in a zoning
district that requires a ten (10) foot front yard setback. The structure is sited as
close as six (6) feet from the front yard setback. In the alternative, the Applicant
is requesting variance relief pursuant to Nantucket Zoning Bylaw Section 139-32
(variances) from the intensity regulations found in Nantucket Zoning Bylaw
Section 139-16 (intensity regulations). The site is located at 10 Derrymore Road,
is shown on Nantucket Tax Assessor's Map 41 as Parcel 243, is shown on Plan
File 13199-B, and is registered at the Nantucket County Registry as Certificate of
Title No. 22422. The site is zoned Residential-I.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation as the Application presented no
matters of planning concern. No abutter comment was received either in favor
of or against the Application.
4. At the hearing, the Applicant was represented by Ms. Tori Wilson. Ms.
Wilson explained that she is before the Board requesting Special Permit relief to
validate a deck sited in the front yard setback in order to close out her client's
Building Permit. Said deck is as close as 7.4 feet from the front yard setback in a
zoning district that requires a ten (10) foot front yard setback. The pre-existing,
nonconforming structure is sited as close as six (6) feet from the front yard
setback.
Ms. Wilson explained that by virtue of a zoning change, the structure
became pre-existing nonconforming because the front yard setback was changed
from zero feet to ten feet after the structure - but not the deck - was sited in its
present location. Nonetheless, in October 2003 the Applicant applied for a
Building Permit in order to construct a deck. The permit was duly signed by the
necessary parties; but, Special Permit relief was never applied for in order to
approve an extension of the structure wherein the nonconforming distance of the
structure is not made more nonconforming and that the Board of Appeals finds
that said extension is not substantially more detrimental to the neighborhood.
Additionally, the Applicant had received Historic District Commission approval
in 2003 for the deck extension which is the subject of this Application.
After deliberating and upon further examination of the various Building
Permits and Historic District Commission plans, it appeared as though it was an
oversight that this Special Permit was never applied for.
Therefore, the Applicants are requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-33.A.(5) in order to validate the location of
the existing deck as close as 7.4 feet from the front yard setback in a zoning
district that requires a ten foot front yard setback.
5. Based on the foregoing presentation and the accompanying
documents, the Board finds that validating the site of the existing deck at 7.4 feet
from the front yard setback is within the purpose and intent of the Zoning Bylaw
and said extension of the structure is not substantially more detrimental to the
neighborhood than the existing nonconformity.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33.A.(5) to validate the existing deck sited 7.4 feet from the front yard
setback as shown on the plan entitled" As-Built Plot Plan", prepared by Bennett
Engineering, dated June 22, 2009, and attached as Exhibit A, with the condition
that no further construction of structures, nor additions shall take place within
ten feet of the northerly front yard lot line without the issuance of further relief
by the Board of Appeals, there were five (5) votes in favor and none (0)
opposed.
