DECISI~:
At a regular neeting of the Board of ~ls held Friday,
July 25, 1980, at 3:00 p.m., at the Town and County Building, in
the matter of the applicatim of JAM!:S P. MLZELL (020-80), after
due delil:::eratian, the Board fourxl:
1. This is a nultiple application for a variance fran the
Intensi ty Regulations of the Br-Iaw to allow the construction of a
dwelling house on an un:1ersized lot am fran relief of the require-
ments of the sideyard arrl setback area. The prcperty is located
off Polpis Road, which is zoned. ux;- III. '!'tIe subject prcperty is
a vacant lot having 29,528 square feet of land in an area which
requires 120,000 square feet. This p~ty was purchased by an
adjoining owner in 1973, which, urrler the law, this lot then
nerged with their urdersized IDt IS. The Petitioner purchased
IDt 16 in 1979 urrler the irrpression it was a wildab1e lot. 'Ibis
impression was that existing lots were forever protected fran the
By-Law and was widely shared by real estate attorneys until the
decision fran the SuprEm:! Court. '!he Petitioner faces a hardship
in that he has purchased the property in good faith and \ttUUld
othexwise be unable to wild qxm it wit.lnut relief fran this
Board .

2. 'The addi tional r~t for relief fran the side yward
arrl setback requirE!llEl1ts are occasioned by the fact the prcperty is
traversed by a snall creek or Wietlarrl area where building would be
virtually iIrpossible. For this reason, the house call1X)t be centered
on the lot wt must be located close to adjacent property to the
north. The abutting neighbors having been notified, do not object
to the location arrl the presence of the unbuildable area on the
property remers this a unique situation not CulllJ.Jll to other lots
in the area arrl, thefore, justifying relief fran this Board.
3. Far the reasons set forth, the Board firrls that owing to
circumstances relating to the soil conditions, shape, arrl topography
of the land stown as lot 16 in Plan Book 16, Page 90, which carrli-
tions do not generally effect other lard in the zoning district, a
literal enforcerrent of the provisions of this By-law would involve
substantial hardship to the Petitioner am. relief may be granted
him without substantially derogating fran the intent arrl p.lrpose
of this By-Law. It is the un.aniJIous decision of the Board that a
variance be grantErl for the construction of a dwellincr house on
this lot 16 without regard to the side line arrl rear ~1:.tJack
requirements of the By-Law in accordance with plan subnitterl to
this Board and to the Building Inspector.
