At a regular meeting of the Board of ~als held Friday,
July 25, 1980, at 3:00 P.M., at the Town and Coonty Building, in
the matter of the aI={)lication of WIIL:IH1 F. HlNI'ER (024-80), after
due delfreration, the Board found:
1. This is an awlication to exparrl a non-ccnforming use
to IJermit construction am ocrupancy of an additioo to an existing
dwelling unit on an uriiersiZErl lot located on Ocean Avenue in
. Siascanset and zonei Residential/Old Historic.i The lot, which was
created un:1er Section 8lL in 1980, CX)Iltains a small guest cottage
located on a lot containing 1, l63 square feet of lard. '!he min.i.tmm
lot size in this district is 5,000 square feet ani there is no
front yard set back. The grourd cover requirarent allows 70%
ooverage of the land.
2. The Applicant purchased this prqJert.y in 1980 and it is
1'1Ofl slx:Jwn as lot 1 on plan dated 1lpril 28, 1980. . He wishes to add
to the front of the building up to the line of Ocean Avenue, which
additicn will make the wilding 576 square feet or 48% of the
grOl11'Xl. oover, which will not violate the existing density regulations.
3. The subject pIq)erty was for many years one of the
cottages carprising the M:)by Dick Hotel and cottage cx:rrplex on
Ocean Avenue in Siasconset. As such, these cottages were rented to
transient visitors duriDJ the smmer m::>nths and were never used as
per.rranent year-rOUJ'rl ~llings. Such a change as envisioned by
the Applicant, would anDlU1t to a substantial change in this neigh-
borl1c;oj by creating year-roorrl dwellings in the midst of a surmer
cottage colony.
4. Furthen1'ore, the Board is well aware that this pr~rty
is only one of eight (8) cottages which have been similarly divided
fran the main hotel property an:l there exists a potential for
awlication by all eight prcperties if the precedent be established.
5. Such an extension of tl:ese non-a::mforming uses would be
substantially rrare detrimental than the present non-conforming use
to this neighborhood. Th<?xefare, the awlication for a Special
Permi t to expand a non-conforming use is unanim:>usly denied.
