DECISION
i At a meeting of the Board of Appeals held \tlednesday,
! December 17, 1980, at 3:30 P.M., at the Town and County
Building, Nantucket, in the matter of the application of
CHRISTOPHER WALTON (049-80), after due deliberation, the
Board found:
1. This is a petition for relief from the sideline set-
back requirements of Section V of the Zoning By-Law for
the construction of a dwelling house. The property is
located on Nonantum Avenue in Surfside, and is zoned
, Residential II. The Petitioner seeks to build a house
i which will be 32' x 26' and thus reach within five feet I
, of the sidelines. I

2. The lot is 5,023 square feet in area, being far less;
than the 20,000 square feet required in this district. i
It is a buildable lot because it was created by a plan i
, recorded before the effective date of the By-Law and is I
separated from all abutting land by three avenues. The I
! area is developed with several summer and year-round
: homes. The applicant is a prospective purchaser of the I
property.
3. The Board finds no compelling reason for granting
relief in this matter, and finds there is no need to
build a structure which exceeds the restrictions of the I
By-Law. The Applicant has not demonstrated any need for;
relief in this case. i
For the reasons set forth, the Peti.tion is unanimously
denied.
