HAMILL and JENNIE H. VORHEES - 9 GAY STREET The Applicants, Michael J. Hamill and Jennie H. Vorhees, request Special Permit relief pursuant to § 139-33 A (4) of the Nantucket Zoning By-Law for their property located at 9 Gay Street (the "Property"), Parcel 42.4.3 on Nantucket Town Assessor's Map 34, shown on a plan entitled Perimeter Plan of Land in Nantucket, Mass., prepared by Chalres W. Hart & Associates, dated June 25, 2009 and recorded as plan numbered 2009-29 at the Nantucket Registry of Deeds on July 10, 2009. The applicants propose to renovate the existing single family dwelling on the Property, as set forth below. More specifically, with respect to the two (2) story wood building of the existing structure, the applicants propose to add one (1) dormer on the second floor as well as a roof walk, as shown by the Site Plan prepared for the Hamill Residence by Emeritus Development, Ltd., dated September 8, 2009, a copy of which is attached hereto as Exhibit "A". The Applicants also propose to demolish and renovate the one and one half (1 %) story rear "L" of the existing structure. Applicants plan to rebuild the rear mass of said "L" utilizing its existing footprint while adding a second story and twenty- four (24) square feet of new ground cover along the east side of the structure, as shown on said plan. Where the front part of the "L" is located, applicants propose to rebuild matching the existing walls and roof, adding two (2) new dormers, and sixty-five square feet of new ground cover on the east side of the structure, as shown on said plan. This work will be conducted in accordance with the architectural plans attached hereto as Exhibit "A", prepared by Emeritus Development, Ltd. which are pending before the Nantucket Historic District Commission. The Applicants anticipate receiving a Certificate of Appropriateness prior to the October 2009 Zoning Board of Appeals Hearing. The subject property is located in the Residential Old Historic (ROH) Zoning District. The structures on the Property were erected in the 1840's, as evidenced by the "Building Structure Inventory Form" from the Nantucket Historic District Commission, a copy of which is attached hereto as Exhibit "B", and specifically the photographs therein. Accordingly, the dwelling is pre-existing, non-conforming as to the current intensity regulations for the ROH district. The dwelling is located on the westerly lot line within the current required five foot side yard setback as shown on a Plot Plan prepared by Dan Malloy, P.E., of Site Design Engineering, Inc., and dated August 26, 2009, a copy of which is attached hereto as Exhibit "C". The proposed work will be done partly within the current required 5' side yard setback on the west side of the Property, as shown by the plan attached hereto as Exhibit "A". However, the majority of the work will take place outside of the required set back areas. Finally, the Lot is 2,873 square feet with existing ground cover of 1,340 square feet. The current ground cover ratio is 47%. The work proposed by the applicants will increase the Property's ground cover to 1,429 square feet, or 50% ground cover ratio. The proposed work will therefore increase the ground cover ratio to 50% but will nonetheless be compliant with the ground cover ratio permitted in the ROH district. Granting the proposed Special Permit will not be substantially more detrimental to the neighborhood than the existing, non-conforming dwelling on the Property. The proposed renovation and addition to the existing dwelling is moderate in size. The renovated dwelling will be in harmony with other houses in this area of the island. Also, by granting the requested Special Permit, the Board would be acting in a manner consistent with the spirit and intent of the Zoning By-Law. After the Atlantic Silk Company factory (10, 12 Gay) was built in 1835-36 at the t`x ~~ opposite end of the block, the name was changed to honor Garrlaliel Gay, the inventor who improved the machinery ~" used in the mill. The looms are said to have been the second in the world powered by steam machinery, and the plant was the first and only one of its kind in Nantucket. Groves of mulberry trees, essential to the raising of :"" silkworms, were planted back of the George Easton house on Notth ZVater and elsewhere but did not do well. The a~, silk industry on Nantucket was short-lived, tasting only eight years. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, November 12, 2009 at 1:00 P.M., in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts 02554, the Board made the following decision on the application Michael Hamill and Jennie H. Voorhees of 53 North Moore Street, Apt. SD, New York City, NY, 10013, Board of Appeals File No. 052-09: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) (alteration of pre-existing, nonconforming structure) in order to renovate and construct an addition that will add twenty-four (24) square feet of new ground cover. The locus is non-conforming as to lot size; but, the structure and locus meet -and will continue to meet -all other dimensional requirements of the zoning bylaw. The site is located at 9 Gay Street, is shown on Nantucket Tax Assessor's Map 42.4.3 as Parcel 34, is shown on Plan No. 2009-29, and is recorded at the Nantucket County Registry of Deeds in book 1139, Page 142. The site is zoned Residential Old Historic. 3. Our decision is based upon the application and accompanying materials, and representations, and testimony at our public hearing. The Planning Board made no recommendation on the basis that no matters of planning concern were presented. No members of public commented on this application. 4. The Applicant is requesting Special Permit relief pursuant to Nantucket Zoning By-law Section 139-33.A.(4) in order to renovate the pre-existing, non-conforming structure on the Premises and, more specifically, to construct an addition that will add one (1) dormer on the second floor, as shown by the Site Plan prepared by Emeritus Development, Ltd., dated September 8, 2009, a copy of which is attached hereto as Exhibit "A"; demolish and renovate the one and one half (1 '/z) story rear "L" of the existing structure and rebuild the rear mass of said "L" utilizing its existing footprint while adding a second story and twenty- four (24') square feet of new ground cover along the east side of the structure. Also, as part of the proposed work within the current westerly side yard setback, the Applicants propose to repair/replace portions of the existing foundation that are compromised and/or do not comply with the Massachusetts Building Code, 780 CMR 7`h edition. Where the front part of the "L" is located, Applicant proposes to rebuild matching the existing walls and roof, adding two (2) new dormers, and sixty- five (65') square feet of new ground cover on the east side of the structure. The locus is undersized, having 2,873 square feet in a zoning district that requires a minimum lot size of 5000 square feet. The structure is otherwise conforming to all intensity regulations. The new additions will give the structure a total ground cover of about 1,429 (or 50% ground cover ratio) which is still compliant with the ground cover regulations of the ROH district with Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.E.(2)(a). 5. Based on the foregoing, the Board finds that the proposed addition will not be substantially more detrimental to the neighborhood than the existing nonconformity and that Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139-33.A.(4) and 139- 33.E.(2)(a) is appropriate and is not contrary to the general purpose and intent of the Zoning Bylaw. 6. Accordingly, the Board of Appeals, by a UNANIMOUS vote GRANTS the requested SPECIAL PERMIT relief pursuant to Nantucket Zoning Bylaw Section 139-33.A(4) to allow the Applicant to add one (1) dormer on the second floor, as shown by the Site Plan prepared by Emeritus Development, Ltd., dated September 8, 2009, a copy of which is attached hereto as Exhibit "A"; demolish and renovate the one and one half (1 %) story rear "L" of the existing structure; rebuild the rear mass of said "L" utilizing its existing footprint while adding a second story and twenty- four (24') square feet of new ground cover along the east side of the structure; to rebuild matching the existing walls and roof, adding two (2) new dormers, and sixty-five (65') square feet of new ground cover on the east side of the structure where the front part of the "L" is located; and, to increase the Applicant's ground cover to approximately 50% with the following condition: a.
