At a meeting of the BOARD:~ APPEALS held September 19 ,
1980, at 3:00 P.M., at the ~own ~d County Building, in
the matter of the application of.:ttowARD and HEDDA MARSH
(027-80), after due deliberation, the Board found:
This is an application for,a Special Permit to extend a
non-conforminq use by the alteration of a structure for
educational purposes. The structure on Wauwinet Road is
a former barn located on a one-acre lot in a LUG-III
district, and has been used for a school of desiqn for
the past two years.
The Board finds this property is located in a purely
residential subdivision. It is a convert&d barn site
which does not have public water supply or sewaqe connec
tion but relies upon private well and septic system.
The use of this property for school purposes will greatl
increase the vehicular traffic and parking problems of
the neighborhood. Despite all the factors, the Board is
limited by the provisions of the Zoninq Act, General Law ,
Chapter 40A, Section 3, which reads:
"No zoning ordinance or by-law shall regulate
or restrict...the use of land or structures...
on land owned or leased...by a non-profit
educational corporation...w
The Board has been advised t~e present tenant, Nantucket
Island School of Design, has 'been determined. to be a
non-profit educational corporation. The Board, therefor ,
cannot restrict this operation.
The Board can, however, impOse reasonable requlations
under Chapter 40A, Section 3.,. and, therefore, imposes
the following conditions uPlP. ~the continued operation of
this institution: 7~' ~
I. Due to the increased traffic generated by the
school operation in this residential area, the property
shall furnish on-site parking space as follows. one
parking space for every three students, and one parking
space for each teacher and employee.

2. The property shall be regularly inspected by
the Health Inspector and Bulldinq Inspector.
3. The provisions of the state Health Code and
State Building Code, as applicable to educational
establishments, shall be r~9idly enforced, and any
violation shall be cause to'terminate this operation.

Friday, August 22, 1980, at 3:00 P.M., at the TOWN AND
COUNTY BUILDING, FEDERAL and BROAD STREETS, NANTUCKET,
on the application of HOWARD and HEDDA MARSH for
relief under Section 8-H-3 of the Zoning By-Law to
alter a non-conforming use by converting,an aqricultural
barn into a cultural school. Said property is located
on Wauwinet Road and is zoned LUG-III.
