The secarrl dwelling is (or will be) part of the realty described
in Certif.icate of Title No. 8341, which lists three a.mers. As
such, evezy buildil'X] cm the lot must have the same ownership and

Enclosed is a copy of a letter from Elizabeth Y. Ensign to
Robert F. Mooney regarding issuance of a building permit for a
secondary dwelling to Cynthia Brossman, dwelling to be constructed
on parcel 78, Assessors sheet 40.
It is Mrs. Ensign's position that the building is not of such
standing that it would qualify under S4 Use reyUlations;.4.!. ~ ill
of the Zoning By-law ame_nded through Apr~l 4, ';J I';J, shown on page
4 of the current publication of the Zoning By-law.
This appeal is taken in order to have the building permit
issued by Norman Chaleki, Inspector of Buildings on January 8,
1980 revoked.
Pursuant to 8F Appeals, page 20, this notice is filed with
you this date and I request that you docket and transmit papers as
directed by S2 of 8F.

Dear ...Mr. Mooney:
Benjamin & Sally Rowles, as tenants by the entirety, hold a
one-half undivided interest in Lot 5, L.C. 380l5-B. The other
one-half undivided interest is owned by Cynthia Brossman.
In 1978, Ben Rowles applied, in his own name, to the HDC for
a certificate of appropriateness, File No. 7845, and subsequently
for a sewage disposal permit and finally for a building permit,
File No. 837-78.
After the above were issued, Ms. Brossman applied for stailar
permits to allow her to build a second dwelling on the Lot. William
H.Hays,III, at my request, wrote to Mr. Chaleki, Building In~ctor,
requesting an opinion from Town Counsel regarding the legality of the
above proceedings. (copy enclosed)
Subsequently, Michael Driscoll wrote on my behalf to Mr. Cbaleki
regarding the problem. (copy enclosed) Mr. Driscoll requested that
no permit issue for a second principal dwelling prior to receipt in
writing of Town Counsel's interpertation of the Zoning By-law of Nan-
tucket as it applies to this particular problem.
Section 4Al b(6), of the Zoning By-law makes provision for a secondary
dwelling on a lot. The secondary dwelling must have 20' greater or
lesser ground cover than the principal dwelling. The preble. in this
case is we appear to have two principal dwellings as evidenced by the
various public records.
As I read the Zoning By-law, and as it was interperted by Mr.
Hays and Mr. Driscoll, it seems pretty clear, even to the uninitiat.d,
that the Zoning By-law is certainly being circumvented, if not vlo1*t.ed.
I am certain there are two principal dwellings, each owned seperatE
ly by the Tenan~ in Common who applied for the various permits. At no
point in the series of application do Rowles and Brossman apply as
Tenants in Common.

The Zoning By-law clearly states that the two dwelll... sball
be in the same ownership. While the title to the 1..... i_ie.tes
a Tenancy in Common all other actions except the mort,... ae~ on
the first dwelling indicate a separate attitude in deal!ft9 with
con.t~uction of the houses involved.

make them a part of this request for a hearing to revoke t.e building
permit improperly issued by the Building Inspector.
