Enclosed for your records and consideration is a copy of the plan for compliance for the above
mentioned property. A hearing before the Board held on June 29 denied a three year time-
variance to make the building accessible and required that the Town submit a plan by
September 1 showing compliance. We apologize for the delay and hope that the Board will
understand that we were delayed by our negotiations with other local Boards. To date we have
filed for approvals with the Historical District Commission and the Zoning Board of Appeals
which have not made their decision at this time.
As shown on the attached drawing we have proposed to install a handicap lift to the rear of the .
main entry porch on Federal Street. This is in compliance with HDC recommendations. In
addition we have reduced the width of the sidewalk to the lift to 36" in order to provide three
parking spaces for the building. This is one less than required by the ZBA and therefore will
require a variance from them. We expect both approvals in the coming weeks.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, October 8, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 050-09 of the Town of Nantucket, of 16 Broad
Street, Nantucket, Massachusetts 02554.
2. Applicants are requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33.A.(4) (alteration of pre-existing, nonconforming
structure) and 139-18.B.(2) in order to waive one (1) parking space so the
Applicant can construct a handicap accessible ramp. The site is located at 22
Federal Street, is shown on Nantucket Tax Assessor's Map 42.4.2 as Parcel 31,
and is registered at the Nantucket County Registry of Deeds as Certificate of
Title Nos. 19498 and 17459. The site is zoned Commercial Downtown.
3. Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning
Board made no recommendation finding that the Application did not present
any issues of planning concern. No abutter comment was received either in
favor of or against the Application.
4. Diane O'Neil of the Town of Nantucket and Ted Burnham of Burnham
Engineering represented the Applicants at the hearing. Ms. O'Neil explained
that the Applicants are requesting a Special Permit in order to alter the
preexisting, nonconforming structure and to waive one of the required parking
spaces. The structure in question is the Mooney building, across from the Town
Building on Federal Street. The Architectural Access Board has required that the
structure be compliant with the ADA requirements and therefore a handicap
ramp must be installed. Additionally, the Historic District Commission has
required the location of the ramp to be sited where a parking space was located.
In doing so, the structure must be altered and a parking space will be lost in the
process.
5. Therefore, the Board finds that such a Special Permit would not be
substantially more detrimental to the neighborhood than what presently exists
and the requested relief is in harmony with the purpose and intent of the Zoning
Bylaw. Additionally, the Board finds that the granting of the parking waiver is
in harmony with the purposes and intent of the Zoning Bylaw and that it would
be physically impossible for the Applicants to provide the necessary parking
spaces required under the bylaw.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested SPECIAL PERMIT to allow the alteration of the preexisting,
nonconforming structure and to waive one of the required parking spaces to be
in substantial conformance with the site plan entitled "Robert F. Mooney
Building," prepared by Burnham Engineering, dated September 8, 2009, attached
herein as "Exhibit A", there were FIVE votes in favor and NONE opposed.
7. Additionally, by a separate motion made and duly seconded to GRANT
the requested FEE WAIVER, there were FIVE votes in favor and NONE opposed.
