At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, August 13, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of Joseph J. McAlinden, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 032-09: 2. Applicant is seeking relief by Variance pursuant to Nantucket Zoning By-law Section 139-32 (variances), from the provisions of Nantucket Zoning By-law Section 139-16 (intensity regulations) in order to relocate, renovate, and add on to the existing dwelling, and to move the septic system and driveway; portions of all of said improvements are located on abutting property. The Applicant requests a reduction of both the front and side yard setback requirements to five (5) feet to accommodate the proposed work. The front yard setback in this zoning district is thirty (30) feet and the side yard setback is ten (10) feet. The site is located at 48 South Cambridge Street, is shown on Nantucket Tax Assessor's Map 59.3 as Parcel 42, is shown as Lot 389 on Land Court Plan 3092-27 ("the Locus"), and is registered at the Nantucket County Registry of Deeds as Certificate of Title No. 9125. The site is zoned Residential - 20. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing from the Applicant's attorney. The Planning Board found the matter not to be of planning concern. There was one letter in opposition received. 4. The Applicant has owned the Locus since 1980. Shortly after he purchased the property, the Applicant was advised that portions of the improvements upon the Locus encroached onto abutting land. Applicant has previously attempted to secure land from the abutting property owner in order to cure the encroachments, but has been unsuccessful in his efforts. Applicant now plans to relocate, renovate, and add on to the existing dwelling, and relocate the driveway and septic system, so that all of the improvements will be located within the limits of the Locus. The Locus borders Long Pond on two sides, and is significantly impacted by wetland constraints. Applicant has requested front and side yard setback relief in order to site the improvements as far away from the wetland areas as possible. The Applicant's attorney stated that since this application was filed, changes have subsequently been proposed to the Zoning By- law which would further increase required front yard setback in this district. Regardless of said change, because of the unique situation of the lot line encroachments and the wetlands, absent zoning relief, Applicant has no reasonable alternative in siting the improvements. Accordingly, reducing front and side yard setbacks to five feet will cure the encroachments and will afford maximum separation from the wetlands. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested VARIANCE from the front and side yard setbacks of the Zoning By-law, finding that owing to circumstances relating to the topography and shape of the Locus and especially affecting the Locus but not affecting generally the zoning district in which the Locus is located, a literal enforcement of the provisions of the Zoning By-law would involve substantial hardship to the Applicant, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-law subject to the following condition: a: The foregoing relief is granted upon the condition that no exterior work permitted under this Variance shall be conducted between Memorial Day and Columbus Day of any year.
