At a regular meeting of the OOP-FD ('P ~.PPFALS, held March 2l,
1980, at 3:00 P.M., at the 'ID'N AND CCUNTY aJUDlR7, in the matter
of the application of PEmR M. EIDRIDGF., attP.!'ded to the awlication
of RIC$.RD SEIBERl' at meeting held February l5, 1980, after due
deliberation, the Board found:
1. This is a peti ticn for a variance fran the prcwisicns
of Section V, Intensity Regulaticns, to allow the construction
of a garage on Lot 587, Land CcA.1rt Plan No. 5004-24, Tan Nevers,
wt-.ich \<<luld exceed the allowable grourrl caver. The garage would
be approximately 440 square feet.
2. This property was purchased in 1971 as a one-acre lot
\td. th 50% ground. CCNer all~. In the later aneronent to the
Zoning By-Law, the area was increased to 120,000 square feet arrl
the grourii CCNerage reduced to 2%. 'Jllis garage \tPUld exceed the
allowable ground cover by 260 square feet. '!he owner c1ailt1s a
hardship due to lack of storage facilities for hrosing his vehicle
an::1 boat for protection fran the elarents. The char~e in zening
classification has left him with insufficient coverage to build
the necessary garage.
3. The Foard firrls as a matter of public policy that a
garage in this area is a useful an::1 necessary accessory buildiR3'.
The relief sought may be granted without detriment to the intent
an::1 purpose of the by-lin'l. '1l1e Peti timer has a haclship due to
the fact that the zening chan;:Je has left him bereft of groorxl cover
an::1 this is a hardship peculiar to thi.s lot wi'ich is oot UAIIIO'l
to other 1an::1 in the area.
4. By unaniJrous vote, the variance is granted in order to
build a garage approximately 440 square feet on rm: 587 of Larrl
Court Plan No. 5004-24.
