NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 Assessor's Map 55 Parcel 404 RC-2 86 Union Street Book 1019, Page 164 1, At a Public Hearing of the Zoning Board of Appeals held at 1 :00 PM on Thursday, September 10, 2009, in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts, on the Application of Nantucket Land Bank of 22 Broad Street, Nantucket, MA 02554, Board of Appeals File No, 039-09, the Board made the following decision: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-33.A,(1) (change in use) to reduce the building footprint and change the use of the structure from residential to storage. The site is located at 86 Union Street, is shown on Nantucket Tax Assessor's Map 55 as Parcel 404, and is recorded at the Nantucket County Registry of Deeds in Book 1019, Page 164, The site is zoned Residential Commercial. 3, Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing, The Planning Board made no recommendation finding that the Application did not present any issues of planning concern, No abutter comment was received either in favor of or against the Application, 4, The Applicant presented materials to the Board and explained that the size structure will be reduced and the use will be changed from residential to storage, In 1986, the Applicant applied to the Board of Appeals to install an accessory apartment and was duly approved in File No, 048-86 to install an accessory apartment. Now the Applicant is before the Board because the accessory apartment has been removed and the Applicant wishes to abandon the residential use of the property, The Applicant informed the Board that pursuant to a determination by the Historic District Commission (HDC), the structure could not be relocated to another locus, Accordingly, had the HDC ruled differently, the Applicant would not be requesting relief from the Zoning Board of Appeals. Regardless, it is arguable that the as the property is owned by the Land Bank, it is a municipal use as the Land Bank is a quasi-municipal use and the property is available for all to benefit and enjoy. Accordingly, municipal uses are allowed in all districts and the use of this storage use is therefore allowable by Special Permit. During the course of deliberations, the Board determined that appropriate relief may be granted by Special Permit. However, as the property in question is pre-existing the Zoning Bylaw but is not nonconforming to any such provision of the code, Special Permit relief may be granted only as a matter of relieving the Applicants from the provisions of the definition of "Accessory Structure" in Nantucket Zoning Bylaw Section 139-2 so as to allow an accessory structure (a structure used for storage) to exist without a primary structure existing on the premises, The Board also based this decision on the representation from the Applicant that the intensity of use of the property will be very low, The Applicant indicated that only between 4-6 trips would be made to the property per year. 5. Therefore, based upon the foregoing, the Board finds that a grant of Special Permit relief for the proposed change in use under Nantucket Zoning Bylaw Section 139- 30 (Special Permits) from the definition of "Accessory Structure" in Section 139-2 (Definitions) to allow for the residential use of the structure to be abandoned in order for the structure to be used solely for storage would be in harmony with the general purpose and intent of the Zoning Bylaw and consistent with similar commercial uses in the immediate neighborhood. 6. Accordingly, by a vote of FOUR in favor and ONE opposed (Poor), the Board GRANTS the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-30 from the definition of "Accessory Structure" in Section 139-2 to allow the existing residential structure to be altered and abandoned and converted to storage with the following conditions: (a) There shall be no outdoor storage on the Premises; (b) The existing driveway shall be abandoned; and, (c) The perimeter of the property shall be fenced.
