ADDENDUM
Application to the Nantucket Zoning Board of Appeals,
18 Bartlett Road, Nantucket, Massachusetts
Applicant is seeking a Special Permit under Nantucket Zoning By-
law ~139-7. Applicant proposes to construct a contractor's shop
on the Premises for the purpose of light manufacturing
including, but not limited to, millwork, such as the
construction of windows and doors. Applicant also proposes to
construct an apartment above the shop that he will use as his
primary residence. The proposed shop will contain about 1915
square feet and will require two (2) parking spaces. The
apartment will contain two (2) bedrooms and will also require
two (2) parking spaces. A proposed site plan showing the
approximate size and location of the structure and the proposed
parking and one (1) loading zone is attached.

1. At a Public Hearing of the Zoning Board of Appeals held at 1 :00 PM on
Thursday, September 10, 2009, in the garage area at 2 Fairgrounds Road, Nantucket,
Massachusetts, on the Application of Jerry Batte and Jean M. Batte as owners,
Christopher Bouque as Applicant, c/o Sarah F. Alger, 2 S. Water Street, Nantucket,
MA 02554, Board of Appeals File No. 042-09, the Board made the following decision:
2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-7 (allowed uses) to construct a contractor's shop on the premises for the
purpose of light manufacturing. Applicant also proposes to construct an apartment above
the shop that will be used as his primary residence. The Applicant is planning on
providing adequate parking and a loading zone on site. The site is located at 18 Bartlett
Road, is shown on Nantucket Tax Assessor's Map 67 as Parcel 113.1, is shown in Plan
Book 21, Page 3, and is recorded at the Nantucket County Registry of Deeds in Book
807, Page 250. The site is zoned Residential Commercial - 2.
3. Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning Board made
no recommendation finding that the Application did not present any issues of planning
concern. There was a letter presented at the hearing in favor of the application and one
abutter spoke in favor of the application at the hearing.
4. The Applicant, through counsel, explained that the Applicant proposes to set up a
contractor's shop for light manufacturing and pursuant to Nantucket Zoning Bylaw
Section 139-7, this use requires a Special Permit by the Board of Appeals. The Applicant
has provided adequate parking and a loading zone is shown on the site plan presented to
the Board of Appeals. Counsel for the Applicant also stated that there will be an
apartment above the shop that he intends to use as his primary residence.
5. Therefore, based upon the foregoing, the Board finds that a grant of special permit
relief for the proposed contractor shop for light manufacturing as allowed under
Nantucket Zoning Bylaw Sections 139-7, would be in harmony with the general purpose
and intent of the Zoning Bylaw and consistent with similar commercial uses in the
immediate neighborhood.
6. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested reliefby
SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-7 with the
following conditions:
(a) No more than three commercial vehicles shall be parked on the Premises;
(b) The hours of operation for commercial fabrication or manufacturing shall be not
earlier than 7:30 A.M. or later than 6:30 P.M on Monday through Saturday, with
no such operations on Sundays;
(c) There shall be no outside storage of goods and materials;
(d) When commercial fabrication or manufacturing is being done, all exterior doors
and windows in the shop area shall be closed. The garage shall be equipped with
air conditioning to help facilitate this requirement; and,
(e) The parking and loading layout shall be in substantial compliance with the
attached plan entitled "Bouque, 18 Bartlett Road, Nantucket, MA," prepared by
Emeritus Development, dated September 22,2009, attached as "Exhibit A."
