TO THE NANTUCKET DREAMLAND FOUNDATION
APPLICATION FOR VARIANCE
The Nantucket Dreamland foundation (hereinafter "Applicant") seeks a Variance,
pursuant to Section 139-32 A of the Nantucket Zoning By-law, from the requirements of Section
139-7 A (8) to allow a tent to be erected for a period exceeding thirty (30) days per year.
Applicant proposes to install a tent upon the Premises for the period oftime spanning September
7,2009 through October 31,2009. The proposed hours of operation for the tent are daily from
9:00 a.m. through 10:00 p.m.
The Applicant proposes to use the tent for the showing of movies and staging of
fundraisers for The Nantucket Dreamland Foundation; the showing of films by the sponsors of
the Nantucket Film Festival; and the use ofthe tent by the Dreamland and other island non-profits
for their sponsorship of fundraisers, farmers markets, festivals and the like. The tent shall be used
in the same fashion and for the same purposes the Applicant would use the Dreamland Theater
were it not in the process of being rehabilitated and reconstructed.
Applicant proposes to outfit the tent with a movie screen, projector, sound system and
small riser stage and in this way will be able to accommodate movies and other events.
The proposed hours of operation for the tent and premises are daily from 9:00 a.m.
through 10:00 p.m. during the weeks the tent is erected and after removal of the tent, use of the
premises from 9:00 a.m. through 6:00 p.m. on weekends (Saturdays and Sundays).
The requested relief is harmony with the intent and purposes of the Nantucket Zoning
By-law. Given circumstances relating to the Dreamland Theater that historically improves Locus,
which is being the removed and reconstructed, and especially affecting this locus and not
affecting generally the zoning district in which it is located, a literal enforcement of the
provisions of by-law would involve substantial hardship to the Applicant.
This desired relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from intents and purposes of the by-law. The
Applicant asks the Board to vote in favor of the Variance as requested.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, August 13, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 036-09 of Nantucket Dreamland Foundation,
cj 0 Vaughan, Dale, Hunter, Stetina, and Beaudette, PC, PO Box 659, Nantucket,
MA 02554.
2. Applicant is requesting a modification of the variance granted in Zoning
Board of Appeals File No. 020-09 to allow the tent to be erected through October
31,2009. The site is located at 17 South Water Street and 18 Easy Street, is shown
on Nantucket Tax Assessor's Map 42.3.1 as Parcels 11.1 and 11.2, is shown on
Land Court Plan 8786-D, and is registered at the Nantucket County Registry of
Deeds as Certificate of Title No. 22759. The site is zoned Commercial
Downtown.
3. Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning
Board made no recommendation finding that the Application did not present
any issues of planning concern. No abutter comment was received either in
favor of or against the Application.
4. Attorney Bill Hunter represented the Applicants at the hearing. Attorney
Hunter explained that the Applicants are requesting a modification of the
previously issued Variance in ZBA File No. 020-09 to allow the tent to be erected
on site to November 1. The original variance allowed the tent to be erected until
September 7 (Labor Day).
5. Therefore, the Board finds that owing to the circumstances relating to the
soil conditions, shape or topography of such land or structures and especially
affecting such land or structures but not affecting generally the zoning district in
which it is located, a literal enforcement of the provisions of this chapter would
involve substantial hardship, financial or otherwise, to the petitioner, and the
requested modification may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the intent or
purpose of said bylaw.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by VARIANCE pursuant to Nantucket Zoning Bylaw Section
139-32 from the requirements of Nantucket Zoning Bylaw Section 139-7(A) to
allow a tent to be erected for longer than thirty (30) days from July I, 2009
through November I, 2009, with the conditions found in ZBA File No. 020-09
there were five (5) votes in favor and none (0) opposed.
