At a regular Jreeting of the Board of Appeals held Friday,
July 25, 1980, at 3:00 p.m., at the Town and County Building, in
the matter of the awlication of JEAN ENOS (023-80), after due
deliberation, the Board fOUl'rl:
1. This is a petition for relief fran SECTI(J\( V, nn.'ENSITY
REGUIATIOOS, of the By-Law in order to penni t the construction of
a dwelling boose on a lot kIx:Iwn as IDt 22 located on South Sl'x>re
!bad am zoned llJH-II. The lot consists of 50,023 square feet of
lam and presently CX)I1tains three (3) existing small cottages.
'!be Petitioner wishes to construct a fourth oottage on this pro-
perty on an existing concrete fourrl.ation.
2. The Petitioner has owned this property since 1966 and
has oonstructed the three existing dwellings with his own labor
aM materials. The Petitioner planned to build a fourth dwelling
and rereived approval for this dwelling fran the Historic District
CaTrnission on February 29, 1972. He rereived an extension of
this certificate on January 19, 1973. He was unable to carplete
rrore than the foundation due to financial difficulties, and in the
ensuing years the property was placed in the llJG- II zoning
district. In addition to the concrete f01..mdation, the Petitioner
has installed a dual septic systan serving all the proposed
dwellings on the prcperty, which has been awrove::l by the Health
Inspector on that basis that the small cottages pose no septic
problems.
3. The Board finds that the Petitioner has consistently
planned to carrplete the remaining cottage since his original
application in 1972 before the adoption of the zoning by-law, and
that he \\Ould suffer a 9enuine hardship if prevented fran doin:J
so. The exisi ting construction on the property is nnique and the
lot shares rertain features which are not u...lllUll to other prcperty
within this zoning district. For the reasons set forth, the
application for relief fran Section V is granted by unanilrous vote
to permit the construction of one final dwelling tx>use upon the
existing foundation on IDt 22 on South Shore Foad.
