1. This is an application for a Special PeI:r.1it to operate a restau-
rant without providing parking spaces and a variance frCJT\ the
requ.irerrent for off-street loading facilities. The pranises are
locatErl on Lov,"'eJ:' Irrlia Street in t1:1e original Old Historic District
where parking spaces ~~re minim3.1 am were not required of other
restaurants. rrhe Petitioner has indicated c. \tdllingness to abide
by the corrli tions which may re imposed on this oreration.
2. The property is lilnited to 40-foot frontage am as tP.e lot is
largely covereC. by the build ing, there is no available loacling area.
Loerling frem the street rray be allowed suhject to controls i.rrposed
by t..he Board of Selectmen. "S the neiollborhcxx1 is entirely ccr.ner-
cial in nature, t.~e restaurant is a perIT1i tted use, but its operation
in this congested area should t-e stricly regulated to avoid offen-
sive noise, cOors, and traffic.
3. The application for reli ef fran parking recruirerents is granted,
and the application for relief fran ~ off-street loading facility
is allONed subject to the foll~ring candi tions of this Special
Permit:
a. IDading am deliveries fran India Street shall he restricted
as to times set forth l:y the Board of SelecbPen.
b. TD.e restaurant shall have no winda.lS or doors facing the
Roberts House or Four Seasons Guest House.
c. The restaurant shall have no outside service area, taJre-out
food, nor atrlible music tJ-..at shall infringe up::m ~ peace of the
neigrmrh:x:x1.
