DECISION:
At a regular meeting of the Board of Appeals,
held Thursday, July 10, 1980, at 11:30 a.m., at the
Town and County Building, in the matter of the applica-
tion of John Burkhart (021-80). after due deliberation,
the Board found:
1. This is a petition for relief from Section
8-H-3 of the Zoning By-Law to permit the alteration of
a two-family house to a guest house containg six room
rental units. The property is located at 94 Oranae
Street and is zoned Residential/Old Hist.. 'l'ht.:
building enjoys the status of a pre-existing non-
conforming use since apartments units are not permitted
under the zoning by-law. This property has contained
two apartments dating as far back as 1939, and since
that date it has contained two kitlchen units which are
essential for separate apartments.
2. The proposed alteration would substitute 6
guest rooms for the two existing apartments and would
serve to eliminate two kitchens from the building. In
the view of the Board, this is a valid alteration of a
non-conforming use of the property. The substitution
of guest room units would serve to make the pro~erty
more productive and would involve no change in the
exterior appearance of the structure. The neighborhood
is not entirely residential in area as there are
several nearby guest houses, which have always been well-
run. In addition, Nantucket has historically provided
well-kept guest houses for its transient visitors and
such a use has served to enhance the appearance,
desirability, and value of the neighborhood.
3. For these reasons the Board finds that the
proposed alteration will not be substantially more
detrimental than the existing. non-conforming use to
the neiqhborhood. The Special Permit is hereby granted
for the alteration of the premises at 94 Orange Street
to contain six guest rooms with no kitchens by unani-
mous vote of the Board.
