A Public Hearing of the BOARD OF APPEALS will be held
Friday, JUNE 20, 1980, at 3:00 P.M., at the TOWN AND
COUNTY BUILDING, FEDERAL and BROAD STREETS, NAN'l'OCItET,
on the application of PAUL G. and ANN B. MURPHY for a
Special Permit to alter a non-conforming use by con-
verting six (6) apartments into three (3) apartments
and six room rental units. The Premises are located

DECISION:
At a regular meeting of the Board of Appeals held
Thursday, July lO, 1980, at 11:30 a.m., at the Town and
'County Building, in the matter of the application of
PAUL G. MURPHY, ET UX (019-80), after due deliberation,
the Board found:
1. This is a petition for relief from Section
, 8-H-3 of the Zoning By-Law to permit the alteration of
a six apartment house to a guest house containing
three apartments and 6 rental room units. The property
is located on Cliff Road and is zoned Residential/ Old
Historic The building enjoys the status of a pre-
existing non-conforming use since apartments units are
not permitted under the zoning by-law. This property
contains six apartments with a kitchen in each apartment.
2. The proposed alteration would substitute
3 apartments and 6 guest rooms for the six existing
apartments and would serve to eliminate three kitchens
from the building. In the view of the Board, this is
a valid alteration of a non-conforming use of the
property. The substitution of guest room units would
serve to make the property more productive and would
involve no change in the exterior appearance of the
structure. The neighborhood is not entirely residential
in area as there are several nearby guest houses, which
have always been well-run. In addition, Nantucket has
historically provided well-kept guest houses for its
transient visitors and such a use has served to enhance
the appearance, desirability, and value of the neighbor-
hood.
3. For these reasons the Board finds that the
proposed alteration will not be substantially more
detrimental than the existing non-conforming use use to
the neighborhood. The Special Permit is hereby granted
to contain three apartments and six guest rooms by
unanimous vote of the Board.
