ADDENDUM
Willard B. Ferris Trust, u/d/t dated February 20,2007, Willard B. Ferris,
Trustee and George Mallette Ferris, III, co-tenants, (hereinafter "Applicants")
seek a SPECIAL PERMIT and FINDING pursuant to Section 139-33(4)(a) and
(b) of the Nantucket Zoning By-Law (that "By-Law") and Massachusetts General
Laws, Chapter 40A, Section 6. The property is located at 8 Pochick Street,
Siasconset (the "Premises") and is improved with two dwellings, a 1 YS story
wood frame Primary Dwelling and a one-story wood frame Secondary Dwelling.
The Applicants are requesting the SPECIAL PERMIT to excavate and lift the pre-
existing non-conforming Primary Dwelling in order to reestablish the integrity of
the dwelling's sill and to construct a foundation wall, partial crawl space and
partial full basement under the structure. Once the foundation wall has been
constructed and the work on the structure's framing has been completed, the
dwelling shall be set back into place onto the new foundation in substantially its
original location on the lot. The Premises is located in the Siasconset Old
Historic (SOH) zoning district.
The Premises consists of two merged preexisting non-conforming lots of
land (Locus) totaling in their entirety approximately 6,240 +/- square feet in size
situated in a Zoning District with a minimum lot size of 5,000 square feet. Locus
is conforming as to frontage having frontage of 104 feet +/- on Pochick Street in a
Zoning District with a minimum frontage requirement of fifty (50') feet. Locus is
conforming as to ground cover ratio having a ground cover ratio of approximately
29.7 percent +/- in a Zoning District with a maximum allowable ground cover
ratio of 50 percent. Locus is conforming as to front-yard setbacks.
Both dwellings are non-conforming with respect to rear and side yard
setbacks with the Primary Dwelling being within four (4') feet of both the east
side property line and south rear property line and the Secondary Dwelling
approximately 2.1' at its closest point from the west side property line and 4.3'
feet from the south rear property line in a Zoning District with a side and rear
setback requirements of five (5') feet. The Premises is conforming as to
separation with the Primary and Secondary Dwellings separated by more than the
required twelve scalar (12') feet.
The proposed renovation of the Primary Dwelling ensures the preservation
of the historic structural viability of the dwelling and is in keeping with other
similar renovations that have recently taken place in this neighborhood and
therefore is not substantially more detrimental to the neighborhood.
By granting the SPECIAL PERMIT, the Board will be acting in a manner
consistent with the spirit and intent of Section 139-33A of the By-Law. In the
alternative and to the extent one may be necessary or required, the Applicant
requests a V ARIANCE for the proposed work.
The Applicants respectfully request that the Board vote in favor of the
requested SPECIAL PERMIT.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, August 13, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 031-09 of Willard B. Ferris Trust, Willard B.
Ferris, Trustee and George Mallette Ferris, III, co-tenants, cj 0 Vaughan, Dale,
Hunter, Stetina, and Beaudette, P.C, PO Box 659, Nantucket, MA 02554.
2. Applicants are requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-33.A.(4)(a) and (b) (alteration of pre-
existing, nonconforming structure) in order to lift their pre-existing
nonconforming primary dwelling in order to reestablish the integrity of the
dwelling's sill and to construct a foundation wall, partial crawl space, and full
basement under the structure. The structure will thereafter be set back into place
onto the new foundation in substantially its original location on the lot. The site
has two dwellings and both are nonconforming with respect to rear and side
yard setbacks. In the alternative, the Applicants are requesting Variance relief
pursuant to Nantucket Zoning Bylaw Section 139-32 (variances) from the
intensity regulations in Nantucket Zoning Bylaw Section 139-16 (intensity
regulations) to complete the requested work. The site is located at 8 Pochick
Street, Siasconset, is shown on Nantucket Tax Assessor's Map 73.3.2 as Parcel 11,
and is recorded at the Nantucket County Registry of Deeds in Book 1130, Page
118. The site is zoned Siasconset Old Historic.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board recommended that the board grant the requested relief. No
abutter comment was receiving in favor or opposed to the Application.
4. At the hearing, the Applicant was represented by counsel. Counsel for the
Applicant stated that the Applicants are requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139-33.A.(4)(a) and (b) in order to
lift their pre-existing, nonconforming primary dwelling in order to reestablish
the integrity of the dwelling's sill and to construct a foundation wall, partial
crawl space, and full basement beneath the structure. In the alternative, the
Applicants are requesting variance relief pursuant to Nantucket Zoning Bylaw
Section 139-32 from the intensity regulations in Nantucket Zoning Bylaw Section
139-16 to complete the requested work.
Counsel informed the Board that there are two dwellings on the locus and both
of which are non-conforming as to rear and side yard setbacks. The primary
dwelling is within four (4) feet of both the east side property line and the south
rear property line. The secondary dwelling is approximately 2.1' at its closest
point from the westerly side property line and 4.3' from the south rear property
line. The dwellings are located in a property district where the side and rear
yard setback requirement is five (5) feet.
Counsel stated that the proposed renovation of the primary dwelling ensures the
preservation of the historic structural viability of the dwelling and is keeping
with other similar renovations that have taken place in the neighborhood.
5. Therefore, based on the information presented by Applicants'
counsel, the Board found that the proposed renovation will not be substantially
more detrimental than the existing nonconforming structure to the
neighborhood.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33.A.(4)(a) and (b) in order to lift their pre-existing, nonconforming
primary dwelling in order to reestablish the integrity of the dwelling's sill and to
construct a foundation wall, partial crawl space, and full basement beneath the
structure in substantial compliance with the plan entitled "Site Plan to
Accompany Board of Appeals Application" prepared by Blackwell and
Associates, Inc., dated May 15, 2009, attached hereto as "Exhibit A," there were
five (5) votes in favor and none (0) opposed upon the following conditions:
A) The footprint of the structure shall remain the same;
B) The final height of the structure shall not be more than eight (8)
inches higher than what presently exists;
C) There shall be no exterior construction prior to the Tuesday after
Labor Day and after Memorial Day of any year; and
2
D) The Applicant will protect the easterly and southerly boundary so
as not to encroach on the abutters property.
