Addendum A
The building at 10 Washington Street had been converted from a garage to a liquor store
in 1985, and the 15 parking spaces required for that retail use were waived in the decision
in ZBA File No. 009-85 (copy attached) on the condition that 2 parking spaces would be
provided on the site.
While the adjacent lot at 12 Washington Street has been and is in common ownership, its
use was and continues to be separate, first as a gas station (see ZBA File No. 092-85,
copy attached) and now as a bus stop for the Nantucket Regional Transit Authority's bus
system. Both lots conform to minimum lot size and frontage requirements under current
zoning as shown on the attached portion of a survey prepared in 2007.
The most recent use of the building at 10 Washington Street has been as a visitor
information center during the summer months, with retail use during the off-season. This
fall, Nantucket Community School will be offering daytime adult education classes in the
building for no more than 20 students at a time. Renovations to make the building
handicap accessible and to install bathroom facilities that can be open to the public were
recently completed.
Historically, cars have pulled in from Washington Street to park on unmarked pavement
in front of the building. Last summer the asphalt area in front of the building was
blocked with landscaping, bike racks and tables to provide a pedestrian-friendly area.
This spring, at the request of the Zoning Enforcement Officer, five parking spaces were
delineated by striping on the property. The applicant requests that the parking
requirements for the summer information center be waived pursuant to Section 139-18 so
that the paved area can be dedicated as open space for pedestrian use and bicycle parking.
The five parking spaces would then be made available for the educational or other off-
season uses which would begin after September 15th.
In the alternative, the applicant requests either that the existing lay-out of five parking
spaces on the site be approved as a modification of the special permit granted in File No.
009-85.

DECISION:
1, At a public hearing of the Nantucket Zoning Board of Appeals, on
Thursday, August 13,2009, at 1:00 P.M., 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
BOA File No. 035-09 of GREENHOUND LLC of 50 Main Street, Nantucket, MA
02554 in connection with property known as 10 Washington Street, Nantucket,
Massachusetts,
2. Applicant is seeking relief by SPECIAL PERMIT pursuant to
Nantucket Zoning By-law Section 139-18 (parking requirements) to seasonally
waive the parking requirements for the summer information center so that the
paved area can be dedicated as open space for pedestrian use and bicycle
parking. These five (5) waived parking spaces would be then made available for
education or other off-season uses which would begin after September 15. In the
alternative, the Applicant is requesting a modification of the decision in Zoning
Board of Appeals File No. 009-85 that the existing lay-out of five (5) parking
spaces be approved. The site is located at 10 Washington Street, is shown on
Assessor's Map 42.3,1 as Parcel 142, and is shown as Lot 2 on Plan file No. 2-E.
The deed reference is Book 1109, page 94, The property is zoned Residential-
Commercial Downtown.
3, Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. No abutter comment was received either
in favor of or against the application and there were no letters on file.
4. Applicant represented that the building at 10 Washington Street
had been converted from a garage to a liquor store in 1985, and the 15 parking
spaces required for that retail use were waived in the decision in ZBA Pile No.
009-85 on the condition that two parking spaces would be provided on the site.
While the adjacent lot at 12 Washington Street has been and is in common
ownership, its use was and continues to be separate, first as a gas station (see
ZBA Pile No. 092-85) and now as a bus stop for the Nantucket Regional Transit
Authority's bus system. Both lots conform to minimum lot size and frontage
requirements under current zoning. The most recent use of the building at 10
Washington Street has been as a visitor information center during the summer
months, with retail use as a primary use during the off-season and as an ancillary
use in the summer, Renovations to make the building handicap accessible and to
install bathroom facilities that can be open to the public were completed in early
2009. This fall, Applicant proposes to have adult education classes taught in the
building for no more than 20 students at a time.
5, Historically, cars have pulled in from Washington Street to park on
unmarked pavement in front of the building. The Applicant has designated the
asphalt area immediately adjacent to the front of the building as a pedestrian
area with landscaping features and some benches. Limited bicycle racks are
provided on one side. Pive parking spaces were delineated by striping,
including one handicapped-accessible space, which spaces by necessity require
cars to back onto Washington Street. Given the volume of traffic on Washington
Street during the summer season, the minimal need for parking given the use of
the building in the summer as an information center with retail ticket and
merchandise sales activity only as an accessory use, and the need for additional
bicycle parking in the downtown, the Applicant requests that the parking
requirements for the summer information center be waived during the summer
so that the entire paved area at 10 Washington Street can be dedicated as open
space for pedestrian use and bicycle parking, The five existing parking spaces
would be made available only for the educational or other off-season uses that
would begin after September 15th and end by May 15th.
6. Based upon the foregoing, and in light of the Nantucket Regional
Transit Authority's use of the Applicant's adjoining property at 12 Washington
Street as a bus stop, the Board finds that the waiver of vehicular parking spaces
in the summer and the reinstatement of the five currently delineated spaces
during the off-season, would be in harmony with the general purpose and intent
of the Zoning By-law, not contrary to sound traffic and safety considerations,
and not be substantially more detrimental to the neighborhood than the waiver
granted for the liquor store use in our prior Special Permit for this location (ZBA
Pile No, 009-85) ,
7. Accordingly, by a UNANIMOUS vote, the Board of Appeals
GRANTS the requested relief by SPECIAL PERMIT pursuant to Nantucket

Zoning By-law Section 139-18 to modify its prior decision in ZBA File No, 009-85
to the extent necessary and to waive all required parking spaces from May 15
through September 15 of any given year, and all but for five parking spaces from
which cars back onto Washington Street from September 15 through May 15.
Relief is hereby conditioned upon the following:
a, There shall be at least four bicycle parking racks on the
property during the summer season,
b. In the event the property at 12 Washington Street ceases to
be used as a bus stop during the summer season, the
Applicant shall reinstate and maintain the five parking
spaces during the summer season, unless further relief is
granted by this Board.
