DECISION:
~t a regular meeting of the BOARD OF APPEALS held
Friday, ~arch 28, 1980, at 3:00 p.m., in the To~m and
COUNTY BUILDING, FEDEPAL AND BROAD STREETS, NANTUCKET,
in the matter of the application of ISLAND HOTELS, INC.
, (008-80), after due deliberation, the Board found:
1. This is an application for Special Permit to
extend the permit~ed use of the Harbor House Hotel
located on South Beach Street in an area zoned Limited
Commercial. The proposed addition to the building con-
sists of ap?roximate1y 190 square feet of new building
area. These involve an extension of the entrance to
the annex situated on the southerly side of the main
entrance, being an area of approximately.30 square feet;:
the extension of a room for administrative services into:
the lobby of about 60 square feet; and an expansion of
the lobby itself by approximately 100 square feet. All
these areas will be used for administrative purposes
and will not add to the total guest accomodations or
service facilities of the hotel-restaurant.
2. This proposed increase will require no
increase in parking area and will not have any adverse
effect upon the general neighborhood. The areas effect-
ed by this permit will be entirely located on the Faston
or South Beach Street side of the Harbor House building.
The plans presented by the Petitioner are included here-
in and made a part of this record.
3. The entire Harbor House project was extensive-
ly heard and discl'ssed by this Board previously and
these finding need not be repeated here. The Board
, makes a general finding that the additions sought by
this request for a Special Permit are in keeping with
the character of the neighborhood and are in harmony
with the general purposes and intent of the By-Law.
4. The Special Permit to extend the areas of
the Harbor House building as requested for administrative
purposes is unanimously granted.

At the same hearing, the Board took up the matter
of an appeal from the decision of the Building Inspector!
on March 4, 19RO, denying a building permit. !

1. The appeal states that a permit was requeste~
to make improvements to a patio on the premises of the i
Harbor House which is claimed to be a non-conforming
use. The area is located on a portion of the Harbor
House property which fronts on North Beach Street.
2. After the hearing and a view of the area.,
the Boards finds as follows:
The ryurden is unon the applicant to prove a
prior non-conforming use of the area. This burden has
not been sustained. The evidence from both photographs
and testimony of the senior living resident of the
i area is that this area hs never been used for patio
purposes and that no construction has existed on this
side for several decades. Such as use of this property
would be an expansion of the use of the Harhor House
and an extension of service facilities into an area
without a Special Permit.
3. The appeal from the decision of the Building
Inspector is, therefore, denied.
