An Appeal from this Decision may be taken pursuant to Section 17 of Chapter 40A, Massachusetts General Laws. Any action appealing the Decision must be brought by filing a complaint in Land Court within TWENTY (20) days after this day's date. NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 Assessor's Map 59.4 Parcel 92 Residential - 20 48 Tennessee Ave Certificate of Title No. 22992 1. At a Public Hearing of the Zoning Board of Appeals held at 1 :00 PM on Thursday, October 8, 2009, in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts, on the Application of Nantucket Land Bank of 22 Broad Street, Nantucket, MA 02554, Board of Appeals File No. 049-09, the Board made the following decision: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) (alteration of pre-existing, nonconforming structure) in order to renovate and rotate the existing structure that is sited approximately 2.1 feet from the front yard setback in a zoning district that requires a thirty (30) foot front yard setback and sited approximately 8.2 feet from the side yard setback in a zoning district that requires a ten (10) foot side yard setback. The site is located at 48 Tennessee Avenue, is shown on Nantucket Tax Assessor's Map 59.4 as Parcel 92, is shown on Plan File 3092- S, and is registered at the Nantucket County Registry as Certificate of Title No. 22992. The site is zoned Residential- 20. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board made no recommendation finding that the Application did not present any issues of planning concern. No abutter comment was received either in favor of or against the Application. 4. Bruce Perry of the Land Bank represented the Applicant. Mr. Perry stated that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) for the alteration of a pre-existing, nonconforming structure. Mr. Perry produced photographic evidence that the structure in question predates the Zoning Bylaw and is sited approximately 2.1 feet from the front yard setback in a zoning district that requires a thirty (30) foot front yard setback. The structure is also sited 8.2 feet from the side yard setback in a zoning district that requires a ten (10) foot side yard setback. The Applicant is proposing to lift the structure and rotate it and place it in exactly the same footprint. Due to wetland constraints, the structure cannot be placed further from the front yard setback. Additionally, Mr. Perry informed the Board that the structure would be raised approximately eighteen inches. Mr. Perry also indicated that the structure has been used to store boats and the Applicant intends to use the structure for storage. 5. Therefore, based upon the foregoing, the Board finds that a grant of Special Permit relief for the proposed change in use under Nantucket Zoning Bylaw Section 139- 33.A.(4) would not be substantially more detrimental to the neighborhood than the existing nonconformity. 6. Accordingly, by a vote of FIVE in favor and NONE opposed, the Board GRANTS the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4) to allow the structure to be lifted, rotated, and placed in substantially the same location as it exists now and to be raised approximately eighteen (18) inches from its present height with the following condition: (a) There structure shall continue to be used for storage.
