DECISION:
At a regular meeting of the BOARD OF ~~PEALS held on
Friday, May 23, 1980, at 3:00 P.M., at the TOWN AND
COUNTY BUIIJDING, in the matter of the application of
TONY CLEMENTI (Ol7-80), after due deliberation, the
Board found:
l. This is an application for a Special Permit to
extend a non-conforming use by extending refrigeration
facilities to the China Seas Restaurant located on Main
Street in Siasconset. ~he property is a non-conforming
use having existed as a restaurant since before the
adoption of the Zoning By-law.
2. The applicants wish to install a l4' x lO' commer-
cial refrigerator to serve the restaurant business.
The equipment is represented to have a minimal effect
on the noise in the area. The extension of the non-
conforming use would not be substantially more
detrimental than the existing use of the premises, pro-
vided the applicants take steps to preserve the
character of the neighborhood.
3. Therefore, the application for extension of a non-
conforminq use by the installation of a 10' x 14'
refrigeration unit is approved by unanimous vote, pro-
vided as a condition of this permit that the addition
shall be fully screened either by fencing or shrubbery
and no exterior debris shall be allowed to remain on
or about the property.
