Exhibit "A"
The Applicant/Owner is seeking relief by SPECIAL PERMIT under Nantucket Zoning
By-law Section l39-33(A)(5)( extension of a nonconforming structure) to allow a deck
attached to nonconforming house at 1 Rosaly Lane (aka Rosalys Lane), in Siasconset.
Said deck lies as close as i: 27.9 feet from Baxter Road, in a district where a 30 foot front
setback is required, and is attached a pre-existing house that is nonconforming as front
setback, being located as close as i: 25.1 feet from Baxter Lane. In addition, there is
separate garage on the property that is nonconforming as to front setback, being as close
as i: 3.8 feet from Baxter Road. In the alternative and if necessary, variance relief is also
requested to validate the deck.
The Premises are located at 1 Rosaly Lane, Assessor's Map 73.1.4, Parcel 32 and Lot I
on Land Court Plan No. 13499-B. The property is zoned Sconset Residential -2.

I, Christopher J. Martin, being duly sworn, depose and say:
1. I make this affidavit from my personal knowledge.
2. I am 63 years old and currently reside at in Toronto, Ontario, Canada. I
have spent summers on Nantucket for my entire life.
3. Since 1977, I have owned the property at 1 Rosaly Lane (a.k.a. Rosalys
Lane), Village of Siasconset, Town and County of Nantucket,
Commonwealth of Massachusetts.
4. In 1953, my parents, Jim and Dorothy Martin purchased 1 Rosaly Lane,
along with the adjacent land and house now known as 3 Rosaly Lane, as a
single lot. At the time of this purchase, there was a separate garage at 1
Rosaly Lane that served the house at 3 Rosaly Lane.
5. In 1966, my parents subdivided their single lot into the two separate parcels
now known as 1 Rosaly Lane and 3 Rosaly Lane; expanded and converted
the garage at 1 Rosa1y Lane into a house; and constructed the separate
garage on 1 Rosaly Lane. In 1971, my parents constructed an addition to
the house at 1 Rosaly Lane.
6. After 1971, the house and separate garage at 1 Rosaly Lane remained
unchanged until I renovated the house in 2008 under Building Permit No.
1004-07

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, September 10, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 041-09 of Christopher J. Martin, cj 0 Paul S.
Jensen, PO Box 3097, Nantucket, MA 02554.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33A(5) (extension of nonconforming structure) in
order to allow the siting of a deck attached to a nonconforming structure. Said
deck lies as close as 27.1.:!=. feet from the front yard lot line in a zoning district that
requires a 30 foot front yard setback. The deck is attached to a pre-existing,
nonconforming house that is sited as close as 25.1 .:!=. feet from the front yard lot
line. There is also separate garage sited as close as 3.8 i: feet from the front yard
setback. In the alternative, the Applicant is requesting variance relief pursuant to
Nantucket Zoning Bylaw Section 139-32 (variances) from the intensity
regulations in Nantucket Zoning Bylaw Section 139-16 (intensity regulations).
The site is located at 1 Rosaly Lane, is shown on Nantucket Tax Assessor's
Map 73.1.4 as Parcel 32 and is shown as Lot 2 on Land Court Plan No. 13499-B
registered with Certificate of Title No. 5451 at the Nantucket Registry District.
The site is zoned 'Sconset Residential - 20.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. There was one letter on file from an
abutter who was in favor of the application.
4. The Applicant was represented by counsel at the hearing. Attorney
Jensen informed the Board that the Applicant is requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139-33.A.(5) (extension of
nonconforming structure) in order to allow the siting of a deck attached to the
nonconforming structure. Said deck lies as close as 27.1 2:. feet from the front
yard lot line in a zoning district that requires a thirty (30) foot front yard setback,
but is attached to a house, which lies as close as 25.12:. feet from the front yard lot
line. According to the affidavit submitted with the application, the house and a
separate garage were built in 1960's and are pre-existing non-conforming
structures. The deck, which supports an outdoor shower and provided access to
back of the house, was constructed as part of a 2006 renovation of the house and
is shielded from Baxter Road and the neighborhood by the non-conforming
garage.
Counsel informed the Board that in the alternative, the Applicant is
requesting variance relief pursuant to Nantucket Zoning Bylaw Section 139-32
(variances) from the intensity regulations in Nantucket Zoning Bylaw Section
139-16 (intensity regulations) to validate the siting of the deck.
5. The Board asked the Applicant's counsel whether the Applicant
used Rosaly Lane or Baxter Road for their front yard setback. Counsel informed
the Board that Baxter Road was used as the front yard setback.
6. Therefore, the Board finds that the deck is an extension of a pre-
existing house that is non-conforming as to front yard set back, that the deck
does not make the non-conforming front yard set back of the house more non-
conforming, and that the addition of the deck is not substantially more
detrimental to the neighborhood then the non-conforming house and garage.
7. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-16(C)(2) to validate the siting of the deck as shown on the attached
plan entitled "Zoning Board of Appeals Building Location Plan" dated August
10, 2009, prepared by Charles W. Hart and Associates, Inc., attached hereto as
"Exhibit A", there were four (4) votes in favor and one (1) opposed (McCarthy)
with the condition that Baxter Road remain the front yard for zoning purposes.
