As discussed in the Board of Appeals decision in File No. 077-08,
the applicant is a nonprofit membership corporation operating
recreational facilities for its members, including tennis courts.
This use is allowed in all districts by special permit under
Nantucket Zoning By-law ~139-7.0 (5) . The applicant's use pre-
exists the 1972 adoption of the Zoning By-law. Its special permit
status, as to alterations subsequent to the adoption of the By-
law, is confirmed by the decisions in 048-02 and 077-08. The
applicant now proposes to place a basement under the existing main
building upon the locus, which will add about 6,522 square feet in
floor area; the present area of the existing basement is about 356
square feet. The basement areas will be used as an exercise
facility, offices for management of the club, storage, kitchen
expansion, club activities, and restrooms. The building,
constructed in 1899 and 1900, is at about 32 feet above grade; no
increase in height is proposed. There will be no increase in
ground cover nor intrusion into setback areas.. No parking nor
loading facilities exist upon the locus, and none are proposed.
Various tennis courts upon the locus lie wi thin setback areas;
however, these nonconformities pre-exist the adoption of the
Zoning By-law and will not be altered. Accordingly, the applicant
requests Special Permit relief, (a) for the alteration of the pre-
existing recreational use upon the locus under ~139-7.0 (5) and
~139-33.A, (b) for the waiver of parking requirements under ~139-
18.B(2), and (c) for the waiver of off-street loading facilities
under ~139-20.C.
