The locus is about 6,529+ I-SF and has 65 feet of frontage in a zoning district (ROH)
where 5,000 SF of area and 50 feet of frontage are required. The current ground cover is
23.4% and the proposed ground cover is 28.4% in a zoning district where 50% ground cover
is allowed. The two story single family dwelling (1,530+ I - SF) is sited about 0.9 feet from
the Easterly side lot line at the closest point, where the minimum setback is 5 feet. This
nonconformity is grandfathered as preexisting the Nantucket Zoning Bylaw adopted in
1972. The locus and structure thereon are conforming in all other respects.
Applicants propose to alter the pre-existing nonconforming house by lifting it and
placing a basement underneath it. A portion of the eastern side of the structure is within the
side setback and would be so altered. Applicants also propose to add three additions
totaling approximately 327 SF, none of which are in the setback or would push the structure
over the allowed ground cover.
Accordingly, Applicants request relief by Special Permit under Nantucket Zoning
Bylaw Section 139-33.A(4) for the alteration of the existing single family dwelling, as above,
where the changes are not substantially detrimental to the neighborhood than the existing
nonconformities, and there is no new nonconformity or increase in any nonconformity.

DECISION:
I. The Nantucket Zoning Board of Appeals held public hearings on July 9 and August
13, 2009, in the Garage Area at 2 Fairgrounds Road, Nantucket, Massachusetts regarding the
application of James W. Reinig and Ellen T. Reinig, c/o Reade, Gullicksen, Hanley & Gifford,
LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, Board of Appeals File No. 026-
09. The Board made the following Decision.
2. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-33.A(4) (alteration of pre-existing, nonconforming structure) in order to lift their
pre-existing nonconforming structure and place a basement beneath it. A portion of the eastern
side of the structure is within the side yard setback as close as 0.9 feet from the side yard lot line
in a zoning district that requires a five (5) foot side yard setback. The Applicants also propose to
add three (3) additions totaling approximately 327 square feet, none of which are in the setbaek
or would place the structure over the allowable ground cover. The current ground cover ratio is
23.4% and the proposed ground cover ratio is 28.4% in a zoning district with a maximum ground
cover ratio of 50%.
The site is located at 15 Milk Street, is shown on Nantucket Tax Assessor's Map 42.3.3
as Parcels 85 and 131, and is recorded at the Nantucket County Registry of Deeds in Book 929,
Page 166. The site is zoned Residential Old Historic.
3. The locus is about 6,529+/- SF and has 65 feet of frontage in a zoning district (ROH)
where 5,000 SF of area and 50 feet of frontage are required. The current ground cover is 23.4%
and the proposed ground cover is 28.4% in a zoning district where 50% ground cover is allowed.
The two story single family dwelling (1,530+/- SF) is sited about 0.9 feet from the Easterly side
lot line at the closest point, where the minimum setback is 5 feet. This nonconformity is
grandfathered as preexisting the Nantucket Zoning Bylaw adopted in 1972. The locus and
structure thereon are conforming to the dimensional requirements of the Zoning By-law in all
other respects.
4. Applicants proposed to alter the pre-existing nonconforming structure by lifting it and
placing a full basement underneath it, including under some or all of the current setback
encroachments. Applicants plan to make other interior and exterior repairs and improvements to
the structure (three additions totaling approximately 327 SF) that do not require relief.
5. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, as no matter of planning concern was presented. Oral and written
presentations were made by the Applicants' representative, and no opposition or concerns were
presented by the abutters or the public. Applicants stated that such pre-existing nonconformities
are common in this area and that relief to install basements is commonly granted by the Board of .
Appeals in the ROH zoning district.
6. Therefore, based upon the foregoing, the Board of Appeals finds that the proposed
alteration of the structure within the setback area by adding a basement requires relief. The
Board also finds that said alteration to the structure would not be substantially more detrimental
to the neighborhood than the existing noneonformity. The Board also notes that a grant of relief
would not create any new nonconformities, would not increase any setback encroachments, and
would be consistent with similar relief granted to properties nearby and properties similarly
situated. The Board further finds that no relief is needed for the other proposed additions or
alterations.
7. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by
SPECIAL PERMIT pursuant to Nantucket Zoning By-law Sections 139-33(A)(4) to allow
construction of a basement under the existing structure in substantial complianee with materials
submitted to the Board and as approved under Certificates of Appropriateness issued or to be
issued by the Nantucket Historic District Commission, subject to the following conditions:
a. There shall be no exterior construction implementing the relief granted between the
Saturday before Memorial Day and September 15 of any year.
b. The Applicant shall provide for shoring of any excavation within five feet of any public
or private road.
