DECISION:
At a regular meeting of the Board of Appeals,
held Friday, April 18, 1980, at 3:00 P.M. at the Town
and County building, in the matter of the petition of
Christopher D. Emery (011-80), after due deliberation,
the Board found:
1. This is a application for a Special Permit to
expand a non-conforming use by establishment of a surf
shop in an existing garage in Madaket. The shop would
be a seasonal operation, renting and selling items
incidental to beach activities. The present neighbor-
hood is zoned residential but a non-conforming restaurant
and gas station in the area have existed for many years.
2. The Board finds that this use of the premises
would be appropriate to serve the needs of a substantial
number of people. There will be no noticable increase
in vehicular traffic or parking problems. T~e proposed
expansion will not be substantially more detrimental to
the neighborhood than the existing use of the property.
3. Bv unanimous vote, the petition for a Special
Permit is 0ranted.
