For Special Permit for Cluster Development
Dear Madam:
Please be advised that the Board of Appeals had a public
meeting held October lO, 1980, and unanimously voted as
follows:
To refer this application back to the Planning
Board in order for the Petitioner to provide
additional information as required for
recommended action and conditions of the pro-
posed Special Permit for cluster development.
VOTED:
It was further agreed, in writing, that the date set forth
in the zoning by-law for action by the Board of Appeals
shall be extended to and including December 15, 1980.
I would suggest this letter be included with your records
of the application.

BOARD OF APPEALS
Nantucket, Massachusetts
A regular meeting of the Board of Appeals was
held Thursday, July 10, 1980, at 11:30 a.m., in the
Town and County Building. Present were members: Mooney,
Cahoon, and Bartsch.
The first matter to come before the Board was
the application of STEPHEN PLIMPTON (018-80). After
discussion it was agreed that the Board could not act
upon the proposed application without a recommendation
from the Planning Board. The Chairman was authorized
to write to the Applicant directing him to submit
complete plans and specifications to the Board before
any favorable action could be considered.
The next matter to come before the Board was the
application of PAUL G. MURPHY, ET UX (Ol9-80) for a
Special Permit to alter a non-conforming use on Cliff
Road. After discussion, the application was voted
favorably by unanimous vote.
The next matter to come before the Board was the
application of JAMES P. DALZELL (020-80), which matter
was continued pending a further hearing on a request for
a variance.
The final matter before the Board was the applica-
tion of JOHN BllRKHART (02l-80) for a Special Permit to
alter a non-conforming use at 94 Orange Street. After
discussion, the application was voted favorably by
unanimous vote.
There being no further business before the
Board, on motion duly made and seconded, it was unani-
mously vote to ADJOURN.

'.1. TP.is is an awlication for a Special Permit far a Cluster Devel-
opnent urrler Section 4A-2 of the Zon~ By-law. The property cm-
sists of ahout 46 acres of lard on South Shore ?ocrl arrl is zoned
'LIMITED USE GENERAL II. This matter was first heard on June 20,
1980, arrl continued far further recamterrlations of the Planning
: Board, confererces, am further consideration, with the date far aJr
. decision exten::l.ed bv Agreanent to Decemhe:r 22, 1980.
,2. The Applicant has suhnitted plans calling for a sub-division of
the lam into 29 lots, of which 27 are prcposErl tuildinJ lots.
[These plans were reviewed by the PlannilXJ Board, which reported arrl
Ireccrrrre.rrled the application be denied. The plans, report, am oor-
tresporrlence with the Awlicant are inoorporate1. into the reoard file
on this matter. The Board has viewed the site, which is presently

3. The Board fWs, after due consideration of the report arrl reaon-
-merrlations of the Planning Board, as follows:
a. The increased ntm1be:r of dwellings in the proposed cluster
develqrrent \'ril1 not terrl to preserve the heath ani dune larrlscape
as reauired by Section 4A-2-b- (3) of the By-I,cn.l.
b. The proposed open larrl in the developnl:mt has an ina:iequate
configuration to serve any useful purpose for visual ar environnental
needs of the neighborh<Xrl.
c. The entire area contains several roads arrl ways which pro-
vide access to neighl:x:rin;r prcperties, rights in which ways have not
been resolved.

d. The cluster of house lots on the southerly portion of the
larrl may pose health problans when fully developerl.
Far the reasons set forth, the Board firrls the proposed ClUster
Developnent will not praoote the purposes of the By-Law as set forth
in Section 4A-2- (a) ani the application is, the:refcre, denied by
unanim:>us vote.
