The patio is a terrace1 area of brick am blue stale, CXJntaining thirty (30) tables ard lattice fence. 'Jbe ~pplicant' s property is located in a Limit€d Carmercial District where the hotel itself has been in operation prior to the Zoning By-raw of 1972 ani is, therefore, a non-confarming use. Any alteration or expansion of this establisl1nent requires a Special Permi.t. 2. The Applicant oonterrls the patio area enjoys the stat'>:1S of a pre-existing non-oonfCX'IllilYJ use based upon testim:my of an enployee that the lawn in this area was occasionally used for serving drinks during the StIttrer of 1971. The overwhelming evidence of the neiqhbors was to the contrary, that no construction exist€d on this site before 1980 ani there was no service area established. L, Chapter 40-A Section 17, the plaintiff in the above-entitled action brings this appeal for judicial review of the Town of Nantucket Board of Appeals decision dated December 5, 1980 with reference to the application of the plaintiff, Island Hotels Company numbered 028-80 concerning the property of the plaintiff located on South Beach Street in the Town of Nantucket. The plaintiff says: I That it owns land on South Beach Street being Lots 1 and 2 on a plan numbered 36477-A, 2. That the defendant, Robert F. Mooney, is a member of the Board of Appeals of the Town of Nantucket and resides at Lower Orange Street, Nantucket. 3. The plaintiff alleges that the defendant, Eileen 1. Cahoon, is a member of the Board of Appeals of the Town of Nantucket and resides at Main Street, Siasconset, 4. The plaintiff alleges that the defendant, Judith K. Bartsch, is a member of the Board of A ppeals of the Town of Nantucket and resides on Orange Street, Nantucket. 5. The plaintiff says that the Board of Appeals of the Town of Nantucket maintains an address at Town Hall on Broad Street, Nantucket. 5A, That the defendants, C. Pursuant to an appeal filed with the Board of Appeals of Nantucket and numbered 028-80 the plaintiff appealed a decision of the Building Inspector of Nantucket dated July 9, 1980, a copy of which is annexed hereto and marked Exhibit "A ". The plaintiff further filed for relief under various sections of the by-law per the attached application which is marked Exhibit liB" dated July 16, 1980, 7. After hearing for which publication notice to abutters was properly made the defendant, Board of Appeals, upheld the decisio of the Building Inspector and declined to grant relief requested of the plaintiff. It is the contention of the plaintiff that it is entitled to continue to use a portion of its premises for the serving of food and beverages on a patio on North Water Street and that the Board in refusing to over -rule the Building Inspector and in refusing to grant affirmative relief exceeded its authority and the plaintiff, therefore, requests that its decision qe annulled. 8. It is the contention of the plaintiff that the use in question is a permitted use under the zoning by-laws of the Town of Nantucket and it is further the contention of the plaintiff that the present use is not an expansion of an existing prior use. 9, It is the contention of the plaintiff that the defendants have misconstrued the zoning by-laws of the Town of. Nantucket and have capriciously and arbitrarily refused to over-rule the decision of the 'Building Inspector which decision the plaintiff alleges is incorrect. Wherefore, the plaintiff prays: 1 That the court annul the decision of the Town of Nantucket Board of Appeals numbered 028-80. 2, That the plaintiff be awarded costs and attorney's fees. Zero Main Street, Nantucket, Ma. 02554 Gentlemen: Enclosed is a copy of your recent advertisement in the Inquirer & Mirror newspaper. The ad is obviously intended to invite the general public to enjoy breakfast and lunch on your newly constructed patio. The Harbor House is located in a Limited Commercial District. Restaurants, Hotels and Motels are permitted uses only by exception which can, after proper public hearing, be granted by the Board of Appeals. The Harbor House Hotel exists as a pre-existing non-conforming use. The recent expansion of 56 rental units, meeting house, shops and swimming pool was allowed by issuance of a Special Permit by the Board of Appeals. Non-conforming uses or structures may be extended or altered provided there is a finding by the Board of Appeals in accordance with procedures required for the issuance of a Special Permit. The addition of the patio to serve the general public is an extension of a non-conforming use. Your attention is also directed to the Nantucket Zoni~g-Board of Appeals Decision 008-80 dated April 4, 1980, Island Hotels, Inc. petitioner. The following is excerpted from the decision. "After the hearing and a view of the area, the Boards finds as fo110t#s: The burden is upon the applicant to prove a prior non-conforming use of the area. This burden has not been sustained. The evidence from both photographs and testimony of the senior living resident of the area is that this area has never been used for patio purposes and that no construction has existed on. this side for several decades. Such a use of this property would be an expansion of the use of the Harbor House and an extension of service facilities into an area without a Special Permit. The appeal from the decision of the Building Inspector is, therefore, denied. II .
