ADDENDUM "A"
Heather M. Reisman ("Reisman") is the owner of a pre-existing, non-conforming cottage
and lot located at 2 Western Avenue, Surfside, Nantucket, Massachusetts 02554 shown as Lot B-
1 on Land Court Plan No. 8697-B at the Nantucket Registry District ("Reisman Property"). The
Reisman Property is also shown as Parcel 59 on Nantucket Assessor's Map 87. The Reisman
Property is non-conforming as to area, frontage, front yard set back distance, and side yard set
back distance. Specifically, the Reisman Property has an area of l4,940::t square feet, fifty (50')
feet of frontage on W estern Avenue, no front yard set back from W estern Avenue, and the
western side of the cottage is approximately 7.95' from the westerly lot line. The intensity
regulations for the R-2 District require a minimum lot area of20,000 square feet, minimum
frontage of75 feet; a minimum front yard set back distance of30 feet; and a minimum side yard
set back distance of 10 feet.
Gerald W. Schwartz is the owner of two (2) parcels of vacant land which abut the
Reisman Property. Parcel One has an area of approximately 1,045::t square feet and is shown as
Lot 3 on a plan recorded as Plan No. 2008-67 at the Nantucket Registry of Deeds, Parcel Two
has an area of 1,961::!:: square feet and is shown as Lot 4 on said Plan. The aggregate area of
Parcels One and Two is 3,006::t square feet ("Schwartz Property").
Schwartz and Reisman seek a Special Permit pursuant to Section 139-33A(8) of the By-
Law to permit Schwartz to convey the Schwartz Property to Reisman in order to enlarge the area
of the Reisman Property, to reduce its front yard set back non-conformity, to increase its
frontage, and to eliminate the existing side yard set back non-conformity. Specifically, the
merger of the Schwartz Property and the Reisman Property will create a new "Merger Lot" with
an area of approximately 17,946::!:: square feet, frontage of 61.05::!:: feet along Atlantic Avenue and
W estern Avenue, a front yard set back distance of 8 feet, and elimination of the side yard set
back non-conformity.
Although the "Merged Lot" will be non-conforming as to minimum front yard set back
and minimum area requirements, the "Merged Lot" will be more conforming that the existing
Reisman Property. Reisman and Schwartz ask the Board of Appeals to grant them a Special
Permit pursuant to Section 139-33A(8) of the By-Law to create the newly configured "Merged
Lot". The new lot will be substantially more beneficial to the neighborhood than the existing
Reisman Property.

Portions of Poplar Street, Cherry Street, Atlantic A venue and Western Avenue
THE TOWN OF NANTUCKET, a Massachusetts municipal corporation having a
principal place of business at 16 Broad Street, Nantucket County, Massachusetts, acting by and
through its Board of Selectmen for consideration paid and in full consideration of FIFTEEN
THOUSAND ONE HUNDRED TWENTY-FIVE and 001100 ($15,125.00) DOLLARS GRANT
TO: GERALD W. SCHWARTZ, c/o ONEX CORP., 161 Bay Street, Suite 4900, Toronto,
Ontario, Canada M5J 2S 1,
All of its right, title and interest in Four (4) parcels of vacant land situated in Surfside,
Nantucket Town and County, Commonwealth of Massachusetts, and bounded and described as
follows:
PARCEL ONE:
A portion of Poplar Street containing 19,513i: square feet, more or less, and shown as
Lot 1 on the Plan of Land in Nantucket, Mass. prepared for Board of Selectmen, Town of
Nantucket, dated July 24, 2008 by Blackwell & Associates, Inc., Professional Land Surveyors,
and recorded as Plan No. 2008-67 at the Nantucket County Registry of Deeds ("Registry").
PARCEL TWO:
A portion of Cherry Street containing 6,OOO:!: square feet, more or less, and shown as
Lot 2 on said Plan.
PARCEL THREE:
A portion of Atlantic Avenue containing 1,04 5i: square feet, more or less, and shown as
Lot 3 on said Plan.

PARCEL FOUR:
A portion of West em Avenue containing 1,961! square feet, more or less, and shown as
Lot 4 on said Plan.
RESTRICTIONS
The grantor's conveyance of Parcels One and Two is based in part on the grantee's
warranty and representation to the grantor that such parcels shall be used for residential purposes
only and shall, for all intents and purposes, be combined with and considered as one parcel with
the abutting property previously acquired by grantee pursuant to the deeds recorded at the
Registry in Book 1111, Page 284 and Book 1017, Page 39, known as Town Assessor Map 87,
Parcels 106, 107, 108, 109 and 110, numbered 11 Nonantum Avenue, and shown as Lots 1-14 of
Block 218 on the plan tiled with the Registry in Plan File No. 3-D (collectively, the "Combined
Premises"), and that no part of the Combined Premises shall be hereafter divided, subdivided or
conveyed as a separate parcel or parcels, unless prior vmtten permission is granted by the Town
of Nantucket Board of Selectmen and such permission is recorded at the Registry. Accordingly,
the parcel hereby granted to the grantee is conveyed subject to a permanent restriction held by
the grantor, forever restricting the Combined Premises to residential use and prohibiting the
division or subdivision of the parcel and the use of the parcel apart from the Combined Premises.
These restrictions shall run with the title to the Combined Premises, and no part of the Combined
Premises shall be hereafter used or conveyed in a manner inconsistent with these restrictions
unless a prior written release is granted by the Town of Nantucket Board of Selectmen and filed
with the Registry.
The grantee further agrees for itself and his successors, heirs and assigns that if for any
reason such restrictions on the use of the Combined Premises shall be deemed subject to
sun-setting provisions, terminated, void or voidable, or other principles requiring duration less
than perpetual, then the grantee and his successors, heirs and assigns shall undertake all
reasonably necessary measures to ensure that the Combined Premises remain used in a manner
consistent with the terms of and intent of this instrument.
The conveyance hereby made has been completed in full compliance with the
requirements of Massachusetts General Laws chapter 44, section 63A.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday,
August 13, 2009 at 1:00 P.M., in the garage area at 2 Fairgrounds Road, Nantucket,
Massachusetts 02554, the Board made the following decision on the application Gerald W.
Schwartz and Heather M. Reisman, c/o ONEX Corp., 161 Bay Street, Suite 4900, Toronto,
Ontario, Canada, M5J2S1, Board of Appeals File No. 037-09:
2. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-33.A.(8) (alteration of preexisting, nonconforming lots) to merge the existing
14,940i: square foot lot with the abutting 3,006i: lots. The newly merged lot will be
nonconforming as to minimum front yard setback and minimum area requirements; but, will be
more conforming than the existing lot. The site is located at 2 W estern Avenue, is shown on
Nantucket Tax Assessor's Map 87 as Parcel 59, is shown on Land Court Plan No. 8597-B and
Plan No. 2008-67 as Lots B-1, 3 and 4, respectively, and is registered at the Nantucket County
Registry of Deeds as Certificate of Title No. 22862. The site is zoned Residential- 20.
3. Our decision is based upon the application and accompanying materials, and
representations, and testimony at our public hearing. The Planning Board made no
recommendation on the basis that no matters of planning concern were presented. No members
of public commented on this application.
4. The Applicants are requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139-33.A.(8) to merge the existing 14,940i: square foot lot with the abutting
3,006i: lots. Ms. Reisman is the owner of the pre-existing, nonconforming 14,940i: lot. This lot,
located in the R-2 zoning district, is nonconforming as to area, frontage, front yard setback, and
side yard setbacks. The minimum lot size in the R-2 zoning district is 20,000 square feet. The
required frontage in this zoning district is seventy-five (75) feet (Reisman has fifty [50] feet of
frontage) and the front yard setback is thirty (30) feet (Reisman has no front yard setback).
Finally, the side yard setback in this zoning district is ten (10) feet (Reisman's cottage is
approximately 7.95' from the westerly lot line).
Accordingly, one of the abutters, Mr. Schwartz, is transferring two parcels to Reisman.
These parcels are 3,006i: square feet combined. Pursuant to Nantucket Zoning Bylaw Section
139-33.A.(8), the Applicants are requesting Special Permit relief in order to enlarge the area of
the Reisman property, thereby reducing its front yard setback nonconformity, increasing the
frontage, and eliminating the side yard setback nonconformity. The newly merged lot will have
a total area of approximately 17,946i: square feet, frontage of 61.05i: feet along Atlantic Avenue
and W estern Avenue, a front yard setback distance of eight (8) feet, and will eliminate the side
yard setback nonconformity. Although the proposed transfer will not cure all nonconformities, it
will make the Reisman property less nonconforming than what presently exists.
5. Based on the foregoing, the Board finds that the proposed reconfiguration of the lot
lines to allow the merger of the property creates no new nonconformities, does not increase any
nonconformity, but instead reduces the lot size nonconformity of the Applicants' property. The
Board therefore deems the newly merged 17,946 ::!:: square foot lot a pre-existing non-conforming
lot of record with all dimensional benefits under Sections 139-33 and 139-16 of the Nantucket
Zoning By-Law. The Board further finds that such reconfiguration of lot lines would not be
substantially more detrimental to the neighborhood than existing lot lines, or contrary to the
general purpose and intent of the Zoning By-law.
6. Accordingly, the Board of Appeals, by a UNANIMOUS vote GRANTS the
requested SPECIAL PERMIT relief to allow the reconfiguration of lot lines by merger the
Applicant' property at 2 Western Avenue, upon the following conditions:
a. The resulting merged Premises shall be shown, respectively, as Lot 3, Plan No. 2008-
67, Lot 4, Plan No. 2008-67, and Lot B-1, L.C.C. 8597-B on the plan entitled "Site
Plan to Accompany Zoning Board of Appeals Application," prepared by Blackwell
and Associates, Inc., dated July 15, 2009, herein attached as "Exhibit A"; and,
b. The merged Premises shall be considered a single building lot under the Nantucket
Zoning Bylaw, as amended.
